PRESENT: Peltier, Potts, Schwab, Hauer, McAllister 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Schwab seconded, to approve the minutes of April 15, 1985, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Hauer seconded, to approve the General Claims for May 6, 1985, after the following additions have been made: Walter Erickson - $918.00 Charles A. Johnson - $974.00 Eugene Jenni - $141.50 All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to approve the Utility Claims for May 6, 1985, as submitted. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to approve the claims for Project 8407 as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Ron Istvanovich - Fire Chief MOTION: McAllister made motion, Peltier seconded, to accept the resignation of Billie J. Smith from the Hugo Fire Department. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, authorizing Fire Chief to make the following purchases: 10 badges - $245.00 200' of 4" hose - $455.00 8 firemen attend State Fire School - $520.00/registration $320.00/work pay 1 Scot Airpak All aye. Motion Carried. 38 May 6, 1985 Fire Chief - cont. MOTION: Schwab made motion, Hauer seconded, to accept the application of Bob Christianson for membership on the Hugo Fire Department. All aye. Motion Carried. Mr. Christianson will be on one year probation, and will be required to have another physical. Another matter discussed: Key for clerk's office - McAllister stated that the Council would have to con- sider the request, as the office has always been considered "private". Increase salary of department officers ($6.00 to 7.00) - the budget for 1985 did not address an increase in salary. Could be a reconvendation of the review com- mittee. Cadet program for 13 - 18 year olds - trained similarly to present fire program. Ken Granger will investigate the insurange aspect of the program. Stated that he would work with Ron on this matter. Leonard Charpentier is working on amending of by-laws. Will submit a draft of the present laws along with a revised copy. Councilman Schwab should sit in on meetings as liaison from the Council. 5.2 Earl Morelli - Residential Addition in CB District Mr. Morelli, 14645 Forest Boulevard, would like to raise and change the line of his roof on a residence located in the CB district. After review of the plan, it was the concensus of the City Council that a building permit can be issued. 5.3 Harlee Anderson - Construction of 2 residenceson one lot Mr. Anderson, 12203 Fiona, is seeking authorization to construct another resi- dence on his property. After construction is completed and the house is ready to be occupied, the old house will either be moved out or torn down. The new house will use the present well and septic system. MOTION: Hauer made motion, Potts seconded, to issue a Special Use Permit to Harlee Anderson, 12203 Fiona, to construct an additional residence on one parcel (93032-2560). Approval is subject to the following: 1. Old residence will be removed by December 31, 1986. 2. Mr. Anderson to post an acceptable Letter of Credit, in the amount of $3,000.00, to guarantee removable of old residence by 12/31/86. All aye. Motion Carried. 5.4 Elsie Jasinski - Land Division Peter Kluegel, septic system inspector, approved the perc tests submitted for par- cels to be divided. May 6, 1985 Elsie Jasinski - Land Div MOTION: Schwab made motion, Peltier seconded, to approve the Land Division for Elsie Jasinski to divide 20 acres into 3 parcels (10, 5 & 5). Parkland dedication, in the amount of $200.00, to be paid. VOTING FOR: Peltier, Schwab, McAllister VOTING AGAINST: Potts, Hauer Motion Carried. 5.6 Nadeau's Market - Site Plan Approval (CB) 39 Dan Nadeau, representing the store, was present to discuss the proposed addition to the existing store. The addition will be used for a smokehouse. The building in- spector and Mr. Nadeau made an on-site inspection of the premises. Mr. Crever stated that an addition in the CB district, more detailed plans will be required. MOTION: Hauer made motion, Peltier seconded, to approve the Site Plan for Nadeau's Market for the addition of a smokehouse, and subject to the following: 1. Plans drawn that are acceptable to the Building Inspector. 2. Owners to screen in rubbish containers to the east of the bldg. All aye. Motion Carried. 5.5 Paul Fladeboe - SUP Mr. Fladeboe, 5829 147th Street, would like to construct a 26 x 30 garage on his property. The existing garage will be converted into living space. Mr. Fladeboe does not need a variange as code allows for 5' setback from interior and rear lot lines in the SFU district. A Special Use Permit is required because the allowed 720 sq ft allowed will be exceeded. Fladeboe will also need an additional driveway. MOTION: Hauer made motion, Schwab seconded, to approve the Special Use Permit for Paul Fladeboe for the construction of a 26 x 30 accessory storage building in the SFU zone. Building will exceed square footage allowed. All aye. Motion Carried. 5.7 Wilson Tool - Sewer Construction Attorney Johnson prepared an agreement for their review that will allow for them to recover some costs for future connection to the sewer line. Wilson Tool would be willing to pay for cost of construction in its entirety. Lloyd Carrigan and Mark Jones, present at the meeting, were provided a copy of the agreement, and will take the matter under advisement. 