PRESENT: Peltier Atkinson, Schwab Attorney Johnson, Engineer Kuusisto ABSENT: Schwab, Vail 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Atkinson seconded, to approve the minutes of the Special Meeting of April 16, 1984, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, McAllister seconded, to approve the minutes of the regular meeting of April 16, 1984, as submitted. All aye. Motion Carried. MOTION: Atkinson made motion, Peltier seconded, to approve the minutes of May 2, 1984, as submitted. All aye. Motion Carried. 3.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Atkinson seconded, to approve the General Claims for May 7, 1984 as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Atkinson seconded, to approve the Utility Claims for May 7, 1984, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Barry Stack - Land Division Mr. Stack was present as spokesman for Donald Lucker, fee owner, of the property to be divided. Mr. Stack stated that the Rice Creek Watershed District will approve the land development upon receipt of drainage easements and construction of the drainage ditch. He stated that the equipment is ready to go ahead with the work. A list of soil tests was submitted to Mr. Kuusisto for his review, as well as the Building Inspector. The drainage ditch is not designed to carry water, but carry water to the ponding area on the property. There is no positive outlet provided for drainage from the property to be divided. MOTION: McAllister made motion, Peltier seconded, to approve the Land Division for Donald Lucker to divide approximately 80 acres into 8 - 10 acre parcels, subject to the following conditions being met: 37 May 7, 1984 1. Provide the City of Hugo with a permit from the Rice Creek Watershed District. 2. Submission of written dedication of easements as outlined on the Land Division plan. 3. All charges and costs (engineering and legal) to be paid by Mr. Lucker, in- cluding $800.00 parkland dedication. 4. The city reserves the right to require a performance bond to meet all condi- tions of the Rice Creek Watershed District should the district not require same. All aye. Motion Carried. 5.2 Glen Bjornson - Special Use Permit Mr. Bjornson was unable to attend tonight's meeting as previously scheduled. MOTION: McAllister made motion, Peltier seconded, that set a special meeting for May 21, 1984, at 6:00 PM, to discuss Mr. Bjornson's need for a Special Use Permit. All aye. Motion Carried. 5.3 Arnold Palme - Subdivision Mr. Palme is proposing the subdivision of approximately 80 acres into 13 - 5 acre lots. A new plan was submitted with the incorporation of the suggested changes from the Planning Commission. Kuusisto reminded the representing engineer that changes should be made on the preliminary plat prior to the hardshell. A develop- ment agreement will be required, and will address financial guarantees, and any variances that may be required. MOTION: McAllister made motion, Peltier seconded, to approve the preliminary plan for Arnold Palme to subdivide 80 acres into 13 - 5 acre lots, subject to the following conditions: 1. Developer obtain written approval from the Rice Creek Watershed District, and a satisfactory storm water management plan be developed. 2. A development agreement, satisfactory to the city, be executed by the developer and approved by the city. All aye. Motion Carried. 5.4 Jimmy DeMars - Special Use Permit Mr. DeMars would like to construct a 40 x 60 pole building on his property prior to the construction of his residence. The property is located at Jeffrey and 170th. MOTION: Peltier made motion, McAllister seconded, to approve the Special Use Permit for Jimmy DeMars for the construction of a 40 x 60 pole builidng prior to his residence, subject to the following conditions: 1. Submission of a $1,500.00 Letter of Credit to guarantee the construction of the principal building within one year of this date, and compli- ance with Site Plan as approved as well as setbacks. Motion Carried. 5.5 Richard Granger - Subdivision The Council reviewed the proposed subdivision of Richard Granger for 17 lots, and the various accesses to the property. The city needs to verify the right-of-way for the future extension of Everton Avenue. There were residents present to object to the extension of Europa Avenue, because of possible deterioration of the present roadbed. A development agreement will have to be executed between the developer and the City of Hugo, which will address the required financial guarantees and any variances that may be required. MOTION: McAllister made motion, Peltier seconded, that the City Engineer be directed to have that corner of Everton Avenue and 122nd Street surveyed, and report back to the Council as to where the property lines are. