PRESENT: Peltier, Potts, Schwab, Hauer, McAllister Also, Engineer Kuusisto and Attorney Johnson 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Hauer seconded, to approve the minutes of May 6, 1985, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Hauer seconded, to approve the General Claims for May 20, 1985, as submitted. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to approve the Water Claims for May 20, 1985, as submitted. MOTION: Schwab made motion, Peltier seconded, to approve the Sewer Claims for May 20, 1985, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the claini for Project 8407 as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 David Truax - Disc on Brown's Creek Watershed District Mr. Truax, 10123 Kerry Court, was present to volunteer to serve as commissioner on the Brown's Creek Watershed Board from the City of Hugo. An alternate will also be required. The draft of the joint powers agreement is under review by the Council and City Attorney with a completion date by July 1, 1985. MOTION: Schwab made motion, Peltier seconded, that the City of Hugo appoint David Truax to serve as its commissioner on the Board of Brown's Creek Watershed District provided the city execute the Brown's Creek Joint Powers Agree- ment. The clerk's office is to advertise for an alternate. All aye. Motion Carried. 5.2 Sheron Peltier - Rezoning Mrs. Peltier, 13141 Henna Avenue, has applied for rezoning her 10 acre parcel from AG to RR2 for purpose of the sale of a 5 acre parcel for future development. Mr. Johnson outlined criteria to be considered for applications for rezoning, e.g.: highest and best use of property, surrounding uses, soil and water conditions, determine permitted uses in zone, roads, and utilities. Considerations to be 44 May 20, 1985 Sheron Peltier - Rezonin avoided: destroy surrounding property values, contract zoning, spot zoning (wide divergence of land use), and personality of applicant. Mrs. Peltier submitted a letter with 44 signatures stating that they are not opposed to the rezoning application. Attorney Johnson stated that petitions are not an issue in rezonings. There were a number of neighbors present to state their objection to the request. MOTION: McAllister made motion, Hauer seconded, to adopt ORDINANCE 1985-219, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING CLASSIFICATION REAL PROPERTY. VOTING FOR: Peltier, McAllister VOTING AGAINST: Hauer, Potts, Schwab Motion Failed. Hauer stated his reason for the "no" vote was to avoid the creation of an "island" (RR2) in the middle of a 10 acre sea (AG). Approving the rezoning would put pressure on the surround area. Schwab and Potts agreed with Hauer's reasoning. 5.3 Richard Brandt - Auto Dismantling License Mr. Brandt's application is for the yard formerly known as Len's Auto Parts. Brandt has been working with Engineer Kuusisto to try to satisfy the require- ment for monitoring wells on the property. For the record, the city will accept the standards for monitoring wells as set forth by the city engineer. The Planning Commission reconvended approval subject to certain conditions being net, specifically, screening the yard to the south and east, and re- moval of the "junk" between the fence and Highway 61. It was the concensus of the Council that Mayor McAllister take a look at the situation. MOTION: Potts made motion, Peltier seconded, to renew the Auto Dismantling License for !?ichard Brandt for a one year period. All aye. Ll,!otion Carried. M02IOJ: McAllister made motion, Peltier seconded, directing the Planning Commission to review the original and amended Special Use Permit as previously issued to Len Noack, and in particular, to address screening and tree conditions. All aye. Motion Carried. 5.5 Will Harris - Site Plan Approval Mr. Harris would like to construct a 24 x 32 pole building on property ad- joining the Texan Bar (30 acres to the east). The building would be used for storage of equipment and materials. Our computer printout states that Don Bumgarner is the owner of the real estate. Mr. Harris stated that that has changed, and that the corporation has purchased the property. Harris stated that he would like to install ballfields at a later date. McAllisted determined May 20, 1985 Will Harris - cont. 45 that if the principal use of the land is recreational, a SUP would be required. If the building is to be used for agriculture, a farm site plan would be required. Attorney Johnson was directed to examine the real estate transation to determine the fee owner of the property. McAllister wants the record to show that Mr. Harris's check was returned to him ($75.00) and a new check in the amount of $10.00 be issued for a Farm Site Plan. MOTION: McAllister made motion, Schwab seconded, to approve the Farm Site Plan for Will Harris, representing Will Harris Investments, Inc., subject to the following conditions: 1. Mr. Charles Johnson will examine the deed and determine that Will Harris or Will Harris Investments, Inc., is the sole owner of the property in question. 2. No building permit shall be issued until the property lines are staked for the building inspector. 3. The building shall meet all city codes for setback requirements. 4. Approved for farm equipment storage only. 5. All these conditions shall be met within 30 days or approval will be null and void. VOTING FOR: Peltier, Schwab, Hauer, McAllister VOTING AGAINST: Potts Motion Carried. 5.4 Richard Schuh - Mining Permits MO'T'ION: Schwab made motion, Hauer seconded, to renew the Mining Permits (Goiffon and Duraine) for Richard Schuh for a one year period. Approval subject to renewal of all financial guarantees. All aye. Motion Carried. 5.6 Washington County Streets & Roads Agreement MOTION: Hauer made motion, Potts seconded, to approve the Washington County Streets and Roads Agreement, and authorize the Mayor and Clerk to execute same. All aye. Motion Carried. 7.0 UNFINISHED BUSINESS There was further discussion of city regulations for parking of a tractor/trailer in the city. MOTION: Potts made motion, Peltier seconded, that the City Clerk shall, by letter, advise Mr. & Mrs. Sampson of Chapter 219-8D, "commercial vehicles", sup- ported by the following: 1. Comprehensive Plan. 2. M.S.A. 473.859, Subd. D, 1 through 4, in particular, Item A of Subd. 4. 46 May 20, 1985 Sampson - cont. 3. M.S.A. 473.852, Subd. 9, Official Controls". Councilman Potts submitted documents into the record (1985-5). Let the record show some data has been marked as to effect reproduction. VOTING FOR: Peltier, Potts VOTING AGAINST: Hauer, Schwab, McAllister Motion Failed. MOTION: Potts made motion, Peltier seconded, that the City Council enfore Chapter 219-8D, "Commercial Vehicles", in the case of the storage at 6560 177th Street. VOTING FOR: Potts VOTING AGAINST: Hauer, Schwab, McAllister ABSTAINED: Peltier Motion Failed. MOTION: McAllister made motion, Scwhab seconded, to set an addition regular Council meeting for May 22, 1985, at 6:00 PM, to discuss the Oneka Lake matter relative to the proposal from Councilman Potts, Ward 2, and any other appropriate city business. All aye. Motion Carried. «5 0 P-7,jTL-5-*M Councilman Schwab submitted d draft of guidelines for the newly formulated youth center (Old City Hall). The Council should review and convent. MOTION: McAllister made motion, Peltier seconded, that the Hugo Lions Club be notified that the city will contribute $100.00 for sodding around the newly cemented area. All aye. Motion Carried. 9.0 ATTORNEY AND ENGINEER Attorney Johnson submitted his monthly report. There was no further discussion. MOTION: McAllister made motion, Peltier seconded, to approve Job Order G825608 for NSP (Lake Air Estates) subject to the condition that they shall receive a start workorder from city engineer prior to construction.
