September 16, 1985
The regular meeting was called to order by Mayor McAllister at 7:00 PM.
PRESENT: Hauer, Peltier, Potts, Schwab, McAllister
Attorney Johnson and Engineer Kuusisto
3.0 APPROVAL OF MINUTES
MOTION: Peltier made motion, Potts seconded, to approve the minutes of September 3,
1985, as submitted.
All aye. Motion Carried.
4.0 APPROVAL OF CLAIMS
MOTION: Schwab made motion, Peltier seconded, to approve the general claims for
September 16, 1985, as submitted.
All aye. Motion Carried.
MOTION: Peltier made motion, Hauer seconded, to approve the utility claims for
September 16, 1985 with the following addition:
James Erickson - $60.00
All aye. Motion Carried.
PLANNING COMMISSION
George Atkinson, Planning Commission chairman, was present and inquired if it was
necessary for him to attend Council meetings. Mayor McAllister suggested the
PC members alternate attending as does the Council to PC meetings. McAllister
also restated city policy in that if land division satisfied all requirements, the
matter is to go directly to the City Council. The open meeting law was then dis-
cussed. The PC is to comply with Chapter 10 of the city code with respect to
notice of meetings when a majority of members will be present and city business
is discussed.
MOTION: McAllister made motion, Potts seconded, that the clerk's office be notified
that they have the authority to schedule mandatory public hearings and
publish the notice in the official newspaper, after consultation with the
Planning Commission chairman.
All aye. Motion Carried.
5.0 PETITIONS, REQUESTS, C HJNICATIONS AND LICENSES
5.1 Bill Wenzel - Site Plan Approval
Mr. Wenzel, 5501 145th Street, is proposing the construction of a 12 x 20 storage
shed and housing for two dogs. The property is located in the CB district. Mr.
Wenzel stated that he had contacted neighbor, Mike Walters, regarding the construc-
tion, and Walters had no objections.
MOTION: Hauer made motion, Peltier seconded, to approve the Site Plan for Bill
Wenzel for the construction of a 12 x 20 storage building on his property
in the CB district.

5.2 Shepherd of the Fields - Special Use Permit
The church is proposing the installation of church signs on the property of
B & H Auto Sales and railroad property north of town. They have the permission
of Howard Moe and have requested permission from Burlington Northern. The
Planning Commission recommended approval.
MOTION: Hauer made motion, Peltier seconded, to approve the Special Use Permit
for Shepherd of the Fields Church to install two advertising signs
subject to the following:
1. Chruch obtain permission from B & H Auto Sales and the Burlington
Northern railroad to install signs on their property.
2. Signs are not to exceed 20" x 30" and to be made of metal.
3. Signs are to be placed on private property and subject to removal
for required maintenance.
All aye. Motion Carried.
5.3 Dave Truax - Disc on Brown's Creek Watershed
Mr. Truax, Hugo's representative, was present to suhmit Brown's Creek proposed
budget with Hugo's portion being 8.62% for every $10,000 spent. He expects a request
of an additional $100.00 for adminstrative purposes over and above the cost for
the 509 plan. The watershed district consists of 18,000 acres with 2280 of
them in Hugo.
At 7:36 PM, Mayor McAllister announced that the City will accept no more sealed
bids for the water tower project.
5.4 PROJECT 8527 - Opening of Bids (7:30 PM)
Engineer Kuusisto opened the following bids for Project 8527 - Elevated Storage
Tank Exterior Painting, at 8:37 PM:
Odland Protective Coating - $11,980.00
Valley Contracting - $15,900.00
Tenyer Coating - $18,000.00
Allied Painting & Renovation - $19,800.00
Maguire Iron, Inc. - $21,840.00
Ford Tank & Painting Co., Inc. - $22,000.00
As is the custom, Engineer Kuusisto took the bids under advisement and make
a reonuendation at the next Council meeting.
MOTION: McAllister made motion, Schwab seconded, to table the decision to award
the bid for Project 8527 until 10/7/85.
All aye. Motion Carried.
5.5 Gil Regnier - Variance
Mr. Regnier, owner of 15 acres along Elmcrest Avenue, is proposing a variance
to the 300' lot width requirement for hardship purposes. Mr. Regnier, resent at
the meeting, provided photos of the land as well as an aerial. It was}9,�Knion
that the lot width of 210' for each parcel would not alter the existing charac-
teristics of the neighborhood. Councilmen Hauer and Schwab stated that they had
no problem with the variance request stating that they felt there was a legiti-
mate hardship and the variance would not alter the existing residential area.

GIL REGNIER - cont.
MOTION: Hauer made motion, Peltier seconded, to approve the Minor Subdivision, in-
cluding a variance from the 300' front road requirment, for Gilbert
Regnier, subject to the following conditions be met:
1. Submission of a certificate of survey for both parcels created.
2. Payment of $60.00 fee for Minor Subdivision.
3. Payment of $100.00 - parkland dedication fee.
All aye. Motion Carried.
5.7 Steve Gaffney - Annual review of SUP
Mr. Gaffney, owner of Minnesota Adhesives, Peloquin Industrial Park, has a SUP
for his business, which is subject to annual review. Fire Chief, Ron Istvanovich,
made an on-site inspection and made the following recommendations: install fire
extinguishers and NO SMOKING signs. The clerk will forward a letter to Mr.
Gaffney with these recommendations.
6.0 ORDINANCES AND RESOLUTIONS
No discussion.
7.0 UNFINISHED BUSINESS
Mayor McAllister stated that he had received a copy of a letter from the County
Administrator to Robert Burn, County Assessor regarding property appraiser's
employment outside of county service (Frank Langer). It was the opinion of the
County Attorney that this constitutes a conflict of interest. McAllister felt
it should have been the obligation of Hugo's representative on the county board,
John Jergens, to notify Hugo of Board action when it involves Hugo. Mr. Langer
will longer be able to assess in the city after August 31, 1986 unless he resigns
his position with the county. It was the concensus of the Council that Mayor
McAllister contact Mr. Jergens regarding this matter.
INSURANCE
MOTION: Potts made motion, Peltier seconded, that the City of Hugo cancel its
marine policy with the Beulke Agency.
All aye. Motion Carried.
FIRE DEPAR 4ENT
MOTION: Peltier made motion, Potts seconded, that the Fire Chief be authorized
to purchase a used, reserve fuel tank for #5 tanker, in the amount of $150.00.
All aye. Motion Carried.
9.0 ATTORNEY AND ENGINEER
Mr. Johnson submitted his monthly report. There was some discussion regarding Mr.
Johnson's appearance at the Court of Appeals on 9/9/85 (White Bear Rod & Gun Club).
They will be making a decision within 90 days of this date.

Engineer Kuusisto received a call from Barton Contracting regarding the
Goiffon pit. He will respond to any questions they may have. Kuusisto has
talked to Hult & Associates regarding the surveying of the easement across the
Alex Zaluckyj property. The accuracy of the existing monument will have to be
verified.
Mayor McAllister stated that he would like to get the Stanek/NSP matter resolved,
and might have to schedule a special meeting to discuss.
McAllister reminded the Council of the Budget 1986 meeting on 9/25 at 10:00 AM.
MOTION: Peltier made motion, Schwab seconded, to adjourn at 9:31 PM.
