PRESENT: Peltier, Atkinson, Schwab, McAllister 3.0 APPROVAL OF MINUTES MOTION: Peltier made nation, Schwab seconded, to approve the minutes of the regular meeting of September 17, 1984, after the following changes have been made: Page 108 (5.4) - Let the record show that McAllister made motion, Schwab seconded, to approve the Special Use Permit for Frank Puleo for the construction of a 32 x 56 garage for storage of equipment. Page 110 (8.1) - The City Engineer will attempt to negotiate with Ramsey County stating that Hugo Page 111 (10.1) the clerk send a letter to the Brandts.... All aye. Motion Carried. MOTION: Peltier made motion, McAllister seconded, to approve the minutes of the Special Meeting of September 17, 1984, as submitted. MOTION: Schwab made motion, Atkinson seconded, to approve the minutes of the Special Meeting of September 25, 1984, after the following addition has been made: RECEIPTS - Building Permits - of no consequence to General Fund All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Schwab seconded, to approve the General Claims for October 1 , 1984, as submitted. All aye. Motion Carried. MOTION: Atkinson made motion, Peltier seconded, to approve the Utility Claims for October 1, 1984, as submitted. All aye. Motion Carried. 5.0 Petitions, Requests, Communications & Licenses 5.1 Don Rudeen - Site Plan Approval Don Rudeen, 10101 180th Street, would like to construct a 30 x 60 pole building for his personal storage. A more detailed site plan was submitted as requested by the Planning Commission. MOTION: Atkinson made motion, Schwab seconded, to approve the Site Plan for Don Rudeen, 10101 180th Street, for the construction of a 30 x 60 pole building for his personal use. All aye. Motion Carried. 114 October 1, 1984 5.2 Leroy McCullough - Minor Subdivision Mr. McCullough is proposing the division of approximately 2A into two parcels. A Certificate of Survey, as well as proof of ownership, was submitted for the record. Rice Creek Watershed had approved the plans of Curt Leibel, purchaser of one of the lots. MOTION: McAllister made motion, Schwab, to approve the Minor Subdivision for Leroy McCullough, and the clerk be authorized to stamp the deed for recording purposes only. Stamping of the deed does not certify that the lot is buildable. All aye. Motion Carried. 5.3 Curt Leibel - Special Use Permit Mr. Leibel has applied for SUP to fill his lot purchased from Leroy McCullough along Highway 61. The lot is currently zoned RB. Mr. Leibel stated that he had installed a culvert under his driveway without a permit from the highway department. Bob McCullough, adjoining property owner, was present to complain about the amount of fill Leibel is placing on his property, which will leave his property approximately 4' lower than the Leibel property. He also noted the debris that is being placed on the lot, and provided pictures of the area. Mr. Leibel stated that he plans on constructing a building to store his masonry equipment and possibly an office. After review of the zoning ordinance, it was determined that Leibel would have to rezone to Industrial to accommodate his planned use of the property. It was at this time Mr. Leibel left the meeting not stating what his plans were for the property as to the zoning. There was no action taken on the application for a Special Use Permit. 5.4 Ron Cressman - Discussion of Old City Hall Mr. Cressman requested that the Council allow Hugo Troop 151 to lease the Old Town Hall for a "scout center". He stated that he has contacted a number of locals, and that they verbally committed their monetary and physical assistance to the project. He will soon be meeting with the Legion and Lions Club soliciting their support. Cressman stated that the scout troop would like to start repairs on the building before winter sets in. It was the overall concensus of the Council that the pro- ject would be good for Hugo, but prior to the city giving official approval, Mayor McAllister suggested that Mr. Cressman gather the interested parties and have them attend a Council meeting. Cressman stated that he would do just that, but at this time needstentative approval from the city when he approaches the Legion and Lions. MOTION: McAllister made motion, Peltier seconded, that the City of Hugo accept Ron Cressman's offer to paint the Old Town Hall. All aye. Motion Carried. 5.6 R & S Properties - Expiration of Letter of Credit mayor McAllister stated that all the conditbn of the Letter of Credit have been met at this time. Mr. Ricci is to be notified that the city expects that the dumpsters remain inside of the fenced area. MOTION: Peltier made motion, Schwab seconded, that the Letter of Credit, in the amount of $25,000.00, to cover certain conditions at the multi-family dwelling at 5697 147th Street, be allowed to expire as all conditions have been met. October 1 , 1984 115 5.7 Eugene Schulz - Renew of Mobile Home Permit MOTION: Peltier made motion, Schwab seconded, to renew the MHP for Eugene Schulz, 8340 140th Street, for a period of 90 days. All aye. Motion Carried. 