HomeMy WebLinkAbout1983.10.17 CC Minutes 90 MINUTES OF THE SPECIAL MEETING OF THE HUGO CITY COUNCIL October 17, 1983 The meeting was called to order by Mayor McAllister at 6:12 PM. PRESENT: Peltier, Schwab, McAllister ABSENT: Atkinson, Vail Let the recoreNiat the requirements for a special meeting have been met. The meeting was called specifically to award the contract the Project 8311 . The bids had been opened at the meeting of October 3, 1983, at 7:30 PM, and the results were as follows: Twin City Tunneling $30,023.00 EJM Pipe Services 31,370.20 Ro-So Contracting 34,075.75 Howard Kuusisto, City Engineer, recommended that Twin City Tunneling, as low bidder, be awarded a contract in the amount of $30,023.00 for the 147th Street Watermain Improvement Project. The city has not yet received a permit from the railroad. A letter of approval should be coming shortly. MOTION: Peltier made motion, Schwab seconded, that the City of Hugo award the contract for Project 8311 to Twin City Tunneling, in the amount of $30,023.00, and that no work commence until the City Engineer provides a written statement. All aye. Motion Carried. Councilman Charles Schwab received a complaint from Don Rice regarding his neighbor, Neal Fagerhaugh. Mr. Rice contends that because of recent excavation on the Fa- gerhaugh property, the culvert on his driveway is becoming plugged. He also felt that a barricade constructed on the Fagerhaugh property is an "eye sore" to him. McAllister and Schwab will make an on-site inspection of the property. MOTION: Peltier made motion, Schwab seconded, to adjourn at 6:25 PM. All aye. Motion Carried. The regular meeting of the Hugo City Council was called to order at 7:02 PM. PRESENT: Peltier, Schwab, McAllister Attorney, Charles Johnson 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Schwab seconded, to approve the minutes of October 3, 1983, after the following correction has been made: Page 88 (5.5) - eliminate the duplication of the word "located" All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Schwab seconded, to approve the General Claims for October 17, 1983, as submitted. All aye. Motion Carried. 91 October 17, 1983 MOTION: Schwab made motion, Peltier seconded, to approve the Utility Claims for October 17, 1983, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Grace Jackson - Petition for Temporary Mobile Home Permit Mrs. Jackson, 4970 130th Street North, lost her house to a fire in the Fall of 1982. She has now applied for a permit to live in a mobile home while her house is being reconstructed. MOTION: Peltier made motion, Schwab seconded, to grant a temporary Mobile Hone Permit to Grace Jackson, 4970 130th Street North, under Chapter 40, Article III, Subdivision B, for a period of 90 days. Duration of per- mit shall not exceed two years. All aye. Motion Carried. JERRY SARAU - LAND DIVISION Mr. Sarau and Paul Tubbs were present to discuss the division of 20 acres into two 10 acre parcels. There is only 512 feet of frontage and would require two variances. After review of the zoning map, it was determined that the 20 acres was zoned Conservancy and would require a rezoning to be able to divide the land. 5.2 Tom Crever - Letter from Gerald Gullickson The City had received a letter from Mr. Gullickson regarding the condition of the residence of Byron Seelig. The only portion of the letter that the city could address was the possible building code violation relative to the abandonement or suspension of work for a period of 120 days. It was the Building Inspector's opinion that there was no violation. Construction at White Bear Rod & Gun Club Mr. Crever discussed the construction with club member, Jerry Perron, cgs informed that the shelter was to be used for testing to determine if they can meet the PCA standards for noise. Mr. Crever stated that it was his opinion that the cost of the shelter exceeds the $500.00 minimum and is a violation of the building code. Tennis Courts (Lions Club) Mr. Crever, representing the Lions Club, stated they are interested in participating with the city for the restoration of the tennis courts on the city park. They had an estimate of $10,000 to complete the work. Mayor McAllister stated that the city could utilize its contract with the county highway department and get the work done at a much lower cost. Further consideration will be given this project. Randall Irving - Renew of Mobile Home Permit MOTION: Peltier made motion, Schwab seconded, to renew the Mobile Home Permit for Randall Irving, 12870 Henna Avenue North, under Chapter 40, Ar- ticle III, Subdivision B, for a period of 90 days. All aye. Motion Carried. October 17, 1983 92 5.3 Ronald Granger - On-Sale Liquor License Hearing (8:00 PM) The city scheduled a hearing for 8:00 PM to hear any comments regarding the applica- tion of Ronald Granger for an on-sale liquor license/Sunday for Paul's Pizza. There was no one present to make comment. The Sheriff's Department sent a sstisfactory recommendation regarding a criminal history. Mr. Granger is aware of the financial guarantees necessary for these licenses, and will be submitted if granted. MOTION: Schwab made motion, Peltier seconded, to grant the following licenses to Ronald Granger for the establishment known as PAUL'S PIZZA: ON SALE INTOXICATING LIQUOR AND ON SALE SUNDAY LIQUOR, in the amount of $425.01 . All aye. Motion Carried. 5.4 Joe Oman - Amended Special Use Permit Mr. Oman is proposing the expansion of the Twin Pine Trailer Park to include 28 new units. The Planning Commission recommended approval subject to seven con- ditions that are available in the file. Karla Wahl, attorney for Mr. Oman, was present and stated that it was their position that the city could not require Mr. Oman to install fire hydrants. They contend that the state regulations for mobile home parks would supersede any conditions required by the city. Fire Chief, Ron Istvanovich, submitted a report stating his recommendation that three fire hydrants be installed in the expansion. He also enclosed pertinent portions of the UNIFORM FIRE CODES. There was some discrepancy as to whether the portions submitted were adopted codes. Mayor McAllister stated that he would like to talk directly to the Fire Marshall prior to taking any action on this matter. Roger Nelson, engineer for the park, stated that the cost for three hydrants and a 6" main would be approximately $15,000 to $20,000. Should Mr. Oman hookup to the city's water service, easements would have to be provided for normal utility main- tenance. It was Mayor McAllister's recommendation that the city should know for sure whether the codes addressed by the Fire Chief have actually been adopted. Ms. Wahl was in- formed that the next regular Council meeting was 11/7. She stated that that would be too late and the project would have to be dropped. Rather than delay action on the ASUP, the city could approve the application contingent to the requirements of the State Board of Health standards being met. The plans have been submitted to the State and should be approved next week. She reminded the Council that they are considering only the expansion and not the established park. Mayor McAllister stated that it was his opinion that the city would allow Mr. Oman to hookup to the city water supply. However, his opinion will change if the city is not allowed the use of the water. If Mr. Oman would have to install a private fire system, the city would require engineering specifications. Ms. Wahl requested the Council to take action on the matter this night or possibly set a Special Meeting prior to 11/7. M)TION: McAllister made motion, Schwab seconded, that the matter be tabled until the Special Meeting on November 2, 1983, at 7:00 PM, to consider the application of John J. Oman for an Amended Special Use Permit. The City Attorney will provide the Council with information regarding the current Minnesota requirement for fire codes in manufactured have parks. All aye. Motion Carried. 93 October 17, 1983 6.0 ORDINANCES AND RESOLUTIONS - No discussion. 7.0 UNFINISHED BUSINESS Catherine Anderson, owner of Carpenter's, was present to inquire if Chapter 150 could be amended to allow for a 6:00 AM opening to serve breakfast. The ordinance now allows for 8:00 AM opening. MOