Pursuant to due call and notice thereof, the City Council
of Hugo held their regular meeting on Monday, August 15,
1983 in City Hall. Mayor McAllister called the meeting
to order at 7:04 PM. Clerk called the roll; all present.
Motion by Peltier, second by Vail to approve minutes of
August 1 , 1983 meeting, motion carried.
Motion by Vail , second by Peltier to approve general
claims, motion carried. Motion by Vail, second by
Peltier to approve utility claims, motion carried.
5.0 Petitions, Requests, Communications and Licenses.
5.1 Vicki Mikesell - 165th Street water problem. Mr.
Mikesell advised council of numerous water problems the
residents are having on the street and in their yards
and requested a solution to the problem. Engineer stated
the problem might be with the depth of ditch and he will
check it out and report at next meeting. Mayor also
suggested writing Mosquito Control to try and alleviate
the insect problem in the area.
5.2 Barry Stack - rezoning. Matter tabled until the
City receives a certificate of survey on property.
5.3 Jeff Barbour - Rezoning. Discussion on this
rezoning was continued from last meeting. Questions
were asked by Councilwoman Peltier about the easement
on the south side of property, legal description being:
South 2 of NW* of Section 26 , Township 31 , Range 21 ,
easterly of County Road 8A. Motion by Schwab, second by
Vail to rezone property described above from Agricultural
to RR-1 , roll call taken: Schwab, aye; Vail, aye;
McAllister, aye ; Peltier, nay; Atkinson, nay, motion
denied.
5.4 St. John' s Church - license. Motion by McAllister,
second by Peltier to issue a 3.2 beer permit to St. John' s
Church of Hugo for picnic Sunday, August 28, 1983,
motion carried.
5.5 Donald Rieck - renew of Mobile Home permit. Motion
by Peltier, second by Schwab to renew temporary mobile
home permit for Donald Rieck from November 15, 1983 to
June 1 , 1984 when a building permit should be issued
and paid for, motion carried.
5.6 James LeRoux - renew of Mobile Home permit. Motion
by Peltier, second by Vail to renew mobile home permit
for James LeRoux, motion carried.
5.7 Willard Sykes rezone from Agricultural to Industrial.
Resident in audience stated that industrial ventures
should not be located in area of single family homes.
After further discussion, motion by Schwab, second by Vail
to rezone the 8.9 acres located on County Road #4 and
Highway 61 from Agricultural to Industrial and further
amended his motion to table matter for two weeks, motion
carried.

5.8 David Mattson - Site Plan Approval. Motion by Schwab,
second by Vail to approve site plan for David Mattson
for a 26 x 32 pole building contingent upon permit
being issued for new home construction prior to construc-
tion of pole barn, motion carried.
6.0 Ordinances and Resolutions - none.
7.0 Unfinished business - none.
8.0 New Business
8.1 Report on liquor liability. Attorney Johnson
advised council of statutory requirements concerning
dram shop liability insurance as adopted by the Minnesota
Legislature in the last session. Dram Shop committee
recommended that amendments to ordinances dealing with
non-intoxicating malt liquor licenses be drawn up by
Attorney reducing the $10 ,000. limit of gross sales
to $500 .
9.0 Attorney and Engineer.
Attorney Johnson handed out his monthly report which is
on file with the city clerk and referred to numbers 228,
476 , 478, 480 , 482 and 4.83. Regarding #476 - water main
extension. Motion by McAllister, second by Peltier
to authorize Mayor and Attorney to execute an application
to Burlington Northern for necessary permits to cross
over Highway 61 and 147th Street, motion carried.
9.1 Destruction Agreement. Motion by Vail, second by
Atkinson to authorize Mayor and Clerk to sign the Destruc-
tion Agreement with American National Bank of St. Paul,
agent for the City of Hugo for the fire equipment and
sanitary sewer improvement bonds, motion carried.
9.2 Kruse Settlement Agreement. Attorney Johnson reviewed
the agreement between Kruse and the City of Hugo . Motion
by McAllister, second by Schwab to authorize the Mayor
to execute the agreement upon recommendation of the City
Attorney, with the Kruses, motion carried.
9.0 Engineer. Engineer reported on the proposed culvert
in the Peloquin Industrial Park. Drawing was given to
council showing the two proposals for installation.
Letter and drawing is on file with city clerk. Motion
by McAllister, second by Vail that City of Hugo accept
Freeland Avenue provided the developer adjers to Proposal
#2 in letter dated August 15, 1983 from the City Engineer
and pays all the charges associated with proposal #2
including engineering fees, motion carried.
Motion by Peltier, second by Atkinson to adjourn meeting,
motion carried. Meeting adjourned at 8157 PM.
