PRESENT: McAllister, Peltier, Schwab Charles Johnson, Howard Kuusisto, and Mr. & Mrs. Doug Kruse ABSENT: Atkinson, Vail MOTION: McAllister made motion, Peltier seconded, that the City Attorney prepare an amendment to the agreement dated December 15, 1981 , between the City of Hugo and Mr. & Mrs. Doug Kruse, whereby Mr. & Mrs. Kruse will assign to the City all vested interest in the bond held by the City of Hugo regarding the Anton system installed on their property. The agreement shall also contain a pro- vision for $1000.00 to be paid to the City of Hugo no later than August 2, 1983, and a payment schedule amortizing the balance of $4,000.00 over a four (4) year period at 81/2% simple interest payable in equal monthly install- ments on or before the 15th day of each month. The original agreement and the amended agreement shall be recorded in Washington County, and the amend- ment shall contain a provision clearly stating that any transfer of ownership shall accelerate the payment of the balance of the principal. The agreement shall contain a provision securing a lien or second mortgage. All aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, to adjourn at 6:45 PM. All aye. Motion 9xzyd Theodora Peltier, Acting Secretary City of Hugo MINUTES OF THE REGULAR MEETING OF THE HUGO CITY COUNCIL May 16, 1983 The meeting was called to order at 7:01 PM. PRESENT: McAllister, Peltier, Atkinson, Schwab Johnson and Kuusisto ABSENT: Vail 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Schwab seconded, to approve the minutes of the Special Meeting of May 16, 1983, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the minutes of the regular meeting of May 16, 1983, as submitted. All aye. Motion Carried. 44 May 16, 1983 4.0 APPROVAL OF CLAIMS MOTION: Schwab made motion, Peltier seconded, to approve the General Claims for May 16, 1983, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the U tility Claims for May 16, 1983, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COtVMUNICATIONS AND LICENSES 5.3 Roy Shoguist - Drainage (Land Division) Mr. Shoquist and adjoining land owners from May Township to again discuss the possi- bility of a drainage problem for the May Township. Mayor McAllister did not feel there was a big problem - only the installation of culverts in the appropriate locations. Permits would have to be obtained from Rice Creek Watershed District, along with possible review of the septic system, and a driveway permit from the city. Access to the property to be divided would be via 169th Street in May Township with a private cul-de-sac located in Hugo, but used by May Township maintenance as a turnaround. McAllister addressed the possible problem of emergency vehicles from Hugo not being able to locate the property. He questioned the possibility of the cul-de-sac being constructed to city standards with the city accepting it as a city street. MOTION: McAllister made motion, Peltier seconded, that the City of Hugo write a letter to May Township stating that we do not object to the extension of 169th Street into the City of Hugo provided that the cul-de-sac be de- clared public roadway owned by the City of Hugo, and shall be constructed to the City of Hugo specifications which are a minimum of 90' turning radius and not less than 6" of Class 5 gravel based on a compacted thickness. A Letter of Credit, in the amount of $1200.00, payable to the City of Hugo guaranteeing above construction requirements will be met, will be deposited with the City of Hugo prior to the issuance of any driveway permits. The $1200.00 Letter of Credit shall also guarantee the proper installation of the drainage culverts for the driveway as may be required by the Rice Creek Watershed District. The street name in the City of Hugo shall be 169th Street Court. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the conditions in the pre- vious motion must be met no later than May 1 , 1984. All aye. Motion Carried. 5.4 Ella Caruth - Rezoning Mrs. Caruth has made application to rezone 20 acres from Industrial to Conservancy so that her daughter may construct a residence on the property. The Planning Com- mission recommended approval with no conditions attached. May 16, 1983 45 MOTION: McAllister made motion, Peltier seconded, to adopt Ordinance 192, AN ORDINANCE AMENDING CHAPTER 320 ENTITLED ZONING. All aye. Motion Carried. 