PRESENT: Hauer, Peltier, Potts, Schwab, McAllister Attorney, Charles Johnson Engineer, Howard Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Schwab made motion, Peltier seconded, to approve the minutes of 11/3/86 as submitted. VOTING FOR: Hauer, Potts, Schwab, McAllister ABSTAINED: Peltier Motion Carried. MOTION: Peltier made motion, Hauer seconded, to approve the minutes of the Board of Canvass on 11/5/86 as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS WfION: Peltier made motion, Hauer seconded, to approve the General Claims for November 17, 1986 as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the Utility Claims for November 17, 1986, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUES'T'S, COMMUNICATIONS AND LICENSES 5.1 Marvin Bontrager - Rezoning Eileen Bayless, fee owner of the property, represented by Peter Coyl, will be withdrawing application for rezoning - File No. 1986-2-RZ. 5.3 White Bear Ambulance Contract MOTION: Potts made motion, Peltier seconded, authorizing the Mayor and City Clerk to sign the contract between Hugo and -White Bear Lake for ambulance :services. All aye. Motion Carried. 5.4 Richard Meath - Renew of Mobile Home Permit MOTION: Peltier made motion, Schwab seconded, to renew the mobile home permit held by Richard Meath for a 90 day period. All aye. Motion Carried. /,� U November 17, 1986 MOTION: Schwab made motion, Potts seconded, to adopt ORDI14ANCE 1986-238, AN ORDINANCE AMENDING CHAPTER 20 ENTITLED "ADMINISTRATION" OF THE HUGO CITY CODE TO INCLUDE SOUND RECORDING OF MEETINGS AND TO PROVIDE FOR RETENTION OF SUCH RECORDINGS. All aye. Motion Carried. 5.2 Interstate Lumber Co - Site Plan Approval (CB District) The Interstate Lumber is proposing the construction of a 6500 sq. ft. cold storage warehouse that would be attached to the existing structure. The drainage plan was reviewed by the City Engineer, and it was his recommendation that two new catch basins be installed and the existing catchbasin be closed. The City will also require a letter of consent from the Burlington Railroad for construction of the building on their property. MO`T'ION: Hauer made motion, Peltier seconded, to approve the Site Plan for Interstate Lumber to construct a 6500 sq. ft. cold storage building to its existing structure subject to the following conditions: 1. Submission of a letter from the Burlington Northern Railroad stating approval of the construction on their property. 2. Drainage plan, as recommended by the City Engineer, for in- stallation of two catchbasins and the blockage of the existing basin, be implemented. All aye. Motion Carried. 5.5 PUBLIC HEARING (7:30 PM) - Rural/Urban Taxing District The City of Hugo is currently split into two taxing districts - urban, paying 100% of the city's mill rate, and rural, paying 80%. The City is considering elimination of the rural taxing district thereby all city taxes be paid at a rate of 100%. Larry Hanson submitted a Memorandum of Opposition to the Proposed Ordinance along with a petition with a list of Hugo property owners opposed to abolishment of the rural taxing district. There was a lengthy discussion, with many residents of the City present, stating their reasons why the present taxing districts should stay in place. The reason this issue was even scheduled for public hearing because of a belief that all Hugo benefits equally from General Fund services The entire public hearing has been taped with copies of same on file at City Hall. proposed MOTION: Hauer made motion, McAllister seconded, to adopt/ORDINANCE 1986-239, AN ORDINANCE ABOLISHING ALL RURAL TAXING DISTRICTS WITHIN THE CORPORATE LIMITS OF THE CITY OF HUGO, MINNESOTA. VOTING FOR: NONE Motion Failed. a revised MOTION: McAllister made motion, Schwab seconded, to adopt/ORDINANCE 1986-239, AN ORDINANCE REGULATING ALL TAXING DISTRICTS WITHIN THE CORPORATE LIMITS OF THE CITY OF HUGO, MINNESOTA. VO'T'ING FOR: Hauer, Schwab, McAllister VO'T'ING AGAINST: Peltier, Potts Motion Carried. November 17, 1986 9.0 ATTORNEY AND ENGINEER 121 Attorney Johnson submitted his monthly report as well as a draft of findings and reasons for rejection of an amended SUP made by the White Bear Rod and Gun Club. This will be discussed at the additional regular meeting of 11/24/86. MOTION: McAllister made motion, Potts seconded, to schedule an additional regular meeting of the Hugo City Council for November 24, 1986, 7:00 PIVI, to discuss the White Bear Rod & Gun Club and any other appropriate city business. All aye. Motion Carried. PLANNING COMMISSION The City received a letter from Lisa Sampson, 6560 177th Street North, requesting consideration to serve on the Planning Commission. MOTION: McAllister made motion, Schwab seconded, that the Lisa Sampson applica- tion to serve on the Planning Commission for forwarded to the 1987 City Council for their consideration. VOTING FOR: Hauer, Potts, Schwab, McAllister VOTING AGAINST: Peltier Motion Carried. ENGINEER Mr. Kuusisto submitted a report regarding the status of Lots 3,4,5,6,7, and 8 for Royalhaven Estates (west side of Sunset Lake). All these lots required financial guarantees to cover filling of lots in compliance with the City Engineer's recommendations. MOTION: McAllister made motion, Peltier seconded, to release financial guarantees for all but Lot 6 (Castle Design) minus any engineering costs. All aye. Motion Carried.. MOTION: McAllister made motion, Peltier seconded, to extend the meeting past 11:00 PM. All aye. Motion Carried. 10.0 CLERK The Clerk received a phone call from Rick Busse regarding the division of his property on Ingersoll Avenue in exchange for donation of land for extension of Ingersoll Avenue and other road purposes. The Clerk was informed that any nego- tiations considered previously were no longer valid, and that Mr. Busse would need to go through the normal process for rezoning and subdivision, if desired. MOTION: McAllister made motion, Schwab seconded, to approve JOB ORDER HURL-EIC-AAH for Northern States Power. All aye. Motion Carried. November 17, 1986 MO'T'ION: McAllister made motion, Schwab seconded, that the City Administrator be authorized to purchase a dictating machine. VOTING FOR: Hauer, Potts, Schwab, McAllister VOTING AGAINST: Peltier Motion Carried. MOTION: Schwab made motion, Peltier seconded, to adjourn at 11:15 PM. All aye. Motion Carried.
