HomeMy WebLinkAbout1985.11.04 CC Minutes111 MINUTES OF THE SPECIAL MEETING OF THE HUGO CITY COUNCIL November 4, 1985 The special meeting was called to order by Mayor McAllister at 6:02 PM. PRESENT: Hauer, Potts, Schwab, McAllister John Jergens, 1st District Commissioner, County Board ABSENT: Peltier Mr. Jergens was present, at the Council's request, to discuss a couple county related matters. The first issue discussed was county policy for the recording of deeds for land located in Hugo. It has come to the city's attention that the county has re- corded a number of lots for property that does not meet the minimum acreage as well as being landlocked. It was decided that the city draft a resolution for submission to the Washington County Recorder stating that Hugo would like to review ALL deeds prior to recording at the county. Mr. Jergens requested that he receive a copy of the resolution after its adoption. Mr. Jergens discussed the need for a representative from Hugo to serve on the Parks and Open Space System Study for the north district of Washington County. Messrs. Bob Olson and Phil Ogburn have already been designated. Mr. Jergens estimated that the ccmmitee would meet approximately 6 times with an end result proposing the kind of parks the county would like. MOTION: Schwab made motion, Hauer seconded, to forward the name of Mary Ann Creager to the Washington County Board of Commissioners to serve as a representative of the Parks and Open Space System Study. All aye. Motion Carried. Let the record show that Mrs. Creager will be paid at her normal, hourly salary. Mayor McAllister discussed the use of off-duty deputies in Hugo for different functions. McAllister stated that it is beneficial to Hugo to have the opportunity to hire these people, and that all insurance areas are covered by the city's policy. McAllister was told to communicate his feeling to Sheriff Trudeau, and McAllister asked that Mr. Jergens notify him prior to the Board's taking of any action. The Council then discussed railroad crossings in Hugo. Councilman Potts brought up the fact of many fatal accidents located on 61 and County Road 4, and his hopes of having flashing amber lights installed at that intersection. PRESENT: Peltier, Potts, Hauer, Schwab, McAllister 112 November 4, 1985 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Hauer seconded, to approve the minutes of the regu- lar meeting of October 21, 1985, as submitted. All aye. Motion Carried. MO'T'ION: Schwab made motion, Peltier seconded, Special Meeting of October 21, 1985, of October 22, 1985, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS to approve the minutes of the which was continued and reconvened MOTION: Peltier made motion, Hauer seconded, to approve the General Claims for November 4, 1985, as submitted. All aye. Motion Carried. MOTION: Hauer made motion, Peltier seconded, to approve the Utility Claims for November 4, 1985, as submitted. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to approve the claim from the Park Fund as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the Project 8407 claims as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Byron Anderson - Land Division Mr. Anderson, 15624 Jeffrey Avenue, is proposing the division of 20 acres from an 80 acre parcel. The new parcel would front on 152nd Street. Because this appli- cation process was started last April, the Council elected to proceed with the 'bld" format. Mr. Anderson was informed that all future division of land would have to go through the Planning Commission. MOTION: Potts made motion, Peltier seconded, to approve the land division for Byron Anderson subdivide 20 acres from 80 acres per the submitted Certi- ficate of Survey. Approval is subject to the following conditions being met: payment of application fee and $100.00 parkland dedication based on existing policy. Any future division of property go through procedure as set by the City of Hugo. All aye. Motion Carried. 113 November 4, 1985 5.3 Public Hearing.- Revenue Sharing Funds The public hearing was called to order at 7:38PM. There was9&blic comment regarding the use of $18,060.00 in revenue sharing funds. The public hearing was closed at 7:39 PM. MOTION: McAllister made motion, Peltier seconded, that the revenue sharing funds be allocated as follows: $5,000.00 for building repairs, maintenance, and construction - balance of $13,060.00 for streets and roads. All aye. Motion Carried. 5.2 Richard Kersten - Site Plan Approval Mr. Kersten, owner of property at 5448 140th Street North, is proposing the con- struction of a 12 x 40 addition to the east side of the existing building. The addi- tion would be used for cold storage, and constructed of similar material and roof lines to complement the existing building. MOTION: Hauer made motion, Potts seconded, to approve the site plan for Richard Kersten for the construction of a 12 x 40 addition to his existing to be used for cold storage. All aye. Motion Carried. 5.4 Purchase of Pagers - Open Sealed Bids (7:45 PM) Fire Chief, Ron Istvanovich, presented the Council with 3 bids listed as follows: Capitol Electronics - $316.00/each General Communications - $265.00/each Motorola Radio - $335.00/each Istvanovich stated that he likes the Motorola pager, and would like to purchase two more. MOTION: Potts made motion, Peltier seconded, that the City of Hugo purchas2#41 ) Motorola pagers at a cost of $335.00/each. All aye. Motion Carried. MOTION: Peltier made motion, Hauer seconded, that the City of Hugo grant a 90 day leave -of -absence to Dan Tauer from the Hugo Fire Department. All aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, that the City Clerk send a letter to Thomas Clymer advising him that his position on the Fire Department is terminated without prejudice. He may reapply at a later date. He may appeal the Council's decision until December 2, 1985, at which time the decision will be final. All ayem Motion Carried. 