PRESENT: Peltier, Atkinson, Schwab, Hauer, McAllister Bill Fahey, Ehlers & Assoc. Mayor McAllister stated that the special meeting was called for the opening of bids for General Obligation Improvements Bonds, in the amount of $295,000, for Lake Air Estates. All legal requirements for the special meeting have been met. Mr. Fahey presented the city with six (6) sealed bids, and after opening all, was awarded to The First National Bank of St. Paul - net interest cost: $220,721 .25 and net interest rate: 9.3824%. MOTION: Schwab made motion, Peltier seconded, to adopt RESOLUTION 1984-18, A RESO- LUTION PROVIDING FOR THE ISSUANCE AND SALE OF $295,000 GENERAL OBLIGATION IMPROVEMENT BONDS OF 1984, SERIES A, AND LEVYING A TAX FOR THE PAYMENT THEREOF. PRESENT: Peltier, Atkinson, Schwab, Hauer, McAllister 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Hauer seconded, to approve the minutes of October 15, 1984, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Atkinson seconded, to approve the General Claims for November 5, 1984, as submitted. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to approve the Utility Claims for November 5, 1984, as submitted. All aye. Motion Carried. 122 November 5, 1984 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 John R. Johnson - Special Use Permit Mr. Johnson is purchasing approximately 60 acres from Harley Johnson in the CB district. Because a wholesale florist operation is not allowed in the CB zone, the city considered a proposed ordinance to allow for this type operation with a Special Use Permit. Mayor McAllister met with Mr. John R. Johnson and arrived at a mutual understanding that Mr. Johnson would consent to a SUP in the CB district. MOTION: McAllister made motion, Peltiere, seconded, to adopt ORDINANCE 1984-210, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" TO INCLUDE WHOLESALE FLORIST OPERATIONS IN THE CB DISTRICT UNDER SPECIAL USE. All aye. Motion Carried. Howard Kuusisto will submit a preliminary cost estimate for the extension of water and sewer to the newly purchased property. McAllister informed J.R. Johnson that all costs would be borne by the user, not the city. McAllister stated that he did not feel a permit from Rice Creek watershed District would be required, but sug- gested that they contact them to make sure. MOTION: McAllister made motion, Atkinson seconded, to approve the Special use Permit for John R. Johnson for the construction of a wholesale floral operation in the CB district, subject to the following conditions: 1 . Any and all conditions of the Special Use Permit must be met within 60 days, unless otherwise stipulated in this permit. If conditions are not met, the Special Use Permit approval will be null and void and a new application must be filled out. 2. That all greenhouses shall be in a good state of repair at all times. 3. That an uptodate list of chemicals will be kept, and the list will be readily available to the City. 4. That the applicant shall have permission to construct greenhouses on the premises, as indicated on the site plan. The applicant shall obtain a Building Permit prior to construction of greenhouses. 5. This permit shall be valid at the same time as publication require- ments for Ordinance 1984-210 have been met. All aye. Motion Carried. 5.4 James Leroux - Renew of Mobile Home Permit MOTION: McAllister made motion, Peltier seconded, to renew the mobile home permit for James Leroux, 4360 165th Street, for a period of 90 days. All aye. Motion Carried. 123 November 5, 1984 6.0 REPORTS OF OFFICERS & comiI'rrt S 6.1 Ordinance Committee - No discussion 6.2 Planning Commission - No discussion 6.3 Building Inspector - No discussion 6.4 Fire Chief - No discussion 6.5 Clerk The clerk's office received a call from Charlotte Kober, Minnesota Correctional In- dustries, regarding microfilming of city documents. It was the concensus of the Council that they are interested, and that Ms. Kober be invited to inspect the records and provide a cost estimate. MOTION: McAllister made motion, Peltier seconded, to set a Special Meeting of the City Council for the Board of Canvas, November 7, 1984, at 7:30 PM. All aye. Motion Carried. The letters of credit for Wil Harris and Jeff Barbour are to be extended prior to expiration, as the conditions of their permits have not been met. MOTION: McAllister made motion, Peltier seconded, the addition to the General Claims $25.00 payable to the City of White Bear Lake, to be charged to the sanitary sewer budget, for the purchase of used valves. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve Job Orders 47154 and 47163 for Northwestern Bell. All aye. Notion Carried. LETTER OF COMPLAINT The city received a letter from Larry Funk complaining about a neighbor raising chickee,5 at 14927 Forest Boulevard, located in the SFU district. MOTION: McAllister made motion, Peltier seconded, that the City Clerk send the occu- pant of the property at 14927 Forest Boulevard, a notice that the keeping of chickens in the SFU district is not a legal use, and request they appear at the Council meeting of 11/19/84 at 8:15 PM. All aye. Motion Carried. 