MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL
October 3, 1983
The meeting was called to order by Mayor McAllister at 7:03 PM.
PRESENT: Peltier, Atkinson, Schwab, Vail, McAllister
3.0 APPROVAL OF MINUTES
MOTION: Peltier made motion, Vail seconded, to approve the minutes of September 19,
1983, after the following correction has been made:
Page 78 - that the City of Hugo formally request the Rice Creek Watershed
District to reinspect
All aye. Motion Carried.
MOTION: Vail made motion, Peltier seconded, to approve the minutes of September 21 ,
1983, after the following correction has been made:
Page 82 (2nd paragraph) - The Council was presented with a signed document.. ..
Delete the name of Mr. Markeson.
All aye. Motion Carried.
4.0 APPROVAL OF CLAIMS
MOTION: Vail made motion, Peltier seconded, to approve the General Claims for
October 3, 1983, as submitted.
All aye. Motion Carried.
MOTION: Vail made motion, Atkinson seconded, to approve the Utility Claims for
October 3, 1983, as submitted.
All aye. Motion Carried.
5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES
5.1 Jim Hubinger
Mr. Hubinger, agent for the Beulke Agency, was present to discuss his recommendation
that the City of Hugo purchase Public Officials and Employees Liability Insurance.
The package would be for three (3) years, and the annual premium $800.00. The policy
would cover the City of Hugo, Council, appointed people, and any employee acting for
the City. Mr. Hubinger stated that the attorney and engineer would be covered by
their own professional liability insurance.
MOTION: Schwab made motion, Vail seconded, that the City of Hugo purchase Public
Officials and Employees Liability Insurance to become effective 10/1/83.

5.2 Tom Oswald - Forest Lake Youth Service Bureau
Mr. Oswald, director of the Bureau, was present, requesting the city's financial
participation in the amount of $2,000.00. The service is provided to residents

of communities participating in the program. Because of an excess in fines col-
lected in 1983, the city has decided to help financially the White Bear Commu-
nity Counseling Center and the Forest Lake Youth Service Bureau.
MOTION: McAllister made motion, Schwab seconded, that the City of Hugo provide
funding for the White Bear Lake Area Community Counseling Center, in
the amount of $2,500.00 for the year 1984, and that we provide funding
for the Forest Lake Youth Service Bureau, in the amount of $2,000.00,
for the year 1984. The monies are to be paid from surplus of court
levied fines in 1983, and that checks be placed on the claims for the
last meeting in December, 1983.
VOTING FOR: Peltier, Schwab, Vail, McAllister
VOTING AGAINST: Atkinson
Motion Carried.
5.3 PROJECT 8311 - OPENING OF BIDS
The opening of bids commenced at 7:33 PM, with Tom Fast representing the City
Engineer, Howard Kuusisto. There were three (3) bids submitted as follows:
RO-SO $34,075.75
EJM CONST. 31 ,370.20
TWIN CITY TUNNELING $30,023.00
The City has received a permit from MDOT, but nothing received to date from the
railroad. Mr. Fast recommended that the awarding of the bid should be tabled
until the next meeting.
MOTION: McAllister made motion, Peltier seconded, to set a Special Meeting of
the City council for October 17, 1983, at 6:00 PM, at which time the
City will award the bid for Project 8311. Other city business may be
considered at that Special Meeting.

5.4 Robert Ricci - Special Use Permit
Mr. Ricci is proposing the moving in of a 4 unit, multi-family dwelling, with the
construction of 2 more units in the basement. The Site Plan has the required num-
ber of parking slots for the number of units and bedrooms. A 100' privacy fence
will be constructed along the east property line, and the Mayor suggested that that
fence be constructed of wood, as well as the around the dumpster area. A concrete
slab will be poured this year yet for future construction of a garage. Mr. Ricci
stated that the parking lot will face 147th Street and will be pitched so as to
drain into that street. Lower 147th Street should have minimal drainage from the
project. Ricci also stated that the building will be refurbished inside as well
as well as exterior painting.
MOTION: Schwab made motion, Atkinson seconded, to approve the Special Use Permit
for Robert Ricci to move in a 4 unit, multi-family dwelling, and the
construction of 2 basement units, subject to the following conditions:
1 . Drainage of water from the roof and parking lot shall drain to
147th Street.

