PRESENT: Hauer, Peltier, Potts, Schwab, McAllister Also - Charles Johnson and Howard Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Schwab seconded, to approve the minutes of the additional and regular meeting of October 6, 1986, after the following corrections have been made: Page 111- meeting called to order at 9:00 AM. Page 113 - (Harstad) The possibility of petitioning RCWD for a permit to clean the ditch east of Highway 61...... All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the minutes of the special meeting of October 13,1986 as submitted. All aye. Motion Carried. 4.0 APPROVAL OF MINUTES MO'T'ION: Potts made motion, Peltier seconded, to approve the General Claims for October 27, 1986 as submitted. All aye. Motion Carried. MO'T'.ION: Peltier made motion, Hauer seconded, to approve the Utility Claims for October 27, 1986 as submitted. All aye. Motion Carried. 5.0 PE'T'ITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Selection of 2nd Assistant Chief Councilman Hauer and Chief Istvanovich reviewed the applications, and recommended Jim Compton for the position of 2nd Chief. MOTION: Schwab made motion, Peltier seconded, to appoint James Compton to the position of 2nd Assistant Fire Chief. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to appoint Mark Olson to the Hugo FD. All aye. Motion Carried. MOTION: Potts made motion, Peltier seconded, to appoint Jeff Pearson to the Hugo FD. All aye. Motion Carried. This brings the rank of the Hugo FD to 29 - maximum of 33 allowed. October 27, 1986 The Fire Chief received a letter from Martin Schwartz requesting a leave of absence for 6 months because of his present work schedule (5 PM to 1:00 AM). Because of Marty's good work record, the Fire Chief recommended that the City not accept the his letter. MOTION: McAllister made motion, Peltier seconded, that the City Clerk write a letter to Martin Schwartz advising him that the City is aware of his unusual work hours, and that the City rejects his request for a leave of absence so long as his time spent in the FD satisfies the Fire Chief thereby satisfying the City Council. All aye. Motion Carried. The City received a letter from the Hugo Postmaster regarding identification of house numbers on mailboxes. MOTION: McAllister made motion, Peltier seconded, to schedule an additional regular meeting of November 17, 1986, at 6:15 PM, to watch the above referenced movie. All aye. Motion Carried. The Fire Chief inquired about using the new grassfire rig for certain fire and rescue calls. Let the record show that it is the consensus of the City Council that the newly purchased pickup truck may be used by officers as an advance tactical vehicle. 5.2 Marty Wegleitner - Subdivision Mr. Wegleitner is proposing the division of his property into three (3) parcels with the sale of one lot at the present time. An easement has been provided to provide access to Parcel A. Attorney Johnson will draft a maintenance agree- ment that will need to be recorded. Mayor McAllister clarified to Mr. Wegleitner what the city accepts as proof of ownership, and a copy of an abstract does not qualify. He will need to provide a letter from an attorney or an abstract company stating the fee owner of the property to be divided. MOTION: Schwab made motion, Potts seconded, to approve the subdivision request of Martin Wegleitner to divide property into two (2) parcels A and B subject to the following conditions: 1. Receipt of an updated certificate of survey with exact boundaries. 2. The access easement be drafted and recorded at Washington County. Construction and maintenance of the road (easement) and cul-de-sac will be done by the buyer and seller. 3. Applicant to provide an acceptable proof -of -ownership. 4. Martin Wegleitner to sign agreement for roadway maintenance as drafted by Charles Johnson. 5. Payment of $200.00 parkland dedication. All aye. Motion Carried. 5.3 McCullough/Gustafson - Rezonin Mr. Burch Gustafson, owner of Con=o, a garment manufacturing business, is interested in purchasing the McCullough property along Highway 61 (Midwest Seeder) so that he can move his business to Hugo. The property would need to be rezoned from RB to Ind. October 27, 1986 /1.j Mr. McCullough never completed his drainage pond as requested by RCWD. He has deposited a check in the amount of $2,000.00 as a sign of "good faith" that the pond will be installed as required. MOTION: Hauer made motion, Potts seconded, to adopt ORDINANCE 1986-jY4 AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE EN'T'ITLED "ZONING" BY AMENDING THE ZONING CLASSIFICATION OF THE DESCRIBED REAL PROPERTY. All aye. Motion Carried. 5.4 Garry Boyer - Complaint The Council inspected the Boyer property on 122nd Street, and determined no violation of any zoning codes. MOTION: McAllister made motion, Potts seconded, that Councilman Schwab contact Garry Boyer suggesting that he construct a fence along his west property line to appease his neighbor, and notify him that cars must be licensed. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the City Clerk write a letter to the complaintant on the Garry Boyer matter and advise him that the City Council does not find Mr. Boyer in violation of any zoning ordinances. All aye. Motion Carried. 