PRESENT: Peltier, Potts, Schwab, Hauer, McAllister City Engineer, Howard Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Hauer seconded, to approve the minutes of January 21, 1985, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Schwab seconded, to approve the General Claims for February 4, 1985, as submitted. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to approve the Utility Claims for February 4, 1985, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, CODM'IUNICATIONS & LICENSES 5.1 Robert Dotte - Site Plan Approval Mr. Dotte would like to construct a 40 x 60 pole building on his property to be used in conjunction with his sod farming business, which is a principal use allowed in the AG district. MOTION: Potts made motion, Hauer seconded, to approve the Site Plan for Robert Dotte for the construction of a 40 x 60 pole building subject to the following conditions: 1. Approval based on Mr. Dotte's statements on 1/23/85 which indicate the principal use shall be for storage of sod farming equipment. 2. Any change in principal use shall be made known to the City of Hugo. 3. Any non -conforming use (per code) will be cuase for the building's removal. All aye. Motion Carried. 5.2 Elsie Jasinski - Rezonin Mrs. Jasinski has signed an application for the rezoning of 10 acres from C to A. This action is Council initiated as a building permit was already issued for a non -conforming lot in the A zone. MOTION: Potts made motion, Peltier seconded, to adopt ORDINANCE 1985-216, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING DISTRICT OF THE DESCRIBED REAL PROPERTY. All aye. Motion Carried. 1.6 February 4, 1985 5.3 Thomas Hubman - Special Use Permit Mr. Hubman, 13744 Keystone Avenue, would like to operate a woodworking business from an accessory building located on his property. MOTION: Schwab made motion, Peltier seconded, to approve the Special Use Permit for Thomas Hubman to conduct a woodworking business from an accessory building with the following conditions: 1. That the ordinance change including woodworking shops in the AG and CONS districts be approved (with Special Use Permit). 2. That no visible sings, other than those normally utilized in a resi- dential district be present. 3. That no over-the-counter retail sales be involved. 4. That the number of persons working at said operation shall not exceed three (3). 5. That there be no generation of offensive odors, glare, smoke dust, noise, vibrations or other objectionable influences, extended beyond said property lot lines. 6. That any sale or transfer of said property and/or business operation would make this permit subject to review and renewal. 7. That the Council, at their descretion, can review this permit at any time, and if violations are found, the permit can be revoked. All aye. Motion Carried. 5.4 Dennis Schreifels - Special Use Permit Mr. Schreifels, 13125 Goodview Avenue, would like to construct a 30 x 48 pole building on his property in the RR1 zone. City Code allows 1200 sq ft. Mr. Schreifels stated that his tuck -under garage will be converted into living space, and tte pro- posed building would be used as a garage and personal storage. MOTION: Hauer made motion, Peltier seconded, to approve the Special Use Permit for Dennis Schreifels for the construction of a 30 x 48 pole building for his personal storage only and any other use would constitute review and possible revocation of the Special Use Permit. All aye. Motion Carried. 5.5 Sandy Borndale - Disc on Special Use Permit Mrs. Borndale was present to discuss the SUP as issued by the Council on 1/21/85. She stated that Item 7, which requires her tocombine the 3 parcels into one lot would be economically unfeasible. They own two 12 acre parcels and a 122 acre parcel, with a mortgage for the two smally lots. There was also further dis- cussion on the location of the proposed building and outside riding arena. Mayor McAllister asked if she would consider agreeing to restrictive covenants and a development agreement rather than combining the three parcels, and be responsible for all appropriate legal costs. He assured her that the city would be willing to work with her in attempting to resolve any problems or financing (costs to city) in order for her to establish the riding facility. MOTION: Potts made motion, Hauer seconded, authorizing