PRESENT: Peltier, Potts, Schwab, Hauer ABSENT: McAllister Councilman received a letter from the Mayor stating that because of a previous en- gagement, he would be unable to attend tonight's meeting. He asked the Council for authorization to deviate from the published agenda in order to address certain reso- lutions, as submitted by the Mayor. MOTION: Schwab made motion, Hauer seconded, that 6.0, ORDINANCES AND RESOLUTIONS be changed in the order in which they appear and be considered at the present time. AYE: Potts, Schwab, Hauer NAY: Peltier Motion Carried. MOTION: Schwab made motion, Peltier seconded, to adopt RESOLUTION 1985-1A, A RESO- LUTION DIRECTING THE RECORDS OF THE GOVERNING BODY OF THE CITY OF HUGO, TO RECORD THE ATTENDANCE RECORD OF THE REPRESENTATIVE OF THE OFFICIAL NEWSPAPER DESIGNATED AT THE 1ST COUNCIL MEETING EACH YEAR. AYE: Schwab NAY: Peltier, Potts, Hauer Motion Failed. MOTION: Schwab made motion, Potts seconded, to adopt RESOLUTION 1985-2, A RESOLUTION ESTABLISHING A MUNICIPAL CHART. AYE: Potts, Schwab, Hauer NAY: Peltier [MOTION: Schwab made motion, Peltier seconded, to adopt RESOLUTION 1985-3, A RESOLUTION DESIGNATING THE COUNCIL MEMBER FROM WARD 2 AS COMMUNICATIONS OFFICER UNTIL DECEMBER 31, 1987. AYE: None NAY: Peltier, Potts, Schwab, Hauer Motion Failed. MOTION: Potts made motion, Peltier seconded, to table the balance of the Resolutions until such time as they can be explained as to intent, by the author of the proposals, possibly setting a particular meeting for them. All aye. Motion Carried. 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Hauer seconded, to approve the minutes of January 7, 1985, as submitted. All aye. Motion Carried. 10 January 21, 1985 MOTION: Schwab made motion, Potts seconded, to approve the minutes of the Special Meeting of January 9, 1985, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF GENERAL CLAIMS MOTION: Peltier made motion, Hauer seconded, to approve the General Claims for January 21, 1985, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the Utility Claims for January 21,1985, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMKUNICATIONS & LICENSES 5.1 Frank Puled - Special Use Permit Mr. Puleo, one of 3 people having an interest in property known as 16325 Forest Boulevard, was present at the meeting to answer any further questions regarding the light manufacturing business being operated in the accessory building located on the property. The property is zoned SFE, and it was the opinion of Councilman Schwab that a SUP could be considered, as the ordinance reads, "home occupations not meeting criteria". The criteria is not met in that Mr. Puleo does not occupy the residence, and the work is being done in an accessory building. It was deter- mined at previous meetings, that the work being done there would not create any hardship or burden on adjoining property owners. They had no objection to the business, only the rezoning of the property to industrial. MOTION: Schwab made motion, Peltier seconded, to approve the Special Use Permit for Frank Puled to conduct a light manufacturing business in an accessory building in the SFE zone (specifically, handicap grab bar construction). This permit would be in compliance with Zoning Ordinances 320-4, Subd G, #3 and 320-3, Subd B, #41, and shall be subject to the following conditions: 1. That no visible signs other than those normally utilized in a resi- dential district be present. 2. That no over-the-counter retail sales be involved. 3. That the number of persons working at said operation shall not exceed three (3). 4. That there be no generation of offensive odors, glare, smoke, dust noise, vibrations or other objectionable influences, extended beyond said property lot lines. 5. That any sale or transfer of said property and/or business operation would make thi4i5ermit subject to review and renewal. 6. That the Council, at their discretion, can review this permit at any time, and if violations are found, the permit can be revoked. AYE: Peltier, Schwab, Hauer NAY: Potts Motion Carried. 11 January 21, 1985 5.4 Ken Krahn - Application for Temporary Mobile Home Permit The public hearing to consider this matter was called to order at 7:50 PM. Mr. Krahn is interested in purchasing the property located at 6316 170th Street, contingent upon his being able to obtain a temporary mobile home permit, under the hardship clause, to be used as a residence his mother and ailing father. Norm Soderman, property owner to the south, inquired as what "temporary" meant, and what kind of septic system would be used. Mr. Krahn stated that he had planned on adding on to the existing system. Mrs. Sarvela submitted a letter voicing her objection to issuance of any permit. The realtor submitted letter from other adjoining property owners stating they had no objections. MO'T'ION: Potts made motion, Schwab seconded, to table this matter until the applicant brings in the necessary information on the existing septic system for review by the City Engineer. All aye. Motion Carried. 5.2 Art Munger - Special Use Permit Mr. Munger, 5311 165th Street, needs a Special Use Permit for the construction of an accessory building that would exceed the 3600 square feet allowed for accessory storage. MOTION: Potts made motion, Peltier seconded, to approve the Special Use Permit for Art Munger, to construct a pole barn as per the submitted site plan. All aye. Motion Carried. 