5.5 George Indykiewicz - Mining Permit Howard Kuusisto inspected the area and stated that everything looks fine. MOTION: McAllister made motion, Hauer seconded, to renew the Mining Permit for 'George Indykiewicz for one year. All aye. Motion Carried. FRANK MILLER Mr. Miller, representing Janet Pfurtscheller, was present to discuss the Site Plan submitted for construction of a 30 x 48 pole building on 16 acres located on the east side of Round Lake. There was a discrepancy in the property lines on the plan submitted that is to be corrected. The property is zoned RR2 and meets the square footage requirements. MOTION: Schwab made motion, Peltier seconded, to approve the Site Plan for Janet Pfurtscheller, 8745 122nd Street, for the construction of a 30 x 48 pole building to be used for personal storage. Approval subject to submission of a corrected site plan showing actual property lines. All aye. Motion Carried. RONALD SCOBIE - Variance Mr. Scobie, 7676 120th Street, needs a variance to construct a 40 x 56 pole building closer to the road than the principal structure. The property is zoned AG, and the total square footage of the accessory buildings would be below the allowed 3600 sq ft. October 27, 1986 Mr. Scobie stated that the building would be used for antique cars and gas pumps which he collects. MOTION: McAllister made motion, Hauer seconded, to approve the variance request of Ron Scobie, 7676 120th Street, for the construction of a 40 x 56 pole building closer to the road than the principal structure. All aye. Motion Carried. 6.0 ORDINANCES AND RESOLUTIONS - No discussion. 7.0 UNFINISHED BUSINESS - No discussion. 8.0 NEW BUSINESS MOTION: McAllister made motion, Potts seconded, to adopt RESOLUTION 1986-24, A RESOLUTION ORDERING THE CITY CLERK'S OFFICE TO INFORMN*Y LENDING INSTITUTIONS OR ANY OTHER REQUESTOR, THAT THE CITY DOES/PROVIDE INSPECTIONS OR CERTIFICATION SERVICES FOR WELLS OR SEPTIC SYSTEMS. THEY ARE TO CONTACT A PRIVATE LABORATORY OR CONTRACTOR OF THEIR CHOICE. All aye. Motion Carried. MOTION: Potts made motion, Peltier seconded, to renew the Cathodic protection contract with Pennwalt Corporation for an annual cost of $290.00. All aye. Motion Carried. The City received a letter from the MinnDOT stating that they are temporarily condemning Irish AVenue, north of County Road 8A for the 35W project. A letter is to be sent to Richard Braun stating that Irish Avenue had just been resurfaced and that Hugo expects the road to be left in the same condition. The City has received letters from a resident and a cable company regarding ser- vicing Hugo with cable T.V. MOTION: McAllister made motion, Schwab seconded, to send Mike Busha a letter stating that the 1986 Council does not feel there is time left to effect- ively study the cable matter, and that the 1987 Council will most assuredly move forward with the project. All aye. Motion Carried. The City received a letter from the Washington County Public Health Department stating that Hugo is eligible for $1157.00 for solid waste management. They need a letter from Hugo authorizing them to give the money to Forest Lake Township Recycling Center. Hugo's scout troop asked that the letter be held until the next Council meeting to enable them to contact FL to see if their troop could be designated to received the allocation. The City received a bid proposal from Tom Bernier to take care of snowplowing the City Hall parking lot area and the lift stations at a rate of $40.00/hour. MOTION: McAllister made iyiotion, Peltier seconded, to notify Tom Bernier that the City is satisfied with the present snowplowing arrangement (Hugo Feed Mill), and will keep his proposal on file for further reference. All aye. Motion Carried. October 27, 1986 9.0 ATTORNEY AND ENGINEER Howard Kuusisto submitted his monthly report. The Council discussed the Harstad development and the drainage ditch on the east side of Highway 61. Harstad Companies deposited a check for $10,000 thereby allowing the Engineer to proceed with the feasibility study. This study should help clarify questions regarding drainage for this project. DNR will need to be contacted for any permits needed because of the protected wetlands. MOTION: Potts made motion, Peltier seconded, to approve Project G153936 for NSP. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve Project HURC-PAL-AAC for NSP. All aye. Motion Carried. MOTION: Potts made motion, Peltier seconded, to approve Project HURC-NEL-AAE for NSP. All aye. Motion Carried. 10.0 CLERK MOTION: Hauer made motion, Peltier seconded, authorizing Carole LaBelle to attend a secretarial seminar on December 8th and City will pay $49.00 fee. All aye. Motion Carried. Attorney Johnson has been corresponding with Attorney Robert Herr regarding an easement in the southeast portion of Hugo. The City will need to respond further regarding the easement and it was discussed as to whom would be paying our legal costs. The City Attorney is to dictate Hugo's response to the Clerk's office for typing. After review of the letter by the Council, and payment by Mr. Herr of any legal/engineering costs, the Clerk can release the letter. The Bui ling Inspector reported to the Council that Richard Koecher has failed to respond he city's correspondence regarding the construction of a building without a permit. MO'T'ION: McAllister made motion, Hauer seconded, that this matter be forwarded to the city prosecuter for investigation. If there is a Building Code violation, the city prosecuter shall start criminal proceedings. All aye. Motion Carried. The Building Inspector will inspect the David Schumann property on 137th Street for possible building code violation for construction without a permit.