the Mayor and City Attorney to draft a working agreement for Sandy Borndale taking into account all conditions of the SUP issued 1/21/85, excluding Item 7. All aye. Motion Carried. February 4, 1985 GOOD NEIGHBOR DAYS 17 MOTION: McAllister made motion, Peltier seconded, that the Hugo Lions Club be granted ex0lusive use of the City Park on June 8, 9, and 10 for the annual GOOD NEIGHBOR DAYS, and the Mayor be authorized to hire off-duty police officers for the event. Officers will be covered by the city's workman's compensation policy. All aye. Motion Carried. Ken Krahn - Temporary Mobile Home Permit Mr. Krahn submitted a bid and proposal from Ronnie Bowman forradditional septic system to be used for the mobile home to be moved on the property. Mayor McAllister stated that the city does not want two separate septic systems on the property after the mobile home is removed. It was determined that it would probably make more sense to update the existing system so that it could be utilized by the residence when the mobile home is no longer required. MOTION: Peltier made motion, Schwab seconded, to grant a Temporary Mobile Home Permit to Ken Krahn, 6316 170th Street, under Chapter 40, Article III, Subdvision D, to be renewed every 90 days, and that he install an additional septic system to the satisfaction of the City Engineer. MOTION: Potts made motion, Peltier seconded, to amend this motion to include that when the mobile home is removed from the property, the new septic system be removed as well. VOTING ON AMENDMENT AYE: Peltier, Potts, Hauer, McAllister NAY: Schwab Motion Carried. ORIGINAL MOTION All aye. Notion Carried. Mayor McAllister stated that a Building Permit will be required to move the mobile home on the property, but that the fee will be waived. However, Mr. Krahn will be required to obtain a Plumbing Permit for the work to be done on the septic system. 5.6 Lu Prachar - Savings Accounts It was the recommendation of the city's auditor that the city combine seven savings accounts into one account (total of $303,377.82). MOTION: Schwab made motion, Peltier seconded, that the City Treasurer combine all savings accounts currently at the 1st State Bank of Hugo into one money market savings account at the 1st State Bank of Hugo. All aye. Notion Carried. 6.0 REPORTS OF OFFICERS AND COMMITTEES 18 February 4, 1985 6.2 Planning Commission The Council touched briefly on the public hearing to be held2/6/85 with the White Bear Rod & Gun Club. MOTION: Schwab made motion, Potts seconded, authorizing the Mayor to hire off- duty police officers for the public hearing of 2/6/85, and that they be covered by the city's workman's compensation insurance. All aye. Motion Carried. 6.3 Building Inspector Mr. Crever was present to discuss the plans of a property owner on Goodview and 8A to construct an "earth" home" on the property that is virtually flat. Council- man Potts stated that although they conform to the State Building Code, the city should address any potential drainage problems that could affect adjoining pro- perty owners and their homes. Mayor McAllister stated that a site plan would be required, with review by the Council, prior to the issuance of any building permit. 6.5 Clerk MOTION: Peltier made motion, Hauer seconded, that Carole LaBelle and Mary Ann Creager be authorized to attend the clerk's conference in Alexandria, Minnesota, on March 19, 20, 21, and 22nd. All aye. Motion Carried. SHAMROCK GLEN MOTION: McAllister made motion, Peltier seconded, to accept the City Engineer's reconuendation to reduce the $85,000 letter of credit for the Shamrock Glen Subdivision by 70% as provided in the Development Agreement. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the City accept the Clerk's reconmendation to mail copies of Council minutes, free of charge, to any resident of the City of Hugo, upon request. All aye. Motion Carried. 7.0 ORDINANCES AND RESOLUTIONS MOTION: Schwab made motion, Peltier seconded, to adopt RESOLUTION 1985-4, A RESO- LUTION AUTHORIZING THE MAYOR AND CLERK TO SIGN THE 1985 POLICE CONTRACT INCLUDING A CHANGE EFFECTIVE SEPTEMBER 1, 1985, FROM 120 HOURS PER WEEK TO 160 HOURS PER WEEK. THE MAYOR IS AUTHORIZE TO PETITION THE COUNTY BOARD TO AMEND THE CONTRACT. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to adjourn at 10:00 PM. All aye. Motion Carried.
