PRESENT: Peltier, Atkinson, Vail, McAllister Attorney Johnson and Engineer Kuusisto ABSENT: Schwab 3.0 APPROVAL OF MINUTES • MOTION: Vail made motion, Atkinson seconded, to approve the minutes of February 6, 1984, after the following change has been made: Page 12 (1st paragraph) - at a rate not to exceed $40.00/hour. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Vail made motion, Peltier seconded, to approve the General Claims for February 21 , 1984, as submitted. All aye. Motion Carried. MOTION: Vail made motion, Peltier seconded, to approve the Utility Claims for February 21, 1984, as submitted. All Aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS AND LICENSES 5.1 Ted Eselgroth - Cable Communication Mr. Eselgroth, representing Westel Cable Communications, was present to discuss the cable system and what Hugo would have to do to get cable in the city. Mr. Eselgroth stated that his firm would have to have at least 150 - 200 subscribers to make the project economically feasible. The "downtown" section of Hugo is the part of Hugo that could be wired at this time. Eselgroth estimated that it would be a 6 month process to wire the community after the awarding of the bid. MOTION: McAllister made motion, Peltier seconded, to form a committee of Ken Lorch, Deane Vail, and Charles Johnson to review the cable TV proposals, and re- port to the City Council their recommendation. Ken Lorch will serve as chairman of the committee. All aye. Motion Carried. 5.3 Robert McCullough - Status of Building Permit Mr. McCullough, owner of Midwest Seeder and Landscaping, has constructed a pole barn on his property located at 15857 Forest Boulevard without benefit of a building permit. McCullough had obtained Site Plan Approval from the city on 7/5/83, subject 15 February 21 , 1984 Robert McCullough - cont. to his obtaining a permit from the Rice Creek Watershed District. McCullough was present at the meeting and stated that it was his understanding that Site Plan Approval constituted authorization to construct the building. Mayor McAllister felt that the city could learn something from this incident, and should require a Letter of Credit to insure a Building Permit is obtained. After further discussion, it was determined that a statement from the applicant would be adequate. MOTION: Peltier made motion, Vail seconded, that the City double the Building Permit fee for Mr. Robert McCullough, and authorize the Building In- spector to issue said permit. The applicant is hereby notified that this in no way relieves him of the necessity to satisfy the requirements of the Rice Creek Watershed District. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the Clerk's office be directed to provide a statement to each applicant for a Special Use Permit and Site Plan Approval, that they will sign, stating that they acknowledge that the granting of a SUP or a Site Plan does not, in any way, constitute a building permit within the City of Hugo. All aye. Motion Carried. 5.2 Russ Gagner - Complaint The city received a complaint from Mr. Brad Boucher alleging that Mr. Gagner's dog killed his valuable dog. Mr. Gagner was invited to appear before the Council to discuss the allegation. Gagner submitted his written comments to the Council this evening, and contends that his animals are not guilty. It was the hope of the Council that the involved parties resolve their problems without the in- volvement of the city. A copy of Mr. Gagner's comments is to be forwarded to the attention of Mr. Boucher. 5.4 Wil Harris/Don Bumgarner The above mentioned gentlemen were present to inquire if the Council had any ob- jection of the name of Don Bumgarner being on the On-Sale Liquor License along with that of Harris. Mayor McAllister stated that the application would be subject to a police check and would require a satisfactory report. McAllister reserved comment on the request subject to the police report. 6.0 ORDINANCES AND RESOLUTIONS No discussion. 7.0 UNFINISHED BUSINESS • 7.1 Shoreland Management Controls The city will be sending a letter to Molly Comeau, DNR, requesting a 90 day ex- tension for our response to them as to the classification of the lakes in Hugo. Mrs. Peltier and the clerk will prepare a recommendation for submission to the Council at a later date. February 21, 1984 16 8.0 NEW BUSINESS The city received the audit report for 1983 from Anfinson, Hendrickson. MOTION: McAllister made motion, Peltier seconded, to set a Special Meeting for March 5, 1984, at 6:00 PM, to discuss the 1983 audit report and any other city business that may be appropriate. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, to set a Special Meeting for March 19, 1984, at 6:00 PM, to discuss the refinancing of the bonds for Project 8102 with Bill Fahey, Ehlers and Associates, and any other city business that may be appropriate. All aye. Motion Carried. Ken Larch, chairman of the Planning Commission, was present to invite the Council to attend the public hearing on March 14 at 7:00 PM, for review of the SUP for the White Bear Rod & Gun Club. Mayor McAllister stated that it was up to each member of the Council to decide for themselves whether they will attend the public hearing, as requested. FIRE CHIEF MOTION: McAllister made motion, Peltier seconded, authorizing the Fire Chief to attend the annual Firefighter's Conference, in an amount not to exceed $450.00. All aye. Motion Carried. 9.0 ATTORNEY AND ENGINEER Mr. Johnson submitted his monthly report. - MOTION: McAllister made motion, Vail seconded, to approve Job Order 49761 for Northwestern Bell. All aye. Motion Carried. 10.0 CLERK The city received a letter from Heidi Harvieux, daughter of Shirley Nelson Hill, requesting a 90 day extension to Item 1 of Hill's Special Use Permit. MOTION: McAllister made motion, Peltier seconded, to issue an Amended Special Use Permit to Shirley Nelson Hill authorizing a 90 day extension for Item 1 , as requested by Heidi Harvieux. All aye. Motion Carried. The city received a letter from Ronald M. Granger stating that he had sold the building known as Paul's Pizza and voluntarily surrendered his on sale liquor license.
