PRESENT: McAllister, Peltier, Atkinson, Schwab, Vail Also - Attorney Johnson and Engineer Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Vail made motion, Schwab seconded, to approve the minutes of March 7, 1983, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Vail made motion, Peltier seconded, to approve the General Claims for 3/21/83 as submitted. All aye. Motion Carried. MOTION: Vail made motion, Atkinson seconded, to approve the Utility Claims for 3/21/83 as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Shay Shackle - Extension of Sewer to Lot After a discussion with the City Engineer, it was recommended that Mr. Shackle bring whatever maps he has to the engineer's office. Mr. Kuusisto will then report at the meeting of April 18 as to whether they have access to the sewer or whether they will need an easement. 5.2 Vern Peloquin - Variance Mr. Peloquin has applied for a variance from blacktop to gravel for Freeland Avenue in the Peloquin Industrial Park. Freeland Avenue was part of a proposed plat that was not accepted by the city. The city now has 438' of road that they maintain but is not a city street. Vail stated that he had no problem with maintaining an additional 400' and he did not feel that the road should be blacktopped because the rest of the roads in the area were also gravel. McAllister stated that he had made an on-site inspection of the roadway, and, in his opinion, there was a drainage problem. There appeared to be no place for the water to run because the ditches were filled. It was McAllister's suggested that an easement be obtained eastbound off Freeland between Regal Plastic and KSTP to the property line northbound to the drainage ditch. MOTION: McAllister made motion, Atkinson seconded, to place the application for variance on the agenda for the meeting of April 18 to enable the Council and Engineer to make an on-site inspection. Kuusisto requested to prepare a report on the existing drainage and what we can expect for drainage on the road. All aye. Motion Carried. 22 March 21 , 1983 5.3 William Jackson - Site Plan Approval Mr. Jackson, 6175 180th Street, would like to construct a 28 x 42 pole barn in the AG zone. They already have an 18 x 24 pole barn. However, the Ag zone allows for 3600 square feet of accessory storage. MOTION: Peltier made motion, Schwab seconded, to approve the Site Plan for William Jackson to construct a 28 x 42 pole barn for personal storage only. All aye. Motion Carried. 5.4 Debbie Hehn - Special Use Permit Debbie Hehn, 5920 Egg Lake Road, would like to start a beauty shop in the basement of her house. Mrs. Hen submitted a site plan indicating the parking area and the placement of lights around the house. MOTION: Vail made motion, Peltier seconded, to approve the Special Use Permit for Debbie Hehn to allow for the establishment of a beauty shop in the base- ment of here residence at 5920 Egg Lake Road. All aye. Motion Carried. 5.5 Dave Weigel - Site Plan Approval Mr. Weigel presented a report from Twin City Testing stating the need to remove the blocks from the north wall. The remaining walls were tested and reported to be sound. Mr. Kuusisto reviewed the parking plan submitted by Weigel. Weigel stated that he is obtaining bids for 66,000 square feet of blacktopping, and the bids are coming in around $29,000. Mr. Weigel has declared.a capacity of 180 people for the bar and restaurant. The ordinance would require 12,000 square feet including driveways. McAllister stated that the plan for a cedar fence would not be adequate, relating to past experiences. After review of the plan, Kuusisto based his estimate on 53,000 square feet of blacktop at 40 a sq ft totaling $29,000 (125% of the estimatelcost) . MOTION: McAllister made motion, Vail seconded, to approve the Site Plan for Esther Weigel for reconstruction of the building last known as the Silver Spur Saloon, subject to the following: 1 . Prior to issuance of a Building Permit, the applicant post with the City of Hugo, an acceptable Letter of Credit, in the amount of $29,000. The Letter of Credit will guarantee the following: a. The applicant will blacktop the parking area as required by city ordinance and to the satisfaction of the City Council. b. The applicant will construct a suitable barrier, acceptable to the City Council, between the property line and Highway 61. c. The applicant submit a satisfactory set of plans to the Building Inspector, and those plans will meet all city and state building codes including Health Department codes. The Letter of credit will guarantee the above conditions will be met by September 15, 1983, and may be reduced by the City Council upon comple- tion of the work. However, the city may require a portion or all of the Letter of Credit to remain in force until June 1, 1984. All aye. Motion Carried. March 21, 1983 23 5.6 Michael Wick - Site Plan Approval Mr. Wick, 8880 140th Street North, would like to construct a 30 x 48 pole barn for his personal use. The building, as proposed, would be constructed closer to the road than the principal building. An existing driveway would be used for the barn. MOTION: Schwab made motion, Peltier seconded, to approve the Site Plan for Michael Wick to construct a 30 x 48 pole barn for his personal use. The south side berm is to remain unchanged and the building is to be set a minimum of 75' from the center of the road. All aye. Motion Carried. 