MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL
November 18, 1985
The meeting was called to order by Mayor McAllister at 7:00 PM.
PRESENT: Hauer, Peltier, Potts, Schwab, McAllister

3.0 APPROVAL OF MINUTES
MOTION: Schwab made motion, Hauer seconded, to approve the minutes of the Special
Meeting of November 4, 1985, after correction of the spelling of ABSENT.
VOTING FOR: Hauer, Potts, Schwab, McAllister
ABSTAINED: Peltier
Motion Carried.
MOTION: Peltier made motion, Potts seconded, to approve the minutes of the regular
meeting of November 4, 1985, after the following change has been made:
(5.4) "that the City of Hugo purchase four (4) Motorola pagers at a
cost of $335.00/each."
All aye. Motion Carried.
4.0 APPROVAL OF CLAIMS
MOTION: Hauer made motion, Peltier seconded, to approve the General Claims for
November 18, 1985, with the following addition:
Tony Istvanovich - $66.00
All aye. Motion Carried.
MOTION: Peltier made motion, Schwab seconded, to approve the Utility Claims for
November 18, 1985, as submitted.
All aye. Motion Carried.
MOTION: Schwab made motion, Peltier seconded, to approve the claim to Orfei & Sons
for LAKE AIR ESTATES.
All aye. Motion Carried.
RESOLUTIONS
MOTION: Potts made motion, Peltier seconded, to adopt RESOLUTION 1985-23, A RESO-
LUTION ADDRESSING NOTIFICATION TO THE WASHINGTON COUNTY RECORDER REQUESTING
ALL DOCUMENTS CREATING A NEW PARCEL OF LAND BE APPROVED BY THE CITY OF
HUGO PRIOR 70 RECORDING.

5.0 PETITIONS, REQUESTS, COMMUNICATIONS AND LICENSES
5.1 Ron Istvanovich - Disc of Burning Permits
Asked to be removed from agenda.
5.2 Basil Stone - Rezoning
The public hearing to consider the Council initiated rezoning of the Basil Stone
property was called to order at 7:15 PM. The public hearing notice was read. Let
the record show that there was no one present at the meeting to make comment.
The public hearing was closed at 7:17 PM.
MOTION: Hauer made motion, Peltier seconed, to adopt ORDINANCE 1985-226, AN
ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING"
BY AMENDING THE ZONING CLASSIFICATION OF THE DESCRIBED REAL PROPERTY.
All aye. Motion Carried.
JAMES MOSTEK
Mr. Mostek, new resident at 12601 Homestead Drive, is proposing the filling of
a trench between lots 5 and 6, Royalhaven Estates. Mr. Mostek has already made
application to the RCWD, but will also require a SUP from Hugo.
MOTION: Schwab made motion, Peltier seconded, that Mr. Mostek to be informed
that he will need a SUP for filling of the land, and the matter to be
placed on the Planning Commission agenda. Mr. Mostek is to deposit
$300.00, in addition to the application fee of $45.00, to cover any
engineering costs.
All aye. Motion Carried.
5.4 Richard Vail - Drainage at Shamrock Glen
Mr. Vail was present and stated that the piping required to complete the drainage
project is on order. Mayor McAllister informed Mr. Vail that if the project is
not completed by December 10th, he will call a special meeting of the City Council
on the 11th to ask for authorization to call on Vail's Letter of Credit. Engineer
Kuusisto stated that he would like to be notified by either Vail or Bowman when
the machinery is moved in to start digging.
5.3 David Nordhausen - Rezoning
The public hearing to consider the Council initiated rezoning of the David
Nordhausen property call to order at 7:30 PM. The public hearing notice was read.
Let the record that there was no one present at the meeting to make comment.
The public hearing was closed at 7:31 PM.
MOTION: Hauer made motion, Peltier seconded, to adopt ORDINANCE 1985-227, AN
ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING"
BY AMENDING THE ZONING CLASSIFICATION OF THE DESCRIBED REAL PROPERTY.

Attorney Johnson advised Stone and Nordhausen what should be done now to have their
parcels combined to form one legal description. Johnson stated that if this is not
done in the relatively near future, the city would record their signed agreements.
5.5 Harstad/Todd Construction - Rezoning
There had been an application to rezone approximately 82 acres, lying on the south
side of 8A, from SFE to SFU. Ken Briggs, representing the above named firm, sub-
mitted a letter to the city requesting the tabling of the application until fur-
ther notice from their office.
MOTION: Hauer made motion, Peltier seconded, to table the Harstad rezoning appli-
cation for a 90 day period from 11/18/85.
All aye. Motion Carried.
9.0 ATTORNEY AND ENGINEER
Mr. Johnson stated that his monthly report will be forthcoming. The Council reviewed
the Stanek matter with the attorney and engineer. Mayor McAllister would like to
see this matter resolved asap, and requested the engineer and attorney to take
whatever steps necessary are needed. A special meeting will be called if necessary.
10.0 CLERK
The city received a call from Joe Card regarding his letter of 9/3/85 which addresses
certain complaints against his neighbor's property. The Council discussed each
item and advised that the city respond as follows:
1. A variance was granted within the framework of city code.
2. Address concern with restrictive covenants with the association.
3. The variance for the 3 -season porch was granted within the framework of city code.
4. Contact 100 regarding this matter.
5. No written permission required in the granting of a variance.
6. This item is referred to the Building Inspector with a report to be made to
the Council.
7. Referred to the Building Inspector.
8. Referred to the DNR.
MOTION: McAllister made motion, Peltier seconded, that the City Clerk provide Joe
Card with the above responses to his letter of 9/3/85.
All aye. Motion Carried.
Tara Arhip, 5261 165th Street, had been sent a letter, along with an application
for a Special Use Permit to operate a junkyard, stating that her name had been placed
on the Planning Commission agenda for 11/13/85. The city never received a response
from her. On 11/18, the city received another call stating that there were at least
25 vehicles sitting behind Arhip's residence. The city's nuisance ordinance addresses
the storage of such vehicles.
MOTION: McAllister made motion, Peltier seconded, that the 1st step of the nuisance
complaint be drafted by the city attorney, and the clerk forward the notice
to Tara Arhip in a manner described by ordinance.

MOTION: Schwab made motion, Hauer seconded, that the city send a letter to
David Schumann requesting him to appear before the City Council at
its meeting of December 2, 1985, at 7:15 PM, to discuss the condition
of his property.
All aye. Motion Carried.
Engineer Kuusisto discussed his monthly report.
MOTION: Peltier made motion, Hauer seconded, to adjourn at 9:08 PM.