114 November 4, 1985 The chief stated that a member of the FD has not made any obligations and has made no attempt to explain his lack of attendance. The Council advised that he take this matter to the Fire Review Committee and make a recommendation to the Council of their findings. 5.5 Steve Arhip - Complaint TheJrWeived a complaint regarding the Arhip residence at 5261 165th Street North. Tara Arhip was present at the meeting and stated that she had more than two unli- censed vehicles on her property. She would like to continue using her property for storage of these vehicles, and was told she will need a Special Use Permit to operate an auto dismantling yard on her property. She stated that she will go to City Hall during business hours to make the appropriate application. TWIN PINE TRAILER PARK The city received an offer from Karla Wahl, representing the Twin Pine Trailer Park, stating that her client would settle out-of-court if the City of Hugo would pay $25,000 for damages, and they would install three fire hydrants. Regardless of what decision is made, there would be no effect on personal lawsuits. MOTION: Schwab made motion, Peltier seconded, that the City of Hugo reject the offer set forth by the Twin Pine Trailer Park. MOTION: McAllister made motion, Potts seconded, to amend the previous motion that the City Attorney be informed that the City of Hugo will not settle the matter out-of-court for any sum less than $9,247.76, which is the amount of taxpayers' money already expended by the city. AMENDMENT VOTING FOR: Potts, Schwab, McAllister VOTING AGAINST: Hauer, Peltier Motion Carried. ORIGINAL MOTION All aye. Motion Carried. 5.6 Eugene Schulz - Mobile Home Permit MOTION: Schwab made motion, Peltier seconded, to renew the mobile home permit for Mr. Schulz for 90 days. All aye. Motion Carried. 5.7 James Leroux - Mobile Home Permit MOTION: Potts made motion, Peltier seconded, to renew the mobile home permit for James Leroux for 90 days. All aye. Motion Carried. 115 November 4, 1985 6.0 REPORTS OF OFFICERS & C AMITTEES 6.1 Ordinance Committee Mrs. Peltier submitted the newly revised subdivision for the Council's review. The clerk's office is to make copies available for the Council and Planning Commission. 6.2 Planning Commission - No discussion 6.3 Building Inspector MOTION: Schwab made motion, Potts seconded, that the city purchase an automatic 35 mm camera to be used by Hugo's deputies and kept in the city's squad. All aye. Motion Carried. 6.5 Clerk Mayor McAllister stated that he will make on-site inspections of citizens' request for a WATCH FOR CHILDREN sign at 6319 175th Street and a barricade notifying southbound traffic on Ingersoll (north of 155th Street), that the road turns. They have been having problems of people missing the turn and running into their fence. 7.0 ORDINANCES AND RESOLUTIONS No discussion 9.0 NEW BUSINESS Wil Harris has inquired about holding boxing matches at the Texan Bar. It was the concensus of the Council that Mr. Harris would need an amended SUP for "commercial recreation". HOME SHARE - JOINT POWERS MOTION: McAllister made motion, Peltier seconded, that the Clerk advise Randy Johnson that James Hauer will serve as Hugo's representative on the joint powers coimtission for the OLDER AUDULT HOME -SHARE PILOT PROGRAM. All aye. Motion Carried. 8.0 UNFINISHED BUSINESS MOTION: Peltier made motion, Potts seconded, to release the current Jeff Barbour Letter of Credit on file with the city. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the City Clerk send a letter to Lucy Thompson, Metro Council, stating that the City of Hugo relinquishes $737.00 of the grant money (Comp Plan). All aye. Motion Carried. 116 November 4, 1985 CITY MANAGER There was further discussion relative to the possible hiring of a city coordinator. Councilman Potts stated that he would like to have public input regarding the proposal, but no firm decision was made. MOTION: McAllister made motion, Schwab seconded, that a select committee be ap- pointed consisting of Councilman Charles Schwab, to act as chairman, City Engineer, Howard Kuusisto, and Planning Commission Chairman, George Atkinson. The committee is directed to investigate and report to the City Council by January 1, 1986, whether the City of Hugo should hire a full-time city coordinator. All aye. Motion Carried. ROAD SUPERINTENDENT MOTION: McAllister made motion, Potts mconded, that the City of Hugo hire Charles Shalander as the Road Superintendent at $500.00/month, and take home the city vehicle, effective January 1, 1986. All aye. Motion Carried. 10.0 MISCELLANEOUS MOTION: McAllister made motion, Hauer seconded, to adopt RESOLUTION 1985-22, A RESOLUTION ADDRESSING PROPOSED AMENDMENTS TO MINNESO'T'A RULES PARTS 7010.0100 - 7010.0700, STATE NOISE STANDARDS. All aye. Motion Carried. MO'T'ION: McAllister made motion, Peltier seconded, that Mr. Art Potts be requested to appear at the public hearing and present the resolution on behalf of the City of Hugo.
