PRESENT: McAllister, Atkinson, Schwab, Vail Attorney - Charles Johnson 3.0 APPROVAL OF MINUTES MOTION: Vail made motion, Schwab seconded, to approve the minutes of January 3, 1983, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Vail made motion, Schwab seconded, to approve the General Claims for January 17, 1983, as submitted. All aye. Motion Carried. MOTION: Vail made motion, Schwab seconded, to approve the Utility Claims for January 17, 1983, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS AND LICENSES 5.1 Andrew Goiffon - Land Division Mr. Goiffon has made application to divide a 10 acre parcel from 35 acres. The land is zoned AG, and proof of ownership and a Certificate of Survey were submitted. The data was reviewed by the City Attorney, and he noted that when the deed is submitted for the clerk's signature, the legal description should be the same as used in the letter from Mr. Simonet showing proof of ownership, indicating accesivia an easement. MOTION: Vail made motion, Atkinson seconded, to approve the Land Division for Andrew Goiffon to divide 10 acres from a 35 acre parcel. The deed should have the same legal description as indicated in the proof of ownership. All aye. Motion Carried 5.2 Windsor-Gro - Renew of Mobile Home Permit MOTION: McAllister made motion, Vail seconded, to renew the Mobile Home Permit for Windsor-Gro, 17385 Forest Boulevard, under Chapter 40, Article III, Sub- division D, for a period of 90 days. Approval subject to payment of $10.00 fee. All aye. Motion Carried. 5.3 Randall Irving - Renew of Mobile Home Permit MOTION: McAllister made motion, Vail seconded, to renew the Mobile Home Permit for Randall Irving, 12870 Henna Avenue, under Chapter 40, Article III, Sub- division B, for a period of 90 days. All aye. Motion Carried. 6 January 17, 1983 5.4 Silver Spur Saloon - Discussion of Nuisance Mr. Ed Waugh, fee owner, and Mr. Gene Ramacher, .last liquor license holder, were sent letters requesting their presence at tonight's meeting to discuss the condi- tion of the building after the fire. Mr. Waugh contacted McAllister stating that he is indeed the fee owner, but that it might be more appropriate to deal with the people who are in possession of the property. Attorney Johnson reconmended that Mr. Waugh be contacted to obtain documentation on the outstanding Contract for Deeds on the property, and that all intermediate owners should be notified and requested to appear before the Council to discuss the nuisance. 6.0 ORDINANCES AND RESOLUTIONS MOTION: Schwab made motion, Vail seconded, to adopt ORDINANCE 189, AN ORDINANCE REGULATING THE POSSESSION, MANUFACTURE, DELIVERY, OR ADVERTISING OF DRUG PARAPHERNALIA, PRESCRIBING PENALTIES AND PROVIDING FOR FORFEITURE. All aye. Motion Carried. 7.0 UNFINISHED BUSINESS 7.1 NSP right-of-way Matter MOTION: McAllister made motion, Vail seconded, that the City Clerk be directed to send a letter to Mr. John A. Smith, NSP, acknowledging his letter of 12/30/82 stating that the matter is under review by the new City Council. All aye. Motion Carried. This matter will be discussed again at the meeting of 2/22/83. 8.0 NEW BUSINESS 8.1 Capitol City Mutual Aid Agreement Mr. Johnson was provided a copy of the proposed agreement. After his review, he de- termined that the previously discussed problems with the original agreement were corrected, and that the new agreement is ready for city signature. MOTION: Vail made motion, Atkinson seconded, that the City of Hugo approve and accept the Capitol City Mutual Aid Agreement and authorize the Mayor to sign the agreement along with the other appropriate signatures. All aye. Motion Carried. 10.0 CLERK The city received a bid from Ron Istvanovich to plow City Hall area and fire hydrants, when needed, for $30.00/hour, 24 hour service. The Feed Mill presently services the city at $36.00/hour. Ron stated that he would be using a 610 Bobcat, and when he would not be able to do the work, his wife's cousin would be available. A Certifi- cate of Insurance could be provided from a firm known as Blacktopping. Ron stated that a 6" snowfall would take approximately 12 hours to remove. 