PRESENT: Hauer, Peltier, Potts, Schwab, McAllister Engineer, Howard Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Hauer seconded, to approve the minutes of August 5, 1985, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Schwab seconded, to approve the general claims for August 19, 1985 as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Hauer seconded, to approve the utility claims for August 19, 1985 as submitted. All aye. Motion Carried. MO'T'ION: Schwab made motion, Peltier seconded, to approve the claims for Project 8407, LAKE AIR ESTATES, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Vern Peloquin - Land Division SEE ATTACHED. 5.2 Gil Regnier - Rezoning Mr. Regnier has made application to rezone approximately 15 acres from AG to RR2. He would like to divide the land into two parcels of 72 acres each, both have 210' of road frontage. The Planning Commission recommended denial because of the width of the parcels that would be created. The Regniers submitted a letter signed by ad- joining property owners stating that they had no objection to rezoning and lot split. Mr. Regnier stated that the land is sandy, and would be perfect for two building sites as the land is quite high. MOTION: Hauer made motion, Peltier seconded, to adopt ORDINANCE 1985-221, an ordinance to approve the rezoning request of Gilbert & Evelyn Regnier. Peltier stated she would like clarification as to the 300' road requirement. Hauer withdrew his motion and Peltier her second. MOTION: Peltier made motion, Potts second, to table the application until receipt of a legal opinion as to requirements for lot frontage. All aye. Motion Carried. 74 August 19,1985 5.3 James Leroux - Renew of Mobile Home Permit MOTION: Peltier made motion, Schwab seconded, to renew the Mobile Home Permit for James Leroux for a 90 day period. All aye. Motion Carried. 5.6 James Lowe - Site Plan Approval (Variance) Mr.Lowe, 15989 Jeffrey Avenue, would like to construct a 44 x 80 pole building for his personal use. He owns 20 acres in the AG zone. The matter was considered by the Planning Commission, and they reccnmended approval with a variance for construction closer to Jeffrey than the principal building. MOTION: Schwab made motion, Peltier seconded, to approve the Site Plan, with variance, for James Lowe to construct a 44 x 80 pole building for his personal use only. All aye. Motion Carried. 5.7 David Scholz - Site Plan Approval Mr. Scholz, 12962 Keller Avenue North, would like to construct a 912 sq ft addi- tion to his present garage. He owns 3.7 acres in the CONS district. The PC recommended approval of the request. MOTION: Schwab made motion, Peltier seconded, to approve the Site Plan for David Scholz to construct a 912 sq ft addition to his existing accessory building for tractor and auto storage. All aye. Motion Carried. 5.4 Charles Shubat - Rezoning Mr. Shubat is proposing the rezoning of approximately 40 acres from AG to the RR2 district. The PC recommended approval with no public comment at the public hearing. There will be 4 lots created all exceeding the 5 acre minimum. The land is basically flat with a high groundwater table. MOTION: Hauer made motion, Peltier seconded, to adopt ORDINANCE 1985-221, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE. VOTING FOR: Hauer, Peltier, Schwab, McAllister VOTING AGAINST: Potts Motion Carried. SHUBAT - LAND DIVISION MO'T'ION: McAllister made motion, Hauer seconded, to approve the Land Division for Charles Shubat to divide 40 acres into 4 lots. Approval is sub- ject to submission of a signed Certificate of Survey, and payment of all appropriate fees: Land Division ($75.00) and Parkland Ded ($300.00). All aye. Motion Carried. August 19, 1985 5.5 Sean Hallet - Special Use Permit 75 Mr. Hallett is proposing the filling of Lot 7, Block 1, Royalhaven Estates, adjoining Sunset Lake, for building purposes. The building inspector coimlented that he had received a phone call that Mr. Hallett was pumping the ponding area, against the recommendation of the City Engineer. Mayor McAllister and Engineer Kuusisto will make an on-site inspection of the lot. It was the concensus of the Council that this matter be tabled until the meeting of 9/3/85. 5.7 Leo Lutz - Special Use Permit Mr. Lutz resides with his parents at 8112 157th Street, and would like to start a meat cutting shop on the property. The building would be part of 240 acres in the AG zone. After review by the PC, a recomiendation for approval was made. If on-site slaughtering should take place in the future, Mr. Lutz would need to find an industrial area. MOTION: Potts made motion, Hauer seconded, to approve the Special Use Permit for Leo Lutz, 8112 157th Street, to operate a meat cutting operation, subject to the following conditions: 1. No visible signs other than those normally utilized in a residential district be present. 2. No over-the-counter retail sales be involved. 3. The number of persons working at said operation shall not exceed three. 4. There shall be no generation of offensive odors, glare, smoke, dust, noise, vibration, or other objectionable influences, extended beyond said property lines. 5. Any sale or transfer of said property and/or business operation would make this permit subject to review, renewal, or cancellation. 6. The Council, at their discretion, can review this permit at any time. If violations are found, the permit can be revoked. 7. All requirements set forth by MPCA, Minnesota Dept of Health, and USDA, where applicable, must be met. 8. No slaughtering of living animals will be allowed under this permit. All aye. Motion Carried. 5.8 Doug Kruse - Special Use Permit (Variance) Mr. Kruse, 12616 Ingersoll, purchased the lot directly to the north of his residence. The additional lot does not have a house on it, but a tennis court. He would like to construct a gazebo on the lot, 30' from Sunset Lake. MOTION: Schwab made motion, Peltier seconded, to approve the Special Use Permit for Doug Kruse, 12616 Ingersoll, for the construction of a gazebo 30' from Sunset Lake (70' variance) on the lot directly north of his residence. Approval subject to payment of $45.00 application fee. All aye. Motion Carried. 6.0 ORDINANCES AND RESOLUTIONS MOTION: Hauer made motion, Peltier seconded, to adopt ORDINANCE 1985-222, AN ORDI- NANCE AMENDING CHAPTER 262 ENTITLED "ON-SITE SEWER SYSTEM" BY AMENDING THE ON-SITE SEWER INSTALLERS LICENSE EXPIRATION DATE. All aye. Motion Carried. 7 August 19, 1985 MOTION: McAllister made motion, Peltier seconded, that the City Clerk be directed to publish only the title and change description of ORDINANCE 1985-220. All aye. Motion Carried. 10.0 CLERK The office received a complaint regarding the possible hazard at 15978 Harrow Avenue. The house has been abandoned for some time, and no doors or windows have been secured against entry. The fee owner of the property is to be contacted and asked what their plans are for the building. The building inspector received a buildiner permit application from Joe Card for the construction of a 10' high x 20' wide basketball backstop. Because of the height of the fence, the abutting property owner is to be notified of the appli- cation. The clerk's office is to notify the Paveks of the application and re- quest that they make comment. 7.0 UNFINISHED BUSINESS The City Engineer received a letter from TKDA regarding the upgrading of County Road J (120th Street). Mayor McAllister felt the project cost of $500,000, and Hugo's portion of $70,000, was cost prohibitive. He felt we should notify them of a flat amount of money Hugo would be willing to give them, or ask that they take up the blacktop, and we will participate in making it a gravel road. MOTION: Hauer made motion, Potts seconded, that the City of Hugo will make a $15,000.00 commitment to the cost of upgrading County Road J. Howard Kuusisto is directed to write TKDA and White Bear Township stating that the $466,000.00 cost of the project is, in our opinion, entirely too much money to spend, and Hugo's $70,000 cost participation is too much and would represent 3/4's of the city's annual road budget for an entire year. Hugo will offer $15,000, and ask they consider the possibility of making it a gravel road. VOTING FOR: Hauer, Potts, Schwab, McAllister VOTING AGAINST: Peltier Motion Carried. 8.0 NEW BUSINESS The city received a proposal from Leroy Houle for the removal of the dead trees in the city park. Mr. Houle will cut down the trees and removed the brush. The wood would be left in 8' lengths to be taken on a first come, first served basis. MOTION: Schwab made motion, Peltier seconded, to expend $380.00 to hire Leroy Houle to remove 5 dead trees from the city park. All aye. Motion Carried. The city received three bids for upgrading of the tennis courts lying west of City Hall: Brochman Blacktopping ($6304.00), T.A. Schifsky ($14,700), and Blacktop Paving ($17,950.00). Parks Commissioner, Charles Schwab, recommended the city hire T.A. schifsky to do the work. 77 August 19, 1985 TENNIS COURTS MOTION: Schwab made motion, Peltier seconded, to contract with T.A. Schif sky and Sons to renovate the city tennis courts in the amount of $14,700.00. VOTING FOR: Peltier, Potts, Schwab, McAllister VOTING AGAINST: Hauer Motion Carried. The city received a bid to replace dilapidated fencing around the ballfields in city park from Metropolitan Fence, Inc. Commissioner Schwab reconmended that the money be expended for the work. MOTION: Schwab made motion, Hauer seconded, to expend $510.00 to Metropolitan Fence for the repair of the ballfield fencing. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, to add the following items to the Utility Claims for August 19, 1985: Alan J. Flater $292.50 Dave Alfveby $262.50 All aye. Motion Carried. MISCELLANEOUS Howard Schletty was present to discuss future plans for land division. MOTION: Peltier made motion, Potts seconded, to adjourn at 10:30 PM. All aye. Motion Carried.