5.3 Sandy Borndale - Special Use Permit Mrs. Borndale, 16237 Harrow Avenue, has submitted a new proposal substantially downgraded-- from owngraded_from the original plan. The new plan would have no indoor ring, and the building would 3600 square feet and house approximately 18 horses. Three letters were sub- mitted7fhe Council stating their objections, but they were addressing the original plan. Mr. William O'Mara, property owner to the north, stated that he strongly objected to any horse shows. Mrs. Borndale stated that it was not her intent to hold many shows, but would like to have that option. MOTION: Potts made motion, Hauer seconded, to approve the Special Use Permit for Sandy Borndale to construct a 3600 sq ft pole building for a horse riding operation, and subject to the following conditions: 1. The City of Hugo does not relinquish any of its rights to any other govern- mental agency for enforecment of this SUP. 2. The applicants shall familiarize themselves with any additional requirements which may be placed upon them by other governmental agencies, such as, but not limited to, the Rice Creek Watershed District, Minnesota PCA, etc. 3. The applicants' land shall be so arranged that no water runn-off will enter upon a neighbor's land or flow towards or into Hardwood Creek. 4. Because of a high water table, adequate manure storage is difficult. Therefore, a concrete (leakproof) storage area, suitable to the City Engineer, shall be built and maintained for manure storage. 5. Disposal of manure will not be allowed on site, and the applicant shall provide to the City of Hugo, a signed contract with a manure removal con- tractor who shall remove manure on a weekly basis. A current contract shall remain in force at all times. i 91 January 21, 1985 Borndale - SUP 6. The applicant shall incorporate their three (3) existing properties into one certificate of survey. 7. The applicant agrees that only 18 head of livestock will be permitted on site at any given time. 8. All parking necessary to this operation shall be on private property. 9. Applicant to provide for control of any dust created by their operation. This requirement is needed because of the lack of acreage. 10. The applicant is to reimburse the City of Hugo for any legal, engineer, or inspection costs. 11. The City of Hugo reserves the right to impose additional requirements for noise and lighting control if conditions dictate. 12. A Site Plan is to be submitted to the Hugo Planning Commission and/or the City Council for approval prior to any building permit being issued. The City Engineer is to review the site plan before Council approval. 13. The applicant has been made aware of the fact that due to the high concentra- tion of livestock, a test well may be needed, in the future, for the testing of ground water. 14. The applicant agrees that there are to be no horse shows held on the property. 15. The City of Hugo retains the right to add to, or subtract from, the above conditions when deemed necessary. 16. The riding ring to be located on the south side of the new building. All aye. Motion Carried. 5.5 Elsie Jasinski - Rezoning MOTION: Schwab made motion, Peltier seconded, to set a public hearing for 2/4/85, to consider rezoning of 10 acres of property owned by Elsie Jasinski, lying north of 177th Street, from C to A. All aye. Motion Carried. 5.6 John Niemczyk - Rezoning MOTION: Schwab made motion, Peltier seconded, to set a public hearing for 2/19/85, at 7:15 PM, to consider rezoning the NEa of the SA of Section 3 from AG to C. All aye. Motion Carried. 5.7 Kevin Mann - Letter of Credit Mr. Mann had submitted a letter of credit guaranteeing compliance with all require- ments relative to the installation of an on-site septa system for his residence. Inspector Kluegel verbally informed Clerk Creager that these conditions have been complied with. NOTION: Peltier made motion, Schwab seconded, to allow the letter of credit for Kevin Mann to expire. All aye. Motion Carried. 13 January 21, 1985 5.8 Ron Gray - Disc on Resignation Mr. Gray had submitted a letter referencing his current resignation, and was at to- night's meeting stating that his job description was expanded beyond for what he was originally employeed. He stated that he had a limited amount of time in which to complete the work, therefore, some things did not get done. He suggested a better job description be drafted for whomever in hired to fill the vacancy. 8.0 NEW BUSINESS 8.1 Combine Savings Accts. LuAnn Prachar, bookkeeper for the City, was present and stated that the audit for 1984 has been completed. It is the recommendation of the auditor that seven different savings accounts be combined into one account to obtain the most interest for the dollars. She will be contacting the official depositories for the city and report the interest rates, and her recommendation as to where the money can best serve the city. MOTION: Schwab made motion, Peltier seconded, to authorize the City Treasurer to investigate the official city depositories for interest rates for the future combining of seven (7) savings accounts into one money market savings account. All aye. Motion Carried. 9.0 ATTORNEY AND ENGINEER 9.1 The Bottle Company Mr. Kuusisto stated that they will make an on-site inspection of the premises to deter- mine whether the Bottle Company has complied with any and all requirements. Mr. Johnson submitted his monthly report. MOTION: Schwab made motion, Peltier seconded, that the City execute a release for the Armon septic system bond. All aye. Motion Carried. Howard Kuusisto, Romi Slowiak, and Art Potts met to try finalize the city's require- ments to get their Comprehensive Plan approved by the Metro Council. MOTION: Schwab made motion, Peltier seconded, to adopt RESOL[TrION 1985-3, A RESOLU- TION SUPPLEMENTING THE COMPREHENSIVE PLAN OF THE CITY OF HUGO. All aye. Motion Carried. MISCELLANEOUS MOTION: Potts made motion, Schwab seconded, to appoint Howard Schletty to the Board of Appeals. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to extend the meeting passed 11:00 PM. All aye. Motion Carried. 14 January 21, 1985 Councilman Schwab stated that he had been contacted by an area businessman who is interested in expanding his business. He also inquired as to whether he would qualify for industrial revenue bonds. Attorney Johnson was not sure whether an expansion could take advantage of them.
