PRESENT: Peltier, Atkinson, Schwab, McAllister 3.0 APPROVAL OF MINUTES • MOTION: Peltier made motion, Schwab seconded, to approve the minutes of October 1 , 1984, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Schwab seconded, to approve the General Claims for October 15, 1984, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Atkinson seconded, to approve the Utility Claims for October 15, 1984, as submitted. All aye. Motion Carried. JAMES G. HAUER Mayor McAllister stated that Mr. Hauer is running unopposed for Councilman, Ward I. It was his recommendation that Mr. Hauer be appointed to fill the present vacancy for that ward until December 31, 1984. The general election will determine the occupant of that position after the 31st. MOTION: McAllister made motion, Atkinson seconded, to appoint Mr. James G. Hauer to the vacant Council seat for Ward 1 , until December 31 , 1984. All aye. Motion Carried. All aye. Motion Carried. Let the record show that the City Clerk administered the oath of office. The Council recessed the regular meeting and called the public hearing to order at 7:16 PM, to consider an ordinance change to allow for wholesale floral operations as a principal use in the CB district. The record will show that there were no comments from the audience. MOTION: McAllister made motion, Schwab seconded, to adjourn the hearing at 7:17 PM. All aye. Motion Carried. The regular meeting was called back to order at 7:18 PM. The Council initiated the public hearing, basically, because of the sale of the Harley Johnson sod farm along 145th Street. His property is zoned CB, and a Mr. Jim Johnson was interested in purchasing the property to house his wholesale floral operation. Because Mr. Johnson - is not interested in operating under a SUP, he was informed that the city would consider making a possible change to the ordinance. Mayor McAllister, after giving 119 October 15, 1984 the matter further consideration, did not feel this was the best way to handle the matter. If altered, that type of operation could be placed anywhere in the downtown area. For that reason alone, McAllister felt the property could possi- bly be rezoned to Agriculture, which allows the operation. The Council will consider further the matter at their meeting of 11/5/84. MOTION: Peltier made motion, Hauer seconded, to table this matter until the Council meeting of November 5, 1984. All aye. Motion Carried. George Indykiewicz - Mining Permit Tom Fast, Kuusisto's office, was present and stated that he was not aware of any complaints of record for the Indykiewicz operation. MOTION: McAllister made motion, Peltier seconded, to renew the Mining Permit for George Indykiewicz for one year, expiring 11/1/85. All aye. Motion Carried. 5.3 Frank Puleo - Rezoning This rezoning, 10 acres from SFE to AG, was initiated by the Council on 9/17/84. The Planning Commission, in their review process, determined that there we;'e only 9.8 acres available, thereby making it impossible to rezone (creation of a non- conforming lot) . Mr. Puleo submitted a letter to the city requesting his appli- cation be withdrawn. MOTION: McAllister made motion, Atkinson seconded, that Frank Puleo be allowed to withdraw his application to rezone his property from SFE to AG. All aye. Motion Carried. 5.1 Oneka Lake Water Problems Tom Fast, representing Howard Kuusisto's office, was present to discuss the five proposals submitted by Howard, to remedy the water problems in that area. Again, there were numerous residents of the affected area present at the meeting to dis- cuss the alternatives. A map of the 5 plans was reviewed, as well as the cost estimates. It was the opinion of the Mayor that the lowering of Oneka Lake would not necessarily resolve the water problems north on 165th Street. Mr. Hummel wanted to go on record as being opposed to any drainage of Oneka Lake that would have a negative impact on his property as he has no water problem at this time. It was decided that Mayor McAllister continue with his negotiations with Alex Zaluckyj to open the "old" drainage way at the southeast corner of the lake. It was also decided that the DNR should be contacted to start immediate action to have the beaver dams removed to allow for more water. Mayor McAllister was in- structed to write a letter to the DNR initiating their immediate action. 5.5 Randall Irving - Renew of Mobile Home Permit MOTION: Peltier made motion, Atkinson seconded, to renew the Mobile Home Permit for Randall Irving for 90 days, subject to payment of the $10.00 fee. All aye. Motion Carried. October 15, 1984 120 5.2 Tom Pogreba - Disc on NSP easement Mr. Pogreba, landowner close to the NSP powerlines in Section 1, was present to ask about the road that is to be constructed to the Joseph Stanek property. He was in- formed that because NSP had built their powerlines in the city right-of-way, they are assisting financially in the obtaining of easements and construction of a new road. Mr. Pogreba requested to go on record as being opposed to the new roadway. CURT LEIBEL Mr. Leibel had informed the city that he is in the masonry business and would be building a structure on his property for that business. The lot is zoned RB and will need to be rezoned to Industrial to accommodate his business. Mr. Leibel has received Rice Creek approval for the filling of his lot as required for his application for a SUP to fill in the floodplain. MOTION: McAllister made nation, Hauer seconded, to approve the application for a Special Use Permit for Curt Leibel to fill Lot 93017-2875 in accordance with the conditions in the permit issued to him by the Rice Creek Watershed District, and payment of a duplicate SUP fee ($45.00) for violation of the city ordinance by filling his lot prior to obtaining a permit. All aye. Motion Carried. LLOYD SATHRE - Amended SUP Mr. Sathre was previously granted a SUP for the raising on non-domestic animals in the RRII zone. He was present at the Council meeting requesting authorization to construct a stockpond at the northeast corner of his property. Robert Olson, ad- joining property owner, stated that if all the experts assure no pollution of Sunset Lake, and the animals remain a distance from his residence, he had no ob- jection. MOTION: Schwab made motion, Atkinson seconded, to amend the Special Use Permit for Lloyd Sathre, as originally issued 9/4/84, to install a livestock water pit per specifications of the U.S. Department of Agriculture Soil Conservation Service. VOTING FOR: Atkinson, Schwab, McAllister VOTING AGAINST: Peltier, Hauer Motion Carried. MOTION: Peltier made motion, Schwab seconded, to extend the meeting passed 11 :00 PM. All aye. Notion Carried. MISCELLANEOUS Mr. Potts presented the Council with a new Water Resource Management Plan for the Rice Creek Watershed District. The city will further/his_comments and respond to Rice Creek Board of Managers. MOTION: Peltier made motion, Atkinson seconded, to adjourn at 11:33 PM. All aye. Notion Carried.
