PRESENT: Peltier, Potts, Schwab, Hauer, McAllister City Attorney, Charles Johnson 3.0 APPROVAL OF MINUTES MOTION: Schwab made motion, Peltier seconded, to approve the minutes of December 17, 1984, after the following changes have been made: Page 140 (#20) - All manufactured homes shall meet..... Page 141 (10.0) - Let the record show that Mrs. Peltier did not vote against this motion. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Hauer made motion, Peltier seconded, to approve the General Claims for January 7, 1985, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Hauer seconded, to approve the Utility Claims for January 7, 1985, as submitted. MOTION: Schwab made motion, Peltier seconded, to approve the claim for Project 8407 as submitted, in the amount of $24,050.00. All aye.. Motion Carried. OFFICIAL APPOINTMENTS MOTION: Schwab made motion, Potts seconded, to designate the Forest Lake Times as the official newspaper for the City of Hugo, for the year 1985. All aye. Motion Carried. MOTION: Schwab made motion, Potts seconded, to designate the 1st State Bank of Hugo, all offices of Twin City Federal, and the First National Bank of St. Paul, as the official depositories for the City of Hugo, for the year 1985. AYE: Peltier, Potts, Schwab, McAllister ABSTAINED; Hauer Motion Carried Councilman Hauer will check into what latitude the city has for making deposits outside the "normal" banking institutions. MOTION: Potts made motion, Hauer seconded, to appoint Charles Schwab as acting Mayor for the year 1985. All aye. Motion Carried. January 7, 1985 MOTION: McAllister made motion, Peltier seconded, to designate Charles Johnson as City Attorney for the year 1985. All aye. Motion Carried. MOTION: Peltier made motion, Hauer seconded, to designate Howard Kuusisto as City Engineer for the year 1985. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the City Clerk draft a working schedule for Council members to act as liaisons to the Planning Commission on a rotating basis. All aye. Motion Carried. MOTION: Potts made motion, Schwab seconded, to designate Mayor McAllister as Roads Commissioner for the year 1985. AYE: Peltier, Potts, Schwab, Hauer NAY: McAllister Motion Carried. MOTION: McAllister made motion, Potts 9aconded, that Joseph McMahon be appointed to the position of temporary, acting Fire Chief, until April 1, 1985. AYE: Potts, Schwab, McAllister NAY: Peltier, Hauer Motion Carried. MOTION: Hauer made motion, Schwab seconded, to adopt RESOLUTION 1985-1, A RESOLU- TION ESTABLISHING A FIRE DEPARTMENT OPERATIONS REVIEW COMMITTEE FOR THE PURPOSE OF SOLICITING AND REVIEWING APPLICATIONS FOR FIRE CHIEF, ASSIS- TANT CHIEF, AND OTHER CANDIDATES CHOOSING TO SERVE ON THE DEPARTMENT, AS WELL AS ESTABLISHING A FIRE DEPARTMENT OPERATIONS MANUAL. AYE: Potts, Schwab, Hauer, McAllister NAY: Peltier Motion Carried. MOTION: McAllister made motion, Peltier seconded, that Leonard Charpentier, Ken Granger, and Jim Olson be appointed to the Fire Department Operations Review Committee. All aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, that the acting Fire Chief be given the authority to designate two (2) assistant chiefs, whose term shall expire concurrent with his, on April 1, 1985. AYE: Potts, Schwab, Hauer, McAllister NAY: Peltier Motion Carried. 3 January 7, 1985 AMENDED DEVELOPMENT AGREEMENT - Lake Air Estates MOTION: McAllister made motion, Peltier seconded, that the Mayor and City Clerk be authorized to execute the amended Development Agreement for Birchwood Builders, Inc. All aye. Motion Carried. BOARD OF APPEALS This board, which is now non-existent, will be comprised of the vice -chairperson of the Planning Commission, member of the City Council, and a citizen at large. Council representative from Wards 1, 2, and 3, are to suhniit a name from each ward, and one of the names will be drawn. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 PUBLIC HEARING The public hearing was called to order at 8:37 PM to consider the inclusion of wood- working shops in the AG and CONS district by Special Use Permit. William O'Mara, 16337 Harrow Avenue, was present and stated that there should be no commercial or industrial operations in the residential or rural area. There were no other public convents. The public hearing was closed at 8:40 PM, and the regular meeting called back to order. Peltier had looked at the Hubman operation, for which this public hearing was called, and did not feel his operation would be a problem. However, another operation could create a nuisance. It was determined that if this proposal passed, the city would need a definition of woodworking operations to protect the applicant as well as any adjoining landowners. MOTION: Peltier made motion, McAllister seconded, that the City Clerk be directed to draft an ordinance to allow woodworking shops in the AG and CONS districts by Special Use Permit only, and that a definition of woodworking shops be included. AYE: Peltier, Schwab, Hauer, McAllister NAY: Potts All aye. Motion Carried. 