2. A Letter of Credit, satisfactory to the City, in the amount of $25,000.00,
shall be submitted to insure blacktopping, exterior painting, build to
meet State electrical and building codes, fencing, sod and shrubbery.
All aye. Motion Carried.
Mr. Ricci was informed that as conditions of the Letter of Credit are completed, the
City will consider releasing/reduction in the $25,000.00.
5.5 Kevin Mann - Special Use Permit
Mr. Mann is purchasing one acre of land from Robert Dotte, lying west of Highway 61
on 165th Street, with hopes of purchasing the remaining 19 acres. He would like to
construct a 30 x 48 pole building prior to the residence. t hT building would be
located 10' from the interior property line rathernind required 20' . Mr.
Mann has been unable to make contact with the property owner to-the east to obtain
his written consent. Mann stated that his plans are for the construction of a home
in 1984.
NOTION: McAllister made motion, Schwab seconded, to approve the Special Use Permit
for Kevin Mann to construct a 30 x 48 pole barn prior to construction of
the principal building, for his personal storage. Approval subject to
the following:
1. Proof of ownership submitted in a manner acceptable to the city.
2. Submission of a letter from the property owner immediately to the
east stating no ojbection to the 10' sideyard setback.
3. Submission of a satisfactory Letter of Credit, cash deposit, or per-
formance bond, in the amount of $1,000.00, guaranteeing a building
permit will be issued for the principal building, and construction
will commence no later than August 1, 1984. Building will be removed
from the property if no house construction has begun and no extension
requested.

5.6 Eugene Schultz - Renew of Mobile Home Permit
NOTION: Vail made motion, Peltier seconded, to renew the Mobile Home Permit for
Eugene Schultz, 8340 140th Street, granted under Chapter 40, Article III,
Subdivision B, for a period of 90 days, and subject to payment of the
$10.00 fee.
All aye. Motion Carried.
6.0 REPORTS OF OFFICERS & COMMITTEES
6.1 Ordinance Committee - No discussion
6.2 Planning Commission - Vacancy
NOTION: Peltier made motion, Atkinson seconded, to appoint Mr. Raymond Olson to fill
the unexpired term of Darrell Jacobson on the Planning Commission (12/31/85) .
VOTING FOR: Peltier, Atkinson, Schwab, McAllister
VOTING AGAINST: Vail

6.3 Building Inspector - No discussion

7.0 ORDINANCES AND RESOLUTION - No discussion
8.0 Unfinished Business
Mr. Syl Nistler, resident on Flay Avenue, was present to ask about the proposed
street light that was to be installed on Flay. Mayor McAllister was unaware that
Mr. Nistler did not know of the plans, but assured him that no installation would
commence until all residents were aware of the final plans.
9.0 NEW BUSINESS
9.1 White Bear Rod & Gun Club
Mayor McAllister received a call during tonight's meeting requesting that no dis-
cussion take place regarding the gun club unless a representative was there.
Mayor McAllister stated that he would honor their request. There was some dis-
cussion about some construction that has taken place on the property.
MOTION: McAllister made motion, Peltier seconded, that the Building Inspector
be directed to inspect the alleged construction and report to the City
Council whether a violation of the Building Code has occurred.

10.0 MISCELLANEOUS
Mr. Ronald Granger has made application for an On-Sale Liquor License for the
business known as Paul's Pizza. The application has been forwarded to Sheriff
Trudeau for his comments, and the Council decided on holding a hearing on this
matter, to be published in the Forest Lake Times.
MOTION: McAllister made motion, Peltier seconded, to schedule a hearing for
October 17, 1983, at 8:00 PM, for the consideration of Ronald Granger's
application for an On-Sale Liquor License.
All aye. Motion Carried.
It was Councilman Vail's opinion that the City should wait until next spring to
determine if the elms on the northeast corner of the city park are diseased. Mr.
Hicks is to be notified of his decision.
MOTION: Peltier made motion, Vail seconded, to adjourn at 9:50 PM.