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, to approve the preliminary plan for Richard Granger for the division of 17 lots subject to the following: 1. A storm water management plan be approved by the Rice Creek Watershed District. 2. A development agreement, satisfactory to the city, be executed by the developer and approved by the city. 3. The development agreement will contain the provisions for sanitary sewer and gravel streets to the gravel equivalent standards for the City of Hugo. All aye. Motion Carried. 5.6 Sally Muellier - Special Use Permit Mrs. Muellner, 14998 Francesca, would like to place a beuty shop in her residence. The Planning Commission recommended approval of the application. MOTION: Peltier made motion, Atkinson seconded, to approve the Special Use Permit for Sally Mueliner, 14998 Francesca, for a beauty shop in her home, subject to the following conditions: 1. Mrs. Muellner provide a letter from the neighbor to the south stating they have no objections. (Provided) 2. Mrs. Muellner meet any and all state requirements for a home beauty shop. All aye. Motion Carried. 39 May 7, 1984 5.7 BESA - Annual Review MOTION: McAllister made motion, Atkinson seconded, to approve the request of the Bald Eagle Sportsman Association for the following: 1. Early opening on the following dates: June 10 July 8 Aug 5 Sept 30 Oct 14 Oct 28 2. Extended hours (2) of shooting on Saturday, August 25, for trap shoot-off. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the Planning Commission be directed to hold a public hearing on any change in the normal operating hours of the Bald Eagle Sportsman Assn. All aye. Motion Carried. 5.8 James Leroux - Renew of Mobile Home Permit MORTON: Peltier made motion, Atkinson seconded, to renew the Mobile Home Permit for James Leroux, under Chapter 40, Article III, Subdivision D, for a period of 90 days. All aye. Motion Carried. 5.9 Washington County Road Maintenance Agreement MOTION: McAllister made motion, Peltier seconded, to sign the Washington County Road Maintenance Agreement for the year 1984. All aye. Motion Carried. 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee - No discussion 6.2 Planning Commission - No Discussion 6.3 Building Inspector - Mr. Crever submitted his monthly report. 6.4 Clerk MOTION: McAllister made motion, Peltier seconded, that Mr. Eugene Jenni be paid • $24.00/hour for his riding mower and $10.00/hour for the hand mowing for the year 1984. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that Shirley Nelson Hill be notified that here Special Use Permit is null and void for non-compli- ance with conditions set forth in said permit. All aye. Motion Carried. May 7, 1984 40 8.0 UNFINISHED BUSINESS 8.1 Preliminary Report - Water Problems (Oneka Lake) An on-site inspection was made of Hardwood Creek by employees of Kuusisto Engineering, and pertinent photos of said inspection were submitted to the Council for their review. There are a number of obstructions along the creek, and no outlet from Oneka Lake. Water movement in the creek is steady but slow. The gradient is relatively low north of Oneka Lake as it meanders to Forest Lake Township. Mr. Kuusisto stated that after the water subsides he would be taking a look at the obstructed culverlon 157th Street. There were a number of bng-time residents of Hugo present at the meeting, and stated that they would be willing to sign legal documents stating that water did flow from the outlet at the southeast corner of Oneka Lake years ago. This drainage ditch is located on the property of Alex Zaluckyj, and he opposes any tampering with, what he considers, a private ditch. MOTION: McAllister made motion, Peltier seconded, that the Mayor and City Attorney obtain an injunction, in a competent court of jurisdiction, regarding the drainage way from Oneka Lake to Oneka Lake Boulevard, so that the City of Hugo be allowed to open said drainage way, and maintain the level of Oneka Lake. Motion Carried. 9.0 NEW BUSINESS 9.1 Brown's Creek - Joint Powers Agreement Mayor McAllister informed the Council some details regarding the establishment of a Joint Powers with neighbors to Hugo's south for a storm water managment program. A portion of the southeast corner would fall in the jurisdiction of this group. This matter will be discussed again at a later date.
