PRESENT: Peltier, Atkinson, Schwab, Vail, McAllister Attorney Johnson and Engineer Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Vail seconded, to approve the minutes of the meeting of January 3, 1984, after the following addition to the minutes has been made: After discussion, it was the concensus of the Council that they agreed with the emergency list of names to be submitted to the Sheriff's office. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Schwab seconded, to approve the General Claims of January 16, 1984, as submitted. All aye. Motion Carried. MOTION: Vail made motion, Atkinson seconded, to approve the Utility Claims for January 16, 1984, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMvIUNICATIONS & LICENSES 5.1 Joan McMillan - Disc of Land Division Requested to be cancelled. 5.3 Randall Irving - Renew of Mobile Home Permit MOTION: Peltier made motion, Vail seconded, to renew the Mobile Home Permit for Randall Irving, 12870 Henna Avenue, under Chapter 40, Article III, Sub- division B, for a period of 90 days. All aye. Motion Carried. 6.0 ORDINANCES AND RESOLUTIONS No discussion. 7.0 UNFINISHED BUSINESS 7.1 Punchcard Voting System It was the concensus that the new voting system would be an asset to the city, with recovery of the initial cost in approximately 2 to 3 years. 6 January 16, 1984 Punchcard Voting MOTION: Vail made motion, Schwab seconded, that the City of Hugo purchase the punchcard voting system as outlined in the cost estimate of EL Marketing dated December 7, 1983. All aye. Motion Carried. APPOINTMENTS MOTION: McAllister made motion, Peltier seconded, to appoint Ronald Istvanovich as Fire Chief for the City of Hugo in the year 1984. All aye. Motion Carried. MOTION: Vail made motion, Schwab seconded, that Joseph McMahon be appointed 1st Assistant Fire Chief for the year 1984. All aye. Motion Carried. MOTION: Schwab made motion, Vail seconded, that Glen Reimer be appointed 2nd Assistant Fire Chief for the year 1984. All aye. Motion Carried. 8.0 NEW BUSINESS Roger Bacon has requested the City to pay for his registration fee to attend school so that he might obtain his Class D Sewer License. MOTION: Vail made motion, Peltier seconded, to authorize Roger Bacon to attend the school necessary to maintain a Class D Sewer license. The City will pay the fee of $60.00. All aye. Motion Carried. RICHARD GRANGER - REZONING Mr. Granger is proposing the rezoning of 30 acres from RR1 to the SFE zone. The Planning Commission held a public hearing on January 11 , 1984, and recommended approval of the request. Mrs. Peltier had the only dissenting comment regarding the proposal. It was her feeling that the land could not accommodate indivi- dual wells because of the high water table. MOTION: Schwab made motion, Atkinson seconded, that the rezoning request of Richard Granger be approved by the adoption of ORDINANCE 201 , AN ORDINANCE AMENDING THE HUGO CODE ENTITLED "ZONING" BY AMENDING THE ZONING DISTRICT CLASSIFICATION OF DESCRIBED REAL PROPERTY. VOTING FOR: Atkinson, Schwab, Vail, McAllister VOTING AGAINST: Peltier Motion Carried. 7 January 16, 1984 Mayor McAllister suggested that Mr. Granger should approach the Planning Commission with a sketch plan for future division of the property. It was the general con- census of the Council that the City would be interested in parkland dedication rather than monetary consideration. The Council also discussed the blacktop re- quirement for new subdivisions, and it was their feeling that gravel roads would be acceptable. Neighbors of the property to be rezoned were present, and expressed concern because of the dust that will becreated with the new gravel roads. Bill Greger felt that the city should require hard-surfaced roads because of the nu- merous homes to be constructed requiring fire protection. Greger also expressed concern that the emergency vehicles would have to cross the railroad tracks twice in order to get to the property. Fire Chief, Ron Istvanovich, was present, and stated that he did not feel the crossing of the tracks would create a problem. 9.0 ATTORNEY AND ENGINEER The City received two bids for the inspection of the deep well turbine pumps - McCarthy Well Company and Layne Minnesota Company. After review of the bids by the City Engineer, Mr. Kuusisto recommended that the City employ Layne Minnesota Company to complete the work being the lower bid of the two submitted. MOTION: Peltier made motion, Atkinson seconded, that the City award the bid for inspection of the deep well turbine pumps to Layne Minnesota Company. All aye. Motion Carried. Attorney Johnson submitted his monthly report. He also submitted his opinion as to the status of the SUP for the White Bear Rod & Gun Club, a copy of which is to be submitted to the club's attorney and June Smith. There was discussion regarding the construction of soundproof type building at their location on County Road 8A. There has been a violation of the building code for constructing without a Building Permit. MOTION: McAllister made motion, Peltier seconded, that the Building Inspector be directed to issue a cease workorder to the White Bear Rod & Gun Club on the construction of a building at their property along County Road 8A in the City of Hugo, and request the presence of a representative of the gun club to appear before the Council at their meeting of February 6, 1984, at 8:00 PM to discuss this matter. All aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, that the City Attorney be directed to seek a permanent restraining order per the attorney's File No. 1500-482. All aye. Motion Carried. MOTION: Vail made motion, Peltier seconded, that the City Attorney's fee be set at $40.00/hour. All aye. Motion Carried. MISCELLANEOUS The Fire Chief was present to discuss a current rash of false alarms as a result of 8 January 16, 1984 malfunctioning alarm systems. He has spoken to other communities, and they usually allow for two "freebie's", and after that charge for false alarms. Attorney Johnson was directed to draft an amendment to the Fire Protection Code with the following to be introduced into the revision: 1. Will charge with the right of appeal to the Council. 2. Two "freebie's" per calendar year. 3. Charge $200.00 for 3rd false alarm. 4. Certified for payment on taxes if not paid. MOTION: Peltier made motion, Vail seconded, to adjourn at 9:40 PM. All aye.
