PRESENT: McAllister, Peltier, Atkinson, Schwab Attorney Johnson and Engineer Kuusisto ABSENT: Vail 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Schwab seconded, to approve the minutes of July 5, 1983, after the following insertion has been made: Page 61 (Fondant drainage) - McAllister has been unsuccessful in ob- taining approval from the property owner, Mary Ouimet, to have the drainage ditch cleaned. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the minutes of the Special Meeting of July 11 , 1983, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Atkinson made motion, Peltier seconded, to approve the General Claims for July 18, 1983, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS AND LICENSES (NAIL ARRIVED AT 7:05 PM) Initially, Mr. Claude Bloomer, 12471 Ethan Avenue, had requested no parking signs to be installed to eliminate vandalism to his property, especially in the winter. The signs created a parking problem for residents of Oakshore Park, and they requested the signs be removed. Mr. Bloomer was members of the Cakshore Park Association were present and agreed that the problem was centered from 126th Street to the south. MOTION: McAllister made motion, Peltier seconded, that Ethan Avenue be resigned "NO PARKING" on the east side of the road from 126th Street to George Jungblut's property. All aye. Motion Carried. 5.3 Esther Weigel - Liquor Licenses Mrs. Weigel, new owner of the Silver Spur Saloon, thought that she could obtain her liquor license at the meeting. She was told to complete the necessary applications when the building was approximately 3/4's complete. MOTION: McAllister made motion, Peltier seconded, to extend the reservation for an on-sale liquor license for Esther Weigel for 90 days. All aye. Motion Carried. 64 July 18, 1983 Esther Weigel - cont. Mrs. Weigel has completed the blacktopping at the establishment and requested a reduction in her $29,000 letter of credit. The letter of credit guarant ed black- topping and the construction of a barricade along Highway 61 . Mrs. Weigel stated that she had talked to DOT, and they stated that this would be there responsibility. MOTION: Peltier made nation, Schwab seconded, to reduce the letter of credit to $5,000 and to remain in effect until the Certificate of Occupancy is issued and city engineer certifies the barrier along Highway 61 . All aye. Motion Carried. 5.1 Robert Anderson - Disc on Blacktopping Homestead Drive Mr. Kuusisto stated that the improvement would cost somewhere between $15 - $20/foot. He suggested that the city hold an informal meeting with the property owners to discuss the possibility of going through with the improvement. 5.4 Randall Irving - Renew of Mobile Home Permit MOTION: Vail made nation, Peltier seconded, to renew the Mobile Home Permit for Randall Irving, 12870 Henna Avenue, under Chapter 40, Article III, Sub- division B, for 90 days. All aye. Motion Carried. 5.5 Windsor-Gro - Renew of Mobile Hone Permit MOTION: McAllister made motion, Peltier seconded, to table until the next meeting. All aye. Motion Carried. 5.6 Barry Stack - Rezoning Mr. Stack, surveyor and representing Richard Hollihan and Joseph Hopkins. was pre- sent to the discuss the proposed rezoning of 110 acres from Conservancy to Agricul- ture. A preliminary plan of how the land would be divided was presented. Mr. Stack stated that there would be a stormwater management plan for the property and the necessary drainage easements. There would also be a complete set of borings and perc tests for each site. Mr. Kuusisto has no objection, but stated his main concern was the drainage plan. MOTION: Vail made motion, Schwab seconed, to adopt ORDINANCE 193, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING DISTRICT CLASSIFICATION OF DESCRIBED REAL PROPERTY. VOTING FOR: McAllister, Atkinson, Schwab, Vail VOTING AGAINST: Peltier Motion Carried. Mayor McAllister informed Mr. Stack that at the time of the Land Division he will have to appear before the Planning Commission. 65 July 18, 1983 Barry Stack - cont. No action could be taken on the rezoning of the Joseph Hopkins property (10 acres) because of the lack of proof of ownership. This matter to be placed on the agenda for the meeting of 8/1/83. WINDSOR-GRU MOTION: Peltier made motion, Vail seconded, to renew the Mobile Home Permit for Windsor-Gro, 17385 Forest Boulevard, under Chapter 40, Article III, Sub- division D, for 90 days. All aye. Motion Carried. 5.7 Hubbard Broadcasting - Amended Special Use Permit Mr. George Merrill, engineer for KSTP, was present and stated they would like to construct a new pad and 2 more antennas on their property in the Peloquin Industrial Park. The Rice Creek Watershed has given approval to the project. Engineer Kuusisto requested an as built of the existing units, fence lines, and the drainage easement. MOTION: McAllister made motion, Atkinson seconded, to approve the Amended Special Use Permit for Hubbard Broadcasting, subject to receipt by the City Engi- neer of an as built showing the present facility and drainage easements. All aye. Motion Carried. 6.0 ORDINANCES AND RESOLUTIONS - No discussion. 7.0 UNFINISHED BUSINESS Councilman Atkinson reported that it would cost $135.00 to purchase and install water meters on wells to determine the amount of water entering the sewer system. WATER BILLING MOTION: Peltier made motion, Schwab seconded, that the city change its policy so that all utility payments postmarked the 10th of the month after issuance of the bills be considered not late. All aye. Motion Carried. 1983 SHERIFF CONTRACT The new Council was issued copies of the new contract for their review. This matter will be addressed at the meeting of 8/1/83. 9.0 ATTORNEY AND ENGINEER Attorney Johnson submitted his monthly report. Mrs. Peltier inquired as to the status of the drainage easements for Goodview Avenue. She stated that the Fashingbauer's were willing to sign an agreement at this time. Attorney Johnson will draft another agreement for submission to the Fashingbauer's. 66 July 18, 1983 MISCELLANEOUS There was some discussion regarding the condition of the rural roads relative to weed control. Mayor McAllister stated that no money had been budgeted for this purpose, and could be considered at budget time. Councilman Vail reviewed information received regarding the possibility of obtaining grant money for installation of lights for the ballfield. The estimated cost is $20,000. The city would be responsible for payment of $5,000 of that sum. MOTION: McAllister made motion, Atkinson seconded, that Mr. Vail be authorized to complete the appropriate applications to obtain grant money for the installation of lights at the city ballfield.