5.2 Vern Peloquin - Variance Attorney Johnson had not been able to get with Howard Kuusisto regarding this matter. It was McAllister's opinion that a culvert is required across the proposed Freeland Avenue to diminish any drainage problems. MOTION: McAllister made motion, Schwab seconded, to approve the variance request of Vern Peloquin in that the City of Hugo will accept the proposed Freeland Avenue as a gravel road rather than the required blacktop for a public roadway, subject to the following: 1 . That the Hubbard Broadcasting Corporation amend their deed to conform with the proposed plat showing a public drainage way along the west side of Freeland Avenue. 2. That Mr. Vern Peloquin deposit with the city an amount equal with the actual cost as estimated by Washington County to install a culvert across proposed Freeland Avenue. 3. That Mr. Vern Peloquin pay the engineering charges to date for this appli- cation. McAllister withdrew his motion. MOTION: Peltier made motion allowing Vern Peloquin a culvert across Freeland Avenue according to the recommendations of Howard Kuusisto and after completion, accept the road. Motion died for lack of second. MOTION: McAllister made motion, Atkinson seconded, for approval of the application for variance to blacktop of a public roadway subject to the following conditions: 1 . That a culvert designed to transfer water from the east side of proposed Freeland Avenue to the west side of proposed Freeland Avenue be installed to the satisfaction of the city engineer, 60 days from today. 2. That the engineering charges for this application be paid to the clerk's office by the applicant. 3. That the KSTP deed by amended to reflect a proper drainage easement all the way to the south boundary of the property. All aye. Motion Carried. 5.5 Shackle/Stewart - Minor Subdivision Lee Stewart is proposing the division of one acre from a seven (7) acre parcel presently zoned SFE. McAllister stated that he would not be able to approve the Minor Subdi- vision of one (1) acre with an on-site system. Another matter to be discussed is access to the property via a private easement. The Council adjourned for an on-site inspection of the Stewart property. MOTION: McAllister made motion, Schwab seconded, that the Shackle/Stewart application be referred to the Planning Commission and the following be considered: 46 May 16, 1983 1 . The Planning Commission be requested to give consideration as to whether the city should allow one more residence to use what is essentially a private driveway. 2. The Planning Commission to cane up with a recommendation as to how we may guarantee the Charpentier's the integrity of the on-site septic system con- templated by the applicant. 3. The Planning Commission to consider whether a restrictive covenant should be entered on the deed for 7 acres if this applicant is allowed to build another home, requesting that no more hones or division of land be allowed on 7 acres until such time as a rezoning is sought and sanitary sewer should become available to the property. All aye. Motion Carried. 8.0 NEW BUSINESS 8.1 Ordinance 179 Sergeant Richter, Washington County Sheriff's Office, was present and stated that since October, 1980, we have had 15 reports of liquor law violations, and 8 since August, 1982. Ordinance 179 allowed for the sale of food after the closing of liquor at 1 :30 a.m. The sheriff's department has been unable to gain access to the establishments stating that they have been told they are closed for security reasons. McAllister stated that the whole point of contention is that the police have to have access to the buildings. MOTION: McAllister made motion, Peltier seconded, to adopt ORDINANCE 191, AN ORDI- NANCE AMENDING CHAPTER 150 OF THE HUGO CITY CODE ENTITLED "LIQUOR, BEER & WINES" TO REPEAL THAT PORTION ONLY OF ORDINANCE #179 ALLOWING AFTER HOURS USE OF LICENSED PREMISES FOR RESTAURANT FACILITY. All aye. Motion Carried. Let the record show that all liquor license holders were notified of the proposed ordinance and there were no shows. 