PRESENT: Peltier, Atkinson, Schwab, Hauer, McAllister Also - Howard Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Schwab seconded, to approve the minutes of November 19, 1984, after the following correction is made: Page 121 - top paragraph (A $300.00 deposit will have to be made All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Schwab made motion, Peltier seconded, to approve the General Claims for December 3, 1984, as submitted. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to approve the Utility Claims for December 3, 1984, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Opening of bids - Lake Air Estates (Project 8407) The city received 13 responses to the advertisement for bid, and the lowest bidder was Orfei & Sons at $245,514.42. The engineer took all bids under advisement, with the awarding of the bid to take place at the Council meeting of 12/17/84. MOTION: McAllister made motion, Peltier seconded, to place the avarding of the bid for Lake Air Estates, Project 8407, on the agenda for the Council meeting of 12/17/84. All aye. Motion Carried. Richard Granger, developer, was informed that he should let the city know, prior to the acceptance of the bid, whether he wants to asphalt and pay the difference in the cost. 5.2 Shirley Nelson Hill Special Use Permit Mrs. Hill is seeking a SUP to operate a bar and restaurant on her property located at 12010 Keystone Avenue, with plans to obtain an on-sale liquor license. The Planning Commission reviewed the re-application and recommended approval. Mrs. Hill stated that the parking lot is now blacktopped. She stated the light post and advertising sign act as a natural barrier for traffic control. Mrs. Hill, sole partner in Oneka Hills Farms, Inc., stated that the corporation will be applying 133 December 3, 1984 for the liquor license. Mrs. Hill was also informed that she will have to apply for the necessary licenses at the county level. MOTION: McAllister made motion, Peltier seconded, to approve the Special Use Permit for Shirley Nelson Hill dba Oneka Hills Farms, Inc., to operate a bar and restaurant at 12010 Keystone Avenue North, subject to the following conditions: 1 . Mrs. Hill has declared that she is the sole stockholder in Oneka Hills Farms, Inc., and will notify the city of any change in stock- holders of the corporation. 2. Mrs. Hill shall apply for and obtain the necessary licenses from the Washington County Human Services Department prior to issuance of the on sale liquor license. 3. The SUP is subject to annual review, and the city will reserve the right to have the property owner install a barricade or fence within the property line for traffic control should it become a problem. Motion Carried. 5.3 Marvin LaValle - Land Division Marvin LaValle, representing his mother and fee owner, Dolores, is proposing the division of 16.5 acres into two parcels - 7.9 acres with building and 8.6 acre parcel. MOTION: Peltier made motion, Schwab seconded, to approve the Land Division for Dolores LaValle to divide 16.5 acres into two parcels - 7.9 acres and 8.6 acres, provided the land is 16.5 acres and the submitted legal description is correct. All aye. Motion Carried. 5.4 Thomas Hubman - Special Use Permit Mr. Hubman, 13744 Keystone, would like to obtain a SUP to operate a woodworking shop in the AG zone. This use is not allowed in that zone, and the Planning Commission forwarded the application with no recommendation because of a tie vote. McAllister stated that the city cannot legalize a use which is not allowed in a particular zone. However, the city can amend the zoning ordinance. MOTION: McAllister made motion, Peltier seconded, that the application of Thomas Hubman for a SUP to operate a woodworking shop in the AG zone be denied for the following reason: Does not meet the criteria of the ordinance for a home occupation be- cause operation would be located in an accessory building. McAllister withdrew his motion and Peltier her second. MOTION: McAllister made motion, Peltier seconded, to schedule a public hearing for January 7, 1985, at 8:30 PM, to consider an amendment to the zoning ordinance to allow woodworking shops in the AG and CONS districts. All aye. Motion Carried. 134 December 3, 1984 5.5 Charles Shubat - Special Use Permit Mr. Shubar has been making application since 1981 to sell Christmas trees from his property along Homestead Drive, north of 8A. It was the opinion of the Council that the initial permit should qualify him to sell trees there as long as he is able. SUP's go with the property and should not have to be renewed annually. MOTION: McAllister made motion, Hauer seconded, to refund Mr. Charles Shubat all SUP fees subsequent to the inital application and notify him that it will not be necessary to apply every year. All aye. Motion Carried. 5.6 Liquor Licenses MOTION: Atkinson made motion, Peltier seconded, to approve the liquor and miscella- neous licenses for 1985, as submitted by the City Clerk. All aye. Motion Carried. 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee - No discussion 6.2 Planning Commission - No discussion 6.3 Building Inspector Mr. Crever was present, and stated that he had no problems. Mayor McAllister stated that the city had not heard from Mr. Curt Leibel regarding the illegal garage raved to his property (no Building Permit) . MOTION: Schwab made motion, Atkinson seconded, that the Building Inspector notify Mr. Curt Leibel that he has 30 days in which to repave the building from his property. If he fails to do so, the Building Inspector is instructed to contact Sara Currie Mardell, prosecuting attorney, to file a formal complaint. All aye. Motion Carried. 6.4 Fire Chief - No discussion 6.5 Clerk The clerk received a letter from WLKX requesting they be placed on the city's mailing list for Council agendas. The Clerk is to send them a letter stating they are wel- come to call City Hall to find out who is on the agenda. We cannot place them on the mailing list. 7.0 ORDINANCES AND RESOLUTIONS MOTION: Hauer made motion, Peltier seconded, that the Clerk draft ordinances abo- lishing Gambling, Bingo, and Refuse ordinances. All aye. Motion Carried. 135 December 3, 1984 8.0 UNFINISHED BUSINESS - No discussion 9.0 NEW BUSINESS 9.1 Utility Budget MOTION: Schwab made motion, Peltier seconded, to adopt the 1985 Water Depart- ment Budget as submitted. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, to adopt the 1985 Sewer De- partment Budget with the addition of $1200.00 for an alarm system. All aye. Motion Carried. 9.2 Northwestern Bell MOTION: McAllister made motion, Peltier seconded, to approve Job Order 47177 for Northwestern Bell. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, give administrative approval to the engineer for Northwestern Bell's Job Order 47180. All aye. Motion Carried. 10.0 MISCELLANEOUS The city received a proposal from Roger Hunt for restoration work on the water tower - pipes in pit under watertank. MOTION: McAllister made motion, Peltier seconded, that the engineer be allowed to accept the proposal for the city and authorizing him to issue a specific work order detailing work to be done, in an amount to exceed $700.00. ,,,t • All aye. Motion Carried. ONEKA LAKE WATER PROBLEM There was further discussion ',as to how to address the water problem around Oneka Lake. It was the suggestion of the Mayor that when a proposal has been drafted, the city hold an open meeting with a closed agenda to discuss with Mr. Zaluckyj. MOTION: Peltier made motion, Hauer seconded, authorizing the Mayor to hire a certified land appraiser to determine estimate for obtaining an easement. All aye. Motion Carried.