5.2 Frank Puleo - Rezoning Mr. Puleo, and his partners, requested a rezoning of approximately 8.8 acres from SFE to IND to accommodate the manufacturing of grab bars for the handicap in their accessory building. The Planning Commission recommended denial of the application. Adjoining landowners had no objection to the work being done, but did not want the property re- zoned to Industrial to eliminate any possible future problems. Mr. Puleo stated that he would do what had to be done to resolve the problem, but Mayor McAllister stated that the Council has limitations as to what they can and cannot do. The city was not aware of any manufacturing to be done in the garage when they appeared before the city for a Special Use Permit for its construction. MOTION: McAllister made motion, Hauer seconded, to ORDINANCE AMENDING CHAPTER 320 OF THE HUGO AMENDING THE DESCRIBED REAL PROPERTY. AYE: Peltier, Schwab, Hauer NAY: Potts, McAllister MOTION FAILED FOR LACK OF 4/5's VOTE. adopt ORDINANCE 1985-213, AN CITY CODE ENTITLED ZONING BY January 7, 1985 Mr. Puleo was informed that the illigal use will have to be terminated. VACANCY ON PLANNING COMMISSION The city received a letter from Arthur Potts indicating his resignation from the Planning Commission because of his recent election to the Council. Mr. O'Mara, present at the meeting, as well as John Granger, expressed their desire to serve on the Planning Commission. Howard Schletty submitted a letter indicating his interest. Because the Commission lacks "downtown" representation, it was the opi- nion of Mayor McAllister that Mr. Granger be selected. MOTION: McAllister made motion, Schwab seconded, to appoint John Granger to the Planning Commission to fill the seat vacated by Arthur Potts. Sole reason for appointment is that John Granger will be able to provide representation from the "old village area". AYE: Peltier, Schwab, McAllister NAY: Potts, Hauer Motion Carried. For the record, Potts voted "NO" because some of the other applicants may have more experience. MOTION: Peltier made motion, Potts seconded, to appoint Ken Lorch as Chairman of the Planning Commission for a four (4) year term. All aye. Motion Carried. MOTION: Potts made motion, Hauer seconded, to reappoint George Atkinson to the Planning Commission for a four (4) year term. All aye. Notion Carried. MOTION: McAllister made motion, Potts seconded, that a court reporter be retained for the public hearing of February 6, 1985, 7:00 PM, a joint meeting of the City Council and Planning Commission, for consideration of the appli- cation of the White Bear Rod & Gun Club for reasonable decibel limits relative to their Special Use Permit. All aye. Motion Carried. 5.3 Sandy Borndale - Special Use Permit Ms. Borndale is proposing the construction of a 72 x 240 pole barn to be used as a riding arena and for boarding purposes. The Planning Commission recommended approval subject to a number of conditions. Ms. Borndale submitted a letter signed by some neighbors, stating they had no objection to the proposal. William O'Mara, neighbor directly to the north, was present, and strongly stated his opposition to the building construction because of: flies, increased traffic, devaluation of his property, and possible contamination of his well because of the high water table. Mayor McAllister stated that this type of operation is permitted in the zone, but would require a SUP because of the size of the building. MOTION: McAllister made motion, Peltier seconded, to table this matter until 1/9/85, setting an additional regular City Council meeting at 6:00 PM, to give further consideration to the application of Sandy Borndale for a SUP. All aye. Motion Carried. January 7, 1985 5.5 Elsie Jasinski - City Initiated Rezoning The city previously approved a 10 acre land division. It came to light that the size was incorrect for the existing zoning. While typing these minutes, another error was discovered. Thought the land was zoned AG at the meeting of 1/7/85, but it is in fact CONS. Therefore, this matter will again be placed on agenda for a public hearing for rezoning from C to A. 5.6 MAPSI - Contract MOTION: Schwab made motion, Peltier seconded, to authorize the Mayor's signature on the 1985 animal control contract with MAPSI. AYE: Peltier, Potts, Schwab, McAllister NAY: Hauer Motion Carried. ART MUNGER - SPA Mr. Munger previously received SPA for the construction of an accessory building on his property on 165th Street. After review of the matter, it was determined that a SUP would be required, because they would exceed the 3600 square foot requirement. This matter will be addressed at the PC meeting of 1/9/85. MOTION: McAllister made motion, Peltier seconded, that this application be forwarded to the Planning Commission for consideration of a SUP. All aye. Motion Carried. CLERK Ken Krahn is interested in purchasing the residence at 6316 170th Street, but would like to obtain a temporary mobile home permit for his parents to reside in. His father has asthma and cancer, therefore, would be apply under a hardship case. MOTION: McAllister made motion, Peltier seconded, to schedule a public hearing for January 21, 1985, at 7;45 PM, to consider the request of Ken Krahn for a temporary mobile home permit under Chapter 40-12, Subd. D. All aye. Motion Carried. 140'TION: McAllister made motion, Peltier seconded, that Arthur Potts be appointed as the official liaison from the Hugo City Council to the Rice Creek Watershed Board of Managers. All aye. Motion Carried. 8.0 UNFINISHED BUSINESS 8.1 Curt Leibel - Removal of Garage (No Permit) The building inspector has his direction if the building is not removed in the allo- cated time frame (see minutes of 12/17/84).