8.0 UNFINISHED BUSINESS 8.1 Ramsey County/Hugo Agreement - 120th Street east of Highway 61 Ramsey County is requesting that Hugo share in the maintenance of 120th Street east of Highway 61. There was a discussion as to exactly how this street happens to belong to the city, and no one was able to explain. MOTION: McAllister made motion, Atkinson seconded, that the City Clerk send the Ramsey County Engineer a letter stating that the City of Hugo will plow snow on both the north and south lanes of 120th Street west of Highway 61, and that it is our understanding that they will maintain the north and south lanes of 120th Street, Ramsey County 81 , east of Highway 61. The City of Hugo will pay them $585.00 in 1985 for such maintenance. This agreement will remain in effect for one year. FOR: Atkinson, Schwab, Hauer, McAllister AGAINST: Peltier MOTION CARRIED., 124 November 5, 1984 MISCELLANEOUS The city received a letter frau Howard Kuusisto regarding the application for con- nection to the Metropolitan Waste Control Commission facility, Lake Air Estates MOTION: Atkinson made motion, Peltier seconded, that the City grant the Mayor authorization to sign the permit for connection to the Metro sewer line for Lake Air Estates. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, authorizing the Mayor to sign the application for the Minnesota Pollution Control Agency for the sanitary sewer connection, Lake Air Estates. All aye. Motion Carried LETTER OF CREDIT - RICHARD VAIL MOTION: Peltier made motion, Atkinson seconded, to give the City Engineer admini- strative authority to reduce the letter of credit for Richard Vail, Shamrock Glen, up to 70% after the engineer has completed final inspec- tion of the dewer, water, and road. All aye. Motion Carried. 5.2 Ronald Cressman - Renovation of "Old City Hall" Ronald Cressman, representing Boy Scout Troop 151, was present to discuss the troop's plans for renovating the town hall on Highway 61. They have the support of the American Legion Post and the Hugo Lions Club, financially and physically. The building is intended to be used as a youth center for Hugo, with hopes of opening this spring. Mayor McAllister stated that the boy scouts would not have exclusive use. The building must remain public or the property would revert to the Forest Lake school district. McAllister stated that the city could not volunteer any money to fund the project. It was the concensus that the renovation is a worthwhile project rather than allow the building to deteriorate. Ken Granger, representing the Hugo Lions Club, stated that the Lions Club would like to see some type of board setup to oversee what goes on there. MOTION: McAllister made motion, Hauer seconded, that the City of Hugo allow the Hugo Boy Scout Troop 151 to use the former "Old Town Hall" building, sub- ject to the following conditions: 1. Provide the city with a hold harmless agreement. 2. The troop provide the city with a certificate of insurance naming the City of Hugo ha an additional named insured. 3. Mr. Charles Schwab shall serve as the liaison officer between the city and the scout troop, and develop guidelines acceptable to the city. 4. The scout troop shall comply with the recommendations of the Building Inspector regarding safety for the building. All aye. Notion Carried. 125 November 5, 1984 MOTION: McAllister made motion, Peltier seconded, that the City Clerk write a certified letter to the executive director of the MPCA informing him that the City of Hugo respectfully requests that they do not intervene in the White Bear Rod and Gun Club matter unless specifically requested to do so by—the City of Hugo, in writing. All aye. Motion Carried. MO'T'ION: McAllister made motion, Peltier seconded, that all department heads be notified that they are to have a signed requisition, by the Mayor or acting Mayor, prior to expending any money over $5.00, until further notice. This notification does not apply to the purchase of gas and/or oil for the Fire Department. All aye. Motion Carried. Joe Card, neighbor to the north of William Pavek on Sunset Lake, was present to complain about the addition being constructed to the front (lakeside) of Pavek's house. Ton Crever stated that Mr. Pavek is constructing according to the permit issued to him, and within the realm of his site plan. Mayor McAllister stated that he will try to make an inspection of the situation as well as the filling of a drainage ditch by Lloyd Sathre at the end of Ingersoll Avenue. The city will be meeting with Metro Council at the office of Howard Kuusisto on December 3, 9:00 AM. for further discussion of the city's comprehensive plan. Howard Kuusisto recommended that the city amend the development with Richard Granger, Lake Air Estates, prohibiting the construction of any house with a full basement.