5.7 Ronald Cressman - Disc on access to property Mr. Cressman, 6085 165th Street, needs proof that he has access to his property from a public roadway inorder to obtain the $1,000 that is being held in escrow. McAllister suggested that Mr. Cressman's attorney, Mr. Mikeworth, contact the city attorney to try and resolve his problem. 5.8 Darrell Tavernier - Licenses for Boat Rental Business Mr. Tavernier has made application for an off-sale nonintoxicating, on-sale nonintoxi- cating liquor licenses and a cigarette license. Because of the new state statute regarding dram shop insurance, it was decided to table the request. MOTION: McAllister made motion, Peltier seconded, to table the applications of Darrell Tavernier until the meeting of April 18, and the attorney to submit a report after review of the statute. All aye. Motion Carried. 5.9 Safeway House Movers - Renew of Mobile Home Permit Because of chanes in the original plans for the mobile honc ossi_b1e changes in the original SUP, no action will be taken on the renewal. MOTION: Vail made motion, Peltier seconded, to send a letter to Donald Sempel and request his presence at the meeting of April 4 to review his Special Use Permit. All Aye. Motion Carried. 6.0 ORDINANCES AND RESOLUTIONS MOTION: McAllister made motion, Peltier seconded, to adopt RESOLUTION 1983-5, A RESOLUTION PROCLAIMING April 9, 1983 AS POW/MIA RECOGNITION DAY. All aye. Motion Carried. 8.0 NEW BUSINESS The Fire Department held a drill on March 14th to determine if they could pump 250 gallons of water per minute. It could be done only with mutual aid. The rural area fire insurance classification has been increased from an 8 to 9. The "250 gallons" was the magic number to have the 24 March 21 , 1983 classification again reduced. MOTION: Vail made motion, Peltier seconded, that the City of Hugo not put on a demonstration for the Insurance Service Office at this time. VOTING FOR: Peltier, Atkinson, Schwab, Vail VOTING AGAINST: McAllister Motion Carried. MOTION: Vail made motion, Peltier seconded, that the City of Hugo enter into the Reciprocal Fire Service Agreement with New Scandia Township, and the Mayor, Clerk, and Fire Chief be authorized td sign the agreement. All aye. Motion Carried. 8.1 Resignations from Planning Commission MOTION: Peltier made motion, Vail seconded, to accept the resignation of Glen Reimer. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, to accept the resignation of George Knuteson and a letter of appreciation be sent to him. All aye. Motion Carried. NOTION: McAllister made motion, Schwab seconded, that the Clerk ad- vertise in the White Bear Press and the Forest Lake Times, block letters, for volunteer candidates for the Planning 'ommission seats, and establish appointment times when they can meet with the City Council. VOTING FOR: McAllister, Atkinson, Schwab, Vail VOTING AGAINST: Peltier Motion Carried. 9.0 ATTORNEY AND ENGINEER Mr. Johnson and Mr. Kuusisto submitted their monthly reports. Mr. Vail had been present at a previous meeting regarding the financial guaran- tees for his subdivision. It was determined that Mr. Vail would be required to submit a road bond in the amount of $25,000, and letter of credit in the amount of $112,500, and a performance bond in the amount of $90,000. All three are to be submitted at the same time, and meet with the approval of the city attorney. The previously recorded agree- ment remains the same. MOTION: McAllister made motion, Peltier seconded, that the NSP and Armon bond matters be tabled until 4/18/83. All aye. Motion Carried. March 21 , 1983 25 10.0 CLERK MOTION: Vail made motion, Atkinson seconded, that the city contact the Hugo Feed Mill regarding the application of weed control mea- sures in the city park. All aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, that the Clerk be authorized to purchase a time clock, rack, and cards from Stillwater Book & Stationery. VOTING FOR: McAllister, Atkinson, Schwab VOTING AGAINST: Peltier, Vail Motion Carried. MOTION: Vail made motion, Peltier seconded, to adjourn at 10:50 PM. All aye.