5.8 Bald Eagle Sportsman Assn - Annual Review Mr. Timm, representing the club, reviewed with the Council the seven recommendations as made by the Planning Commission (minutes of 4/24/85). The following will be considered in amending their existing SUP: 1. The muzzleloaders will not be permitted to use the facility. 2. The BESA will absorb the cost to calcium chloride Goodview Avenue approximately 8/10's mile. (cont.) 40 May 6, 1985 BESA - cont. 3. The club will close Memorial Day weekend, Labor Day weekend, and the week of the 4th of July. 4. The club will be opened one Sunday a month from the 2nd weekend in April until the 1st weekend in October, and will be allowed two Sundays in October. The hours of operation will be from 12:00 noon until 6:00 PM on those Sundays. 5. BESA will provide the names of three people responsible for maintaining the rules of the club that can be contacted in case of any infraction. The club will provide a copy of their stmoting schedule to all the neighbors as well as City Hall. 6. Saturday hours reduced to 10:00 AM until 5:00 PM. 7. Two days in both July and August will be designated as DCM shoot days. MOTION: McAllister made motion, Peltier seconded, to schedule a public hearing for Jnune 3, 1985, at 7:30 PM, for the purpose of discussion of amend- ing the Bald Eagle Sportsman's Association's Special Use Permit. List of proposed changes available at City Hall, 8:30 AM - 1:30 PM, Monday through Thursday. All aye. Motion Carried. The BESA will operate under the original permit until officially amended. MISCELLANEOUS MOTION: McAllister made motion, Schwab seconded, to accept the application of Daniel Tauer for membership on the Hugo Fire Dept. All aye. Motion Carried. Councilman Potts submitted documents to be made part of the record relative to the sale of the residence at 6560 177th Street. The future, hopeful owner owns his own tractor/trailer, and would like to park the rig on his property while he is at home. There was much discussion as to what ordinance would be violated. It was the recommendation of Mayor McAllister that the city attorney be contacted to formulate an opinion for the clerk's office as to whether they could drive the tractor -trailer on a gravel road and park the vehicle at his house. MOTION: Potts made the motion, Peltier seconded, that inquiries coming into Hugo City Hall about questinable situations, be referred to the res- pective Ward Councilperson for review prior to an answer being given. Guidelines for referring to a Councilperson: 1. Is the situation being proposed in a gray area when considering the Hugo City Code? 2. Is the situation being proposed outside the "norm" for the neighbor- hood in question? 3. Don't be afraid to ask for the person's name and phone number. A Hugo staff person and/or Councilperson will cane back (within 3 work days) with a course of action. 4. We shall not lose sight of the fact that this is a Council form of government, and not one of just administration. VOTING FOR: Peltier, Potts VOTING AGAINST: Schwab, Hauer, McAllister Motion Failed. 41 May 6, 1985 MOTION: McAllister made motion, Hauer seconded, that the City Council will accept the opinion of the City Attorney relating to this matter. Potts - Let the record show we should not be abdicating our vote to an unelected official. I am willing to come in for a special meeting. VOTING FOR: Schwab, Hauer, McAllister VOTING AGAINST: Potts ABSTAINED; Peltier Motion Carried. Hauer - For the record, regardless of the city Attorney's opinion, the party will still need to deal with the matter of restrictive covenants. 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee - No discussion 6.2 Planning Commission - No discussion 6.3 Building Inspector Mr. Crever asked about a Lions Club matter as to the location of utilities so that they could concrete the picnic area to the Lion's building. McAllister suggested the club contact engineer Kuusisto. 6.5 Clerk MOTION: Potts made motion, Peltier seconded, to approve the Job Order 47424 for Northwestern Bell. All aye. Motion Carried. MOTION: Schwab made motion, McAllister seconded, that the City of Hugo enter into a contract between HUMAN SERVICES INC., IN WASHINGTON COUN'T'Y AND HEALTH RESOURCES ASSISTANCE CORPORATION EMPLOYEE ASSISTANCE SERVICES and the three office personnel (Creager, LaBelle, and Prachar), at an annual cost to the City of $5.00/employee. All aye. Motion Carried. NEW BUSINESS MOTION: Peltier made motion, Potts seconded, to set a special meeting for June 3, 1985, at 6:00 PM, for Curtis Sparts to explain the recycling center as presently operated in Forest Lake Township. All aye. Motion Carried. RICHARD SCHUH MOTION: Schwab made motion, Peltier seconded, to authorize the Mayor and City Clerk to execute the agreement with Richard Schuh regarding the purchase of gravel from the Andrew Goiffon pit. All aye. Motion Carried. 412 May 6, 1985 MOTION: Schwab made motion, Peltier seconded, to extend the meeting passed 11 :00 PM. All aye. Motion Carried. The City Council will be given a tour of the Wilson Tool facility on May 8 at 4:00 PM (after Board of Review) . The city is to consider the installation of "SLOW CHILDREN" signs on 177th St. MOTION: Peltier made motion, Hauer seconded, to adjourn at 11 :06 PM. All aye. Motion Carried.
