HomeMy WebLinkAbout1985.12.02 CC MinutesAI MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL December 2, 1985 The regular meeting of the Hugo City Council was called to order at 7:00 PM by Mayor Michael McAllister PRESENT: Potts, Schwab, McAllister ABSENT: Peltier and Hauer 3.0 APPROVAL OF MINUTES MOTION: Potts made motion, Schwab seconded, to approve the minutes of Ncvember 18, 1985 as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Potts made motion, Schwab seconded, to approve the General Claims for December 2, 1985 as submitted. All aye. Motion Carried. MOTION: Schwab made motion, Potts seconded, to approve the Utility Claims for December 2, 1985 as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMKUNICATIONS & LICENSES Fire Chief Ron Istvanovich was present, and stated that District Memorial Hospital has expressed interest, again, to provide Hugo's ambulance service. Ron will review their pro- cedures for the next 6 months, with the Council's consent, and make a report in June. District Memorial will be sending the city a proposal for CPR and First Aid Training of the members for the HFD. JAMES MOSTEK - SPECIAL USE PERMIT Mr. Mostek, 12601 Homestead Drive (Lot 5), was present to discuss the proposed filling between his lot and the lot owned by Castle Design (Lot 6). He stated that there would less than 100 yards of fill used. Howard Kuusisto felt that a SUP would be appropriate for the protection of Mr. Mostek and the City. There was considerable discussion regarding the drainage easement required along the pro- perty line. There exists now a 4' easement to provide lake access to the property owner across the road from Lot 5. Mostek stated he would try and resolve the problem. MOTION: Schwab made motion, Potts seconded, to grant a Special Use Permit to James Mostek, 12601 Homestead Drive, to fill between Lots 5 and 6 for drainage purposes. Approval is subject to the following conditions: 1. Property owner shall comply with all requirements of the City Engineer. 2. Erosion control structure to be installed and slope to be seeded in the spring. (continued) /,2.), December 2, 1985 James Mostek - SUP (cont) 3. The property owner to sign a hold harmless agreement with the City of Hugo. 4. A Letter of Credit, in the amount of $1,000.00, shall be submitted to the City of Hugo to insure the following: a. Erosion control structure maintained. b. Limit fill to areas and depths indicated on plan. c. A 10' utility and drainage easement be obtained by the City along the property line between Lots 5 and 6. The Letter of Credit to terminate when the engineer has cer- tified the turf is restored. All aye. Motion Carried. 5.1 David Schumann - Complaint Mr. Schumann, 7630 137th Street, appeared before the Council to discuss the condition of his property. Mayor McAllister stated that after making a visual inspection of Schumann's property, it would appear that there is a violation of the Hugo City Code. Mr. Schumann is storAtk a large number of vehicles on his property without having a SUP to operateKh auto dismantling yard. Mr. Schumann stated that he would do whatever is necessary to correct the problem. Mayor McAllister stated that the city would table the verbal complaint received about Schumann's property, thereby giving Mr. Schumann the option to apply for a Special Use Permit for an auto reduction yard in the Agriculture District. MOTION: McAllister made motion, Potts seconded, that the City Clerk be directed to start a CONFIDENTIAL file, under Minnesota Privacy Data Act, where all information regarding complaints against people or property will be kept, and to order a rubber stamp CONFIDENTIAL. The only people with access to this file shall be the City Council members, the city attorney, and law enforcement personnel assigned to the City. All complaints shall be in writing. The City of Hugo does not accept telephone or verbal complaints effective this date. All aye. Motion Carried. The City was served with 17 interrogatories in the Potts vs. Hugo legal matter. Because Mr. Potts is a member of the Council, Mayor McAllister did not feel it was in the best interest of the City to have an open meeting. McAllister stated that he will be meeting privately and individually with CouncilmeaMers Charles Schwab and James Hauer before he returns the interrogatories to Hugo's attorney. In his opinion (McAllister), that this is the only way to handle with the best interest of the City. He also stated that he is aware that this could be construed as a possible violation of the open meeting law. CLERK Mr. Garry Boyer was to appear before the Planning Commission at a previous meeting to discuss his application for a Special Use Permit, however, he failed to appear. Mr. Boyer is to be sent a certified letter stating that he will be placed on another PC agenda, and that if he doesn't attend, the City will take further action. 123 LIQUOR LICENSES MOTION: Potts made motion, Schwab seconded, to approve the liquor licenses as submitted on the attached list. The Mayor shall not sign any liquor licenses until all bonds and liquor liability insurance is submitted for each license. All aye. Motion Carried. MISCELLANEOUS The Hugo Feed Mill will be plowing the skating rinks this winter. A & B Construction has been digging out the city fire hydrants since the recent large snowfall. The Hugo City Council members will be having dinner on December 16th at 5:00 PM, at Bobbie's in the Park. There will be no city business discussed. MOTION: McAllister made motion, Schwab seconded, to adopt RESOLUTION 1985-24, A RESOLUTION DEALING WITH THE INSTALLATION OF SAFETY DEVICES AT THE INTER- SECTION OF WASHING`r0N COUNTY ROAD #4/170TH STREET AND HIGHWAY 61 IN THE CITY OF HUGO.
