PRESENT: Peltier, Schwab, Vail, McAllister City Engineer - Howard Kuusisto ABSENT: Atkinson 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Vail seconded, to approve the minutes of August 15, 1983, as submitted. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to approve the minutes of the Special Meeting of August 31 , 1983, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Vail seconded, to approve the General Claims of September 6, 1383, as submitted. MOTION: Vail made motion, Schwab seconded, to approve the Utility Claims of Septem- ber 6, 1983, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 White Bear Community Counseling Anne Reis, White Bear Lake Community Counseling Center, was present requesting Hugo's financial participation in their program. Twenty eight families were served by the center in 1982. In 1983 families were turned down unless they were able to pay the full cost of the service. Hugo failed to budget for any services (Forest Lake and White Bear Lake) in 1983. McAllister stated that Hugo would consider partial funding of the center if they would allocate the money to service only juveniles 18 and under, initially. Anne stated that she will respond to this condition prior to the Council meeting of September 19th. 5.2 Jer-Neen Spring - Rezoning Willard and Catherine Sykes had applied to rezone approximately 8.9 acres at the northeast corner of Highway 61 and 170th Street from Agriculture to Industrial. Kassen Rameden is the fee owner of the property. The city received a letter from Mrs. Sykes, stating that they will not be building at the site that was to be rezoned. Schwab then withdrew his notion for approval of the rezoning made at the Council meeting of August 15, 1983, and Vail withdrew his second. The fee owner did not request withdrawal of his application. 75 September 6, 1983 Jer-Neen Spring (cont.) MOTION: Vail made motion, Peltier seconded, to deny the application of Kassen Rameden and Willard and Catherine Sykes to rezone 8.9 acres at the northeast corner of Highway 61 and County Road 4 (170th Street) from Agriculture to Industrial. Reason for the denial being Jer-Neen Spring, being the interested party, has withdrawn their application from purchasing that property. Ail aye. Motion Carried. 5.3 Rubbish Licenses MOTION: McAllister made motion, Peltier seconded, to grant Rubbish Licenses to the following: LAKE SANITATION, WOODLAKE SANITARY SERVICE, DOALL SERVICE, MARONEY'S SERVICE, AND BELLAIRE SANITATION, subject to re- quired Certificate of Insurance. All Aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, to approve the Rubbish License for MCS REFUSE, subject to receipt of payment for application fee. All aye. Motion Carried. 6.0 REPORTS OF OFFICERS & COMMIES 6.1 Ordinance Committee - No discussion 6.2 Planning Commission - No discussion 6.3 Building Inspector - No discussion 6.4 Fire Chief - No discussion 6.5 Clerk The clerk informed the Council that she had issued a temporary Mobile Home Permit to Sandy Olsen who had lost her home due to a fire. The permit will be renewed every 90 days as long as necessary. SITE PLAN APPROVAL MOTION: Vail made motion, Schwab seconded, to approve the Site Plan for May Belle Massie, 6616 170th Street, for the construction of a 28 x 40 pole barn for personal storage, according to the submitted site plan. All aye. Motion Carried. 9.0 NEW BUSINESS 9.1 Project 8311 MOTION: McAllister made motion, Peltier seconded, to advertise for bids for Im- provement Project 8311 in the official newspaper two (2) times. Ad- vertisement should state that the bids will be opened by the City Engineer at Hugo City Hall, on October 3, 1983, 7:30 PM. All aye. Motion Carried. September 6, 1983 76 MOTION: Peltier made motion, Vail second, authorizing the Mayor to execute the application for Pipe Line Permit from the Burlington Northern Railroad for Project 8311 . All aye. Motion Carried. 10.0 MISCELLANEOUS MOTION: Vail made motion, Peltier seconded, that the Mayor and City Clerk be authorized to execute the Application by Governmental Subdivision for Conveyance of Tax-Forfeited Lands, thereby obtaining an easement for road purposes on Parcel 93725-2950 (Shadyside, Block 7, Lots 11 - 21) . All aye. Motion Carried. The clerk was instructed to contact Doug Kruse regarding the agreement sent to his attention. The city would like to get document finalized as soon as possible. COMPLAINT The city has received a complaint about the throwing of garbage on a property line. MOTION: McAllister made motion, Peltier seconded, that Councilman Vail be directed to contact the Hjelmhaug residence to advise them we have a complaint about garbage on their property line. They are to remove said garbage within 5 days of notification and if they fail to do so, the clerk is to issue a nuisance abatement notice to appear before the Council at their meeting of September 19th at 7:15 PM.
