PRESENT: Hauer, Peltier, Potts, Schwab, McAllister Howard Kuusisto, City Engineer This special meeting was called to discuss the Oneka Lake matter. The meeting was opened to the public, but the agenda was closed. It was the opinion of the City Council that the best avenue to lower the lake level was to go through the Alex Zaluckyj property where a ditch had apparently been used years ago. The City submitted a proposal with a financial offer to the Zaluckyj's and requested they notify the city prior to this date as to whether they reject or accept the offer. The city was officially notified, by letter, they rejected the proposal as submitted. MOTION: Potts made motion, Peltier seconded, to direct the City Attorney to prepare a Resolution to condemn the property of Alex Zaluckyj for the purpose of drainage of Oneka Lake. Alll aye. Motion Carried. Maryg Creager, City The regular meeting of the City Council was called to order at 7:04 PM. PRESENT: Hauer, Peltier, Potts, Schwab, McAllister Howard Kuusisto, City Engineer - Charles Johnson, City Attorney 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Schwab seconded, to approve the minutes of July 1, 1985, as submitted. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to approve the minutes of the addi- tional regular meeting of July 11, 1985, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Schwab seconded, to approve the General Claims for July 15, 1985, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Hauer seconded, to approve the Utility Claims for July 15, 1985, as submitted. All aye. Motion Carried. 66 July 15, 1985 5.0 PETITIONS, REQUESTS, C MMUNICATIONS & LICENSES 5.1 James Leroux -- Renew of Mobile Home Permit MOTION: Peltier made motion, Scwhab seconded, to renew the Mobile Home Permit for James Leroux, for a 90 day period. All aye. Motion Carried. James Leroux - Land Division Mr. Leroux is proposing the division of 10 acres from a 35 acre parcel. A Cer- tificate of Survey was filed, as well as proof of ownership. MOTION: Hauer made motion, Peltier seconded, to approve the Land Division for James Leroux to divide 10A from 35A in the Agriculture zone. Approval is subject to payment of $100.00 parkland dedication fee. All aye. Motion Carried. 5.2 Bill Wolfe - Site Plan Approval and Variance Mr. Wolfe is proposing the construction of a 35 x 40(45) pole building on his property located on Jeffrey Avenue. The barn would be closer to the road than the house thereby necessitating the variance. MOTION: Schwab made motion, Peltier seconded, to approve the Site Plan and Variance for Bill Wolfe to construct a 35 x 40(45) pole barn according to the site plan submitted. All aye. Motion Carried. 5.3 Patrick Higgins - Site Plan Approval MOTION: Hauer made motion, Peltier seconded, to approve the Site Plan for Patrick Higgins, 12145 Everton Avenue, to construct a 320 square foot accessory building in the SFE zone. All aye. Motion Carried. 5.4 George Knuteson - Special Use Permit Mr. Knuteson, 10051 Kerry Court, would like to construct a 22 x 18 stone and wood building on his property that will serve as a retreat room and storage for antiques. There will be no plumbing in the building. MOTION: Schwab made motion, Hauer seconded, to approve the Special Use Permit for George Knuteson, 10051 Kerry Court, for the construction of a 396 square foot accessory building on his property. All aye. Motion Carried. 67 July 15, 1985 5.6 Marlene Mooren - Special Use Permit Ms. Mogren would like to establish a "SHARE A HOME FOR WOMEN" is her residence on 140th Street. There would be a maximum of 5 women at the house for longer residency, but could have more there on an emergency basis. Len Shimota, 9824 140th Street, was present to state that he opposed the proposed use, and would like to see the home remain as a single family residence. Ms. Mogren would get most referrals from her church, Calvary Assembly of God, in White Bear Lake or by word-of-mouth. The Mogren property is zoned AG, and institutional housing is allowed by Special Use Permit. MOTION: Schwab made motion, Peltier seconded, to approve the Special Use Permit for Marlene Mogren to operate a "SHARE HOME FOR WOMEN" at her residence, subject to the following conditions: 1. Establishment to have yearly review by the Washington County Community Health Services. A copy of the review to be provided to the City. 2. Home to comply with all fire and building codes. 3. No changes to be done to the outside appearance of the house. 4. Residence shall have a maximum of five adults, 10 total persons residing in hone and not to exceed 15 persons on an emergency basis for more than 72 hours. The owner and family are excluded from the total. 5. This Special Use Permit is subject to review at the will of the City Council at any time. All aye. Motion Carried. 6.0 ORDINANCES AND RESOLUTIONS MOTION: Potts made motion, Peltier seconded, to schedule a public hearing for August 5, 1985, at 7:30 PM, to consider the proposed ordinance amending the zoning ordinance to include earth sheltered and earth bermed structures. All aye. Motion Carried. 7.0 UNFINISHED BUSINESS MOTION: Schwab made motion, Peltier seconded, authorizing the execution of the MEMORANDUM OF AGREEMENT FOR RECYLCING GRANT DISTRIBUTION between the City of Hugo and Washington County. All aye. Motion Carriend. 5.5 Will Harris - Special Use Permit and Site Plan Approval Mr. Harris is proposing the construction of two softball fields and a smaller scale golf course on his property located to the east of the Texan Bar. A 40 x 60 pole building will also be constructed in conjurttion with his plans. Adjoining neighbor, Lori Flanagan, filed a letter of opposition to the proposal stating their quiet neighborhood would change "into a busy, fast -paced one" as well as an increase in noise. John Jungmann was present and stated that he was not opposed to the plans, but wan interested in plans for parking,and drainage. Mr. Harris felt the existing lot would adequately serve "daytime" activities, and because the land was fairly level, and not much land alteration would be required, drainage would not be a problem. (continuted) 68 July 15, 1985 MOTION: Potts made motion, McAllister seconded, to approve the Special Use Permit and Site Plan for Will Harris to construct two softball fields and approximately six golf holes on the property adjacent to the Texan Bar, subject to the following conditions: 1. Owner to provide portable restroom facilities outside of the bar. 2. One ingress and egress through existing driveway on Highway 61. 3. Fences, berms, or plantings shall be set to control traffic and limit traffic to the parking area. 4. Restricted flight golf balls will be required. No other balls per- mitted and notice of such rule to be posted in the area where green fees are collected. 5. The entire outfield of the softball fields to have snow fencing, and further fencing will be required if neighbor problems occur. 6. Restricted flight softballs shall be used. 7. No lighting shall be provided on golf course or softball fields without amendment to this permit. 8. Annual review shall be required. All aye. Motion Carried. 8.0 NEW BUSINESS MOTION: Schwab made motion, Peltier seconded, that the city send a letter to Jim Wisner and the Hugo Lions Club thanking them for their efforts to obtain a new flag pole outside of City Hall. All aye. Motion Carried. 9.0 ATTORNEY AND ENGINEER Mr. Johnson submitted his monthly report. There was no further discussion. Engineer Kuusisto stated that the water tower is in need of sandblasting and painting before a "major" project is needed. He estimated the cost to be appro- ximately $12,000.00 MOTION: McAllister made motion, Peltier seconded, that the City Engineer be directed to advertise for sealed bids for the repainting of the city's water tower. All aye. Motion Carried. 10.0 CLERK The Clerk is to forward copies of all correspondence sent to the Joe Card family regarding the construction of a fence between the Card and Pavek property. The City received a letter of complaint from Mike Ball regarding a possible vio- lation to city code (no building permit). It was a consensus vote of the Council that the Building Inspector investigate the allegation and report to the City Council of his findings.
