PRESENT: Hauer, Peltier, Potts, Schwab, McAllister Engineer - Howard Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Hauer seconded, to approve the minutes of the Special Meeting of June 3, 1985, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the minutes of the regular meeting of June 3, 1985, after the following change has been made: Page 52 (5.2) - Let the record show that it is clear nothing should be done with the 40 decibel requirement this year. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Schwab seconded, to approve the General Claims for June 17, 1985, as submtitted. MOTION: Peltier made motion, Hauer seconded, to approve the Utility Claims for June 17, 1985, with the following addition: Alan J. Flater - $78.75 All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Brown's Creek Aareement The Council had just received Attorney Johnson's comments on the agreement at tonight's meeting. It was his recommendation to not approve the agreement until certain matters could be addressed. A special meeting will most probably be necessary to iron -out the questions raised by the attorney. Dave Truex, Hugo's mnmissioner, would like to have Nile Kriesel and Doug Thomas present at this special meeting. Mr. Truex will be attending the meetings regarding Brown's Creek, but not as an official commis- sioner, until the agreement is signed. 5.2 Russell Jarousek - Special Use Permit Mr. Jarousek, 17400 Henna Avenue, would like to operate a hobby -type sawmill on his 122 acres located in the AG zone. The Planning Commission reccmTended approval with certain conditions. Councilman Potts had no problem with the operation, as such, but wanted to see the number of employees limited to one in order to prevent a "business" from starting up. Councilmen Hauer and Schwab did not feel that three 56 June 17, 1985 Jarousek - cont. employees was excessive. The sawmill operation is outside, with only a covering. There is protection on two sides with rows of pine trees. MOTION: Potts made motion, Peltier seconded, to approve the Special Use Permit for Russ Jarousek to goerate a sawmill on his property at 17400 Henna Avenue, subject to the following conditions: 1. No visible signs be present, other than those normally utilized in a residential district. 2. No over-the-counter sales be involved. 3. No outside employees shall be hired. Only family members to parti- cipate in said hobby operation. 4. No generation of offensive odors, glare, smoke, dust, noise, vibra- tion, or other objectionable influences, extended beyond said property lot lines. 5. Any sale or transfer of said property and/or business operation would make this permit subject to review and renewal. 6. The Council at their discretion, can review this permit at any time. If violations are found, the permit can be revoked. All aye. motion Carried. Let the record Mr. Jarousek stated he had no problem with Item 3 (above). 5.3 Don Klausing - Site Plan Approval Mr. Klausing, who is constructing a house new 130th and Irish, would like approval to construct a 30 x 45 pole building. The property lies within the AG district containing 10 acres. The Planning Commission recc nnended approval. MOTION: Schwab made motion, Hauer seconded, to approve the Site Plan for Don Klausing to construct a 30 x 45 pole building for his personal use. All aye. Motion Carried. 5.4 Frank Puleo - Special Use Permit Mr. Puleo, part owner in a residence located at 16325 Forest Boulevard, would like authorization to raise horses on the property. There is 9.8 acres lying in the SFE district. The Planning Commission recommended approval. MOTION: Potts made nation, Schwab seconded, to approve the Special Use Permit for Frank Puleo to raise no more than 3 horses in the SFE zone. All aye. Motion Carried. Norman Horton - Auto Dismantling Licenses (2) James Flannery, attorney for Mr. Horton, questioned the necessity for the moni- toring wells, as reconmended by the Planning Commission at their meeting of 6/12/85. It was his opinion that there is no factual basis for the requirement. There are other polluters in the city (farmers), and nothing is being done them. Michael and Richard Brandt were present, and stated that it cost them $4800.00 for the June 17, 1985 Horton - cont. installation of wells on their property, and would cost $200.00 to have the water tested. Engineer Kuusisto felt that the installation cost was exorbitant and unnecessary. He suggested that a representative for Mr. Horton contact his office for further information to attempt to keep his costs down. MOTION: Potts made motion, Peltier seconded, to approve two (2) Auto Dismantling Licenses for Norman Horton, Sr., subject to payment of application fees and completion of applications ($50.00 each application). All aye. Motion Carried. MOTION: Potts made motion, Peltier seconded, to amend the Special Use Permit for Norman Horton, Sr., to include Item 11 to read as follows: Installation of one monitoring well at each license site, with the test results to be submitted prior to annual renewal. Test can be done by a laboratory of owner's choice, and should be tested for oil, gas, lead, transmission fluid, etc. All aye. Motion Carried. Mr. Flannery was informed that the $1500.00 bond is to be reinstated. The city had received notification of cancellation effective June 21, 1985. Mr. Kuusisto is to determine the locations for the wells. 6.0 ORDINANCES AND RESOLUTIONS The ordinance committee has been working on amending the Zoning Ordinance to include earth shelter buildings in all zones. Copies of their minutes were submitted to the Council for their review. MOTION: Peltier made motion, Schwab seconded, that Cheryl Istvanovich be appointed as a member of the Hugo Ordinance Committee. All aye. Motion Carried. 7.0 UNFINISHED BUSINESS Attorney Johnson had submitted the Drainage Easement Agreement and the drainage ease- ment for submission to Alex Zaluckyj MO'T'ION: McAllister made motion, Potts seconded, authorizing the Mayor to forward the proposed agreement to Alex and Tamara Zaluckyj, along with the attached exhibits, and request a response by July 15, 1985. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, to schedule a Special Meeting for July 15, 1985, at 6:00 PM, to discuss the Oneka Lake matter. There will be a closed agenda. All aye. Motion Carried. - Q 00 June 17, 1985 LINO LAKES AGREEMENT MOTION: Hauer made motion, Peltier seconded, authorizing the Mayor and City Clerk to sign the agreement between Lino Lakes and the City of Hugo for on-call inspections. BOARD OF APPEALS Councilman Potts inquired as to whether the Board of Appeals could be approached relative the decision to allow the Sampson's to park their tractor/trailer on property abutting the Potts' residence. Mayor McAllister was not sure, and felt Attorney Johnson should be consulted for further clarification. Councilman Potts informed the Council that he will be proceeding with legal action in this matter. Mayor McAllister advised Mr. Potts that he could proceed to court in this matter. However, he is not authorized to expend any tax dollars in legal fees without the vote of the majority of the Council. 9.0 ATTORNEY AND ENGINEER Mr. Johnson provided the Council with a copy of his monthly report for this meeting. 10.0 CLERK MOTION: McAllister made motion, Peltier seconded, to add the following to the General Claims for June 17, 1985: City of Lino Lakes (inspections) - $262.42 All aye. Motion Carried. Mr. Schulz is to appear at the Council meeting of July 1 to discuss his plans for use of the mobile home permit. MOTION: Peltier made motion, Hauer seconded, to adjourn at 9:41 PM.