7 January 17, 1983 • MOTION: Schwab made motion, Vail seconded, to accept Blacktopping's bid for snow removal at City Hall for $30.00/hour, 24 hour service. VOTING FOR: Schwab VOTING AGAINST: McAllister, Atkinson, Vail Motion Failed. Councilman Vail stated that he will talk to a representative of the Feed Mill regarding the service, or lack of, to the city. Fire Chief Istvanovich stated that he can obtain flags for the fire hydrants at $7.50 each in lots of 45. The City would require 41 . MO'T'ION: Vail made motion, Atkinson seconded, authorizing the Fire Chief to purchase flags for the fire hydrants in an amount not to exceed $350.00. All aye. Motion Carried. The City received a letter from Cindi Sullivan, race director - Northeast YMCA, re- questing permission the use of Everton Avenue for a foot race on August 13, 1983, at 9:00 AM. She stated that they will be working with the Ramsey and Washington County Sheriff's Department for assistance with traffic control. MOTION: Vail made motion, Schwab seconded, to grant permission for the use of Everton Avenue for a foot race on August 13, 1983. All aye. Motion Carried. The city received a bid from MAPSI for animal pickup with the City of Hugo. They would charge $30.00 per hour, one hour minimum until 3:30 PM each week day. After regular business hours and on weekends, the fee would still be $30.00 per hour, but with a two hour minimum. They would make a pickup upon a call from the Clerk's office, Washington County Sheriff's Office, and a member of the Council, and the animal would have to be confined. MOTION: McAllister made motion, Vail seconded, that the City Clerk respond to MAPSI and state that the City accepts their proposal, and clarify in our acceptance, that a dog catcher will only be dispatched upon request of the Washington County Sheriff's Office, the City Clerk's office, or a member of Hugo's City Council. A copy of the city's Ordinance is to be forwarded to MAPSI, stating that along with our acceptance of their offer, it is understood that they will comply with our ordinance. All aye. Motion Carried. 9.0 ATTORNEY AND ENGINEERR Mr. Johnson submitted his monthly report. In regard to the Comp Plan, Mayor McAllister stated that he will be meeting with Mr. Lockyear at a later date. Mary eager, Clerk De-A City ugo 8 MINUTES OF THE SPECIAL MEETING OF THE HUGO CITY COUNCIL January 18, 1983 The meeting was called to order by acting Mayor, Charles Schwab, at 7:01 PM. PRESENT: Schwab, Atkinson, Vail ABSENT: McAllister The special meeting was called to interview applicants desiring to fill the current two (2) year council-at- large vacancy. ARTHUR POTTS Mr. Potts, 6620 177th Street, has been a resident of Hugo for 62 years, and stated that he would like to fill the vacancy because of a genuine concern for the com- munity. He stated that he had attended a number of council meetings in the past just to see how they operate. Mr. Potts stated that if the railroad along Highway 61 was ever abandoned, the right-of-way could possibly be used as an open corridor. His job would allow for him to attend all meetings when required. THEODORA PELTIER Mrs. Peltier was present and reiterated her past years of service to the community. She was born and raised in Hugo, and feels her experience well qualifies her to fill the vacancy. Mr. Atkinson asked if she had any reason for wanting the position other than experience. Mrs. Peltier stated that she had no complaints, but is con- cerned that the gravel roads are given the attention required. MYRL PETERSEN Mr. Petersen, Hugo's postmaster, stated that he has resided in Minneapolis and Stillwater, and that he has now lived in Hugo for 3 years. He is very interested in small town living and its quality of life. He would like to see growth within the community while still retaining a small town setting. He stated that he basi- cally is interested in seeing Hugo progress MOTION: Vail made motion, Schwab seconded, to appoint Mrs. Theodora Peltier to fill the 2 year Council-at-Large vacancy. VOTING FOR: Vail and Schwab VOTING AGAINST: Atkinson Motion Carried. MOTION: Vail made notion, Schwab seconded, to adjourn at 7:30 PM. All aye. Motion Carried.
