August 5, 1985
The regular meeting was called to order by Mayor McAllister at 7:00 PM.
PRESENT: Hauer, Peltier, Potts, McAllister
ABSENT: Schwab
3.0 APPROVAL OF MINUTES
MO'T'ION: Hauer made motion, Potts seconded, to approve the minutes of the special
meeting of July 15, 1985 as submitted.
VOTING FOR: Hauer, Potts, McAllister
VOTING AGAINST: Peltier
Motion Carried.
MOTION: Peltier made motion, Hauer seconded, to approve the minutes of the regular
meeting of July 15, 1985 as submitted.
All aye. Motion Carried.
4.0 APPROVAL OF CLAIMS
MOTION: Peltier made motion, Hauer seconded, to approve the General Claims for
August 5, 1985 as submitted.
All aye. Motion Carried.
MOTION: Hauer made motion, Peltier seconded, to approve the Utility Claims for
August 5, 1985 as submitted.
All aye. Motion Carried.
5.0 PETITIONS, REQUESTS, COMMUNICATIONS AND LICENSES
5.1 Fire Department
Fire Chief, Ron Istvanovich, was present to make following purchase requests:
4 belts to be added to the back of fire vehicles to meet OSHA standards: $120.00
100 feet of 1i" hose: $140.00
100 feet of 2" hose: $300.00
Fire fighter one training books: $65.00
Contract with Nicholson Company for truck maintenance: $1097.00 (November)
$650.00 (April)
MOTION: Potts made motion, Peltier seconded, that the City of Hugo hire the
Nicholson Company for the maintenance of fire equipment for the months
of November and April, per submitted proposal.
All aye. Motion Carried.

MOTION: Potts made motion, Peltier seconded, authorizing the Fire Chief to
make the following purchases in an amount not to exceed $625.00:
4 belts, 100' 12" hose, 100' 2" hose, and fire manuals.
All aye. Motion Carried.
BUDGET MEETING
MOTION: McAllister made motion, Peltier seconded, to set an additional regular
meeting of the Hugo City Council on September 25, 1985, at 10:00 AM,
for the purpose of drafting and adopting a budget for 1986, and any
other appropriate city business.
All aye. Motion Carried.
5.3 PUBLIC HEARING - Proposed Ordinance (Earth homesL
The public hearing to consider the mentioned ordinance was called to order at
7:35 PM. The ordinance change was published in the official newspaper as
required. There was no one present at the hearing to comment on the proposed
ordinance change. The public hearing was closed at 7:37 PM.
MOTION: Potts made motion, Peltier seconded, to adopt ORDINANCE 1985-220, AN
ORDINANCE AMENDING THE ZONING ORDINANCE CHAPTER 320 TO INCLUDE
EARTH SHELTERED AND EARTH BERMED STRUCTURES.
All aye. Motion Carried.
5.7 Quent Marier - Site Plan Approval with Variance
Mr. Marier, 6395 Oneka Lake Boulevard, would like to construct a 26 x 30 garage
on his property, 5' from the property line. The matter was considered by the
Planning Commission followed by a reco u endation for approval.
MOTION: Potts made motion, Hauer seconded, to approve the Site Plan with a variance
for the construction of a 26 x 30 garage.
All aye. Motion Carried.
5.6 William Lowell - Site Plan Approval
Mr. Lowell is proposing the construction of a 80 x 100 warehouse building for
his roofing business. He owns 2 acres in the industrial zone along 140th Street
(north) and west of Highway 61. The permit from RCWD is no longer valid. Mr.
Lowell is to contact them to determine if he will need a permit from them now
that they have changed their regulations.
MOTION: Hauer made motion, Peltier seconded, to approve the Site Plan for William
Lowell for the construction of a 80 x 100 warehouse in the Industrial
zone. Mr. Lowell is to provide a permit from RCWD, if required, or a
statement from them stating no permit required.