5.6 Roger Dupaul - Site Plan Approval Mr. Dupaul, who leases the northern portion of the Horton yard, is requesting authorization to construct a 40 x 40 pole barn for storage and a portion to be used for office space. Mr. Dupaul agreed to comply with the recommendations of the Fire Chief regarding fire lanes. MOTION: Schwab made motion, Peltier seconded, to approve the Site Plan for Roger Dupaul for the construction of a 40 x 40 pole building, subject to Mr. Dupaul adhering to the submitted site plan and the Fire Chief's recommenda- tions as far as tire stacking and piling. All aye. Motion Carried. Let the record show applicant was informed he might be required to obtain a permit from the Rice Creek Watershed District. SALARIES - VOLUNTEER FIRE DEPARTMENT Mayor McAllister stated that he had taken an informal survey of other volunteer firemen that were present,,a mutual aid meeting held in the fire hall. Hugo was May 16, 1983 47 well below the figures quoted him. The volunteers are currently being paid $3.30/hour. The Fire Chief receives $600.00/year and the 1st and 2nd officers $150.00/each. MOTION: McAllister made motion, Schwab seconded, to adopt RESOLUTION 1983-7, A RESO- LUTION AMENDING THE SALARIES FOR THE HUGO FIRE AND RESCUE DEPARTMENT. 1. All fire fighters will be paid $3.30/hour until they have 12 full months of service on the Fire Department. 2. After 12 full months of service with the Fire Department, fire fighters will be paid at the rate of $5.00/hour. 3. The officers appointed by the Hugo City Council, Fire Chief, and 1st and 2nd Assistant Chiefs, will be paid at a rate of $6.00/hour. 4. All fire fighters who complete five (5) years of service during any one calendar year shall be paid a $50.00 annual stipend that year and four (4) years thereafter, provided the Fire Chief certifies, in writing, to the clerk's office that the fireman has completed 75% of the drills and meetings required by the Hugo Fire Department. 5. All fire fighters who complete 10 years of service during any one calendar year shall be paid $100.00 annual stipend and each year thereafter until retirement, provided the Fire Chief certifies, in writing, to the clerk's office that the fireman has completed 75% of drills and meetings re- quired by the Hugo Fire Department. 6. Failure of the Fire Chief to certify completion of 75% of drills and meetings as required by the Hugo Fire Department, for any member that year, shall result in forfeiture of the stipend for that year. All aye. Motion Carried. 8.2 Northwestern Bell Job Order MOTION: McAllister made motion, Peltier seconded, to approve Job Order J-31065 for Northwestern Bell. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the City Attorney be notified to write a letter to Richard Vail and explain to him, in writing, of the deficiency we feel exists at this time in the Development Agreement and no further action will be taken by the City Council or permits issued until these matters are cleared up to the satisfaction of the City. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that NSP's Job Order G-742101 be tabled. All aye. Motion Carried. Engineer Kuusisto instructed to notify NSP of the Council's decision. 9.0 ATTORNEY AND ENGINEER Messrs. Johnson and Kuusisto submitted their monthly reports. 10.0 CLERK The city received a letter from their insurance agency regarding premium costs for the new policy effective June 6, 1983. 48 May 16, 1983 NOTION: McAllister made motion, Peltier seconded, to notify the Beulke_Agency that it is the intention of the City of Hugo to continue in.the three. (3) year package program and we are anticipating that our insurance premium, calendar year 1983, will be $6828.00 or less. All aye. Notion Carried. NOTION: McAllister made motion, Peltier seconded, that the city notify the Beulke AGency to initiate a program of cancellation and rewrite as discussed with Jim Hubinger and Mayor McAllister, that will put the city on an insurance calendar year beginning in January, 1985. All aye. Motion Carried. NOTION: McAllister made motion, Peltier seconded, to extend the meeting passed 11:00 PM. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to extend the liquor license reser- vation for Esther and David Weigel for a period of 60 days. Present re- servation will expire June 1 , 1983. All Aye. Motion Carried. MOTION: McAllister made motion, Schwab seconded, to set the pay scale for Eugene Jenni, park maintenance, at $20.00/hour. All aye. Motion Carried. Mayor McAllister stated that he would talk to Darrell Jacobson regarding his in- tentions for serving on the Planning Commission.