5.5 Bruce Bernin - Discussion on Oneka Lake Water Problems Concerned residents of the Oneka Lake area were present to further discuss possible remedies to the water problems. Mayor McAllister assured the people that steps were being taken, and a report will be made by the City Engineer at the Council meeting of October 15th on the establishment of a possible release of water through the Gary Weber property rather than the existing drainage on the Alex Zaluckyj property. This matter has been placed on the agenda for October 15th at 7:30 PM. 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee - No discussion 6.2 Planning Commission - No discussion 6.3 Building Inspector A copy of the submitted building permit applications was provided by the clerk's office. MOTION: Atkinson made motion, Peltier seconded, that the City of Hugo invites specific proposals for an estimated cost to do a footing, rough-in, and final inspection during working hours. All aye. Motion Carried. 6.4 Fire Chief - No discussion 6.5 Clerk MOTION: McAllister made motion, Peltier seconded, that the City Clerk be authorized to sign the affidavit as drafted by Charles Johnson, that addresses the acquisition of right-of-way by Oneka Township, the consolidation of Oneka Township with the former Village of Hugo, and the improvement and mainte- nance of Janero Avenue at public expense. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the 31.65 acre lot created (File No. 1984-51) be stamped for approval after the following language is added to the deed: This lot has not met the requirements for a standard on-site sewage disposal system. All aye. Motion Carried. 7.0 ORDINANCES AND RESOLUTIONS MOTION: Peltier made motion, Schwab seconded, to adopt RESOLUTION 1984-10, A RESO- LUTION REDUCING BY $24,100.00 THE TAXES LEVIED FOR COLLECTION OF SANITARY SEWER IMPROVEMENT BONDS. All aye. Motion Carried. 116 October 1, 1984 MOTION: Schwab made motion, Atkinson seconded, to adopt RESOLUTION 1984-11 , A RESOLUTION CERTIFYING THE ANNUAL LEVY TO THE COUNTY AUDITOR. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to adopt RESOLUTION 1984-12, A RESOLUTION THAT THE CITY CLERK CERTIFY TO THE AUDITOR OF WASHINGTON COUNTY SPECIAL ASSESSMENTS FOR COLLECTION OF DELINQUENT UTILITY BILIS. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to adopt RESOLUTION 1984-13, A RESOLUTION CERTIFYING SPECIAL ASSESSMENT FOR WATERMAIN LOOP ENCLOSURE ON COUNTY ROAD 8A. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to adopt RESOLUTION 1984-14, A RESOLUTION CERTIFYING SPECIAL ASSESSMENT FOR PROJECT 8102 IN THE BALD EAGLE INDUSTRIAL PARK. All aye. Motion Carried. MOTION: Atkinson made motion, Schwab seconded, to adopt RESOLUTION 1984-15, A RESOLUTION CERTIFYING THE SANITARY SEWER ASSESSMENT ROLL FOR PLACEMENT ON THE 1985 TAX ROLLS. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to adopt RESOLUTION 1984-16, A RESOLUTION CERTIFYING THE STORM SEWER ASSESSMENT FOR PLACEMENT ON THE 1985 TAX ROLLS. All aye. MOTION: Schwab made motion, Peltier seconded, to adopt ORDINANCE 1984-209, AN ORDINANCE AMENDING CHAPTER 20 OF THE HUGO CITY CODE ENTITLED "ADMINISTRA- TION SALARIES" TO PROVIDE FOR COMPENSATION TO THE MAYOR AND MEMBERS OF THE COUNCIL WHO MUST APPEAR AT, OR PREPARE FOR A LEGAL PROCEEDING IN- VOLVING THE CITY OF HUGO. Motion Carried. 8.0 UNFINISHED BUSINESS N TION: McAllister made motion, Peltier seconded, that the City Engineer be directed to prepare final specifications and plans for the improvements in LAKE AIR ESTATES, and to advertise for seal bids to be opened at Hugo City Hall, December 3, 1984, at 7:30 PM, as approved in the adoption of RESOLUTION 1984-17. All aye. Motion Carried. 10.0 MISCELLANEOUS Mayor McAllister asked Councilwoman Theodora Peltier if he had ever asked her to participate in a violation of the open meeting law of the State of Minnesota or participate in any illegal meeting. Mrs. Peltier responded "no". Mayor McAllister October 1 , 1984 117 asked Councilwoman Theodora Peltier if Councilman Dean Atkinson or Councilman Charles Schwab had ever asked her to participate in a violation of the open meeting law of the State of Minnesota or participate in any illegal meeting. Mrs. Peltier responded "no" White Bear Township has agreed to participate in a feasiblity study for the permanent repair of County Road J (120th Street) east of Highway 61 . MOTION: Schwab made motion, Atkinson seconded, that the City of Hugo expend $1,750.00 for a feasibility study to determine costs for permanent repairs of County Road J. All aye. Motion Carried.