5.9 Karie Rudeen - Discussion on mobile homes
Mrs. Rudeen, home owner near 180th Street and Keystone, was present to inquire as
to city policy regarding "mobile homes" as permanent residences in Hugo. She was
told that any "manufactured house" that was constructed in 1976 or later, and was
960 square feet, could be used as a single family residence. Three years ago, the
City of Hugo defeated an ordinance change that would have required these hones to
be a minimum of 20 feet in width. There was no decision made by the Council to
reconsider the present policy.
5.8 Agreement - LARC and Hugo
The City of Hugo will receive $1135.00 (recycling grant) from Washington County,
and will then forward this sum to the LARC in Forest Lake Township. The city
has entered into a contract with the county, and also needs to sign the Memoran-
dum of Agreement with LARC.
MOTION: Hauer made motion, Peltier seconded, that the Mayor be authorized to
execute the agreement between LARC and the City of Hugo.
All aye. Motion Carried.
5.2 St. John's Church - On Sale Non -intoxicating License
MOTION: Hauer made motion, Peltier seconded, to grant an ON SALE NON -INTOXICATING
LIMITED SELLOR LICENSE to the church of St. John's the Baptist for 8/25/85.
All aye. Motion Carried.
GAMBLING LICENSES
MOTION: Hauer made motion, Potts seconded, that in regard to the Gambling Licenses
for the Minnesota Humane Society and St. John's Church, we do absolutely
nothing.
All aye. Motion Carried.
6.0 REPORTS OF OFFICERS & COMMITTEE'S
6.1 Ordinance Committee - working on subdivision ordinance.
6.2 Planning Commission - no discussion
6.3 Building Inspector
Crever is working with Will Harris to finalize the Certificate of Occupancy for the
Texan Bar.
Crever has not had any response as to the legality of barb -wired fences in a resi-
dential neighborhood. Attorney Johnson is to report at a later date.
Mayor McAllister stated that on 8/5/85 he met with two residents that live on 150th
Street. They claimed that the Twin Pine Trailer Park was moving in a new trailer
along their property to the north. It was their opinion that the trailer would be
infringing onto their property. There was no surveyor's marker on the line, so it
was impossible to determine the exact property line. McAllister stated that he re-
ferred the matter to the Minnesota Department of Health, as they regulate mobile

home parks as far as setback requirements. Because the trailer park has a Special
Use Permit, McAllister asked that City Engineer, Howard Kuusisto, establish the south
property line of the trailer park. Vern Peloquin stated that he could find the
marker, and the meeting was recessed at 8:26 PM so that McAllister and Peloquin
could make an onsite inspection of the property. They returned at 8:46 PM, and
no monument could be located. John Trippel and Mike Gibbs were both present, at
different times, in reference to this matter.
JOE CARD
The city received a letter from Joe Card stating that the fence he erected on his
southern property line was built to serve as a backboard for a basketball hoop.
The inspector was instructed to the fence is in violation of the fence ordinance.
6.4 Clerk
The clerk polled the Council, and Planning Commission members present at the
meeting, as to their opinion regarding a policy change so that "routine" site
plan approvals be submitted directly to the Council. The response varied so
each Council member was instructed to write down their thoughts, positive and
negative, about the possibility of changing the policy.
FIRE PREVEN'T'ION PROGRAM
Cheryl Istvanovich, Fire Department secretary, was present to request that the
city purchase a "Learn Not To Burn Program" to use when the FD visits the ele-
mentary schools in Hugo. The program costs $767.00. She also requested that
the city purchase handouts for their open house on October 6.
MOTION: McAllister made motion, Hauer seconded, authorizing Cheryl Istvanovich,
Hugo FD, tp purchase the "Learn Not To Burn Program" in the amount
of $767.00
All aye. Motion Carried.
MOTION: Hauer made motion, Peltier seconded, that the FD be authorized to
purchase handouts for their open house on 10/6 in the amount of $400.00.
All aye. Motion Carried.
MISCELLANEOUS
Mayor McAllister stated that the city will be patching Ethan Avenue, from 126th
Street to Elmcrest Avenue, in the amount of approximately $16,000. work will
be started this year.
MOTION: Potts made motion, Peltier seconded, to adjourn at 9:30 PM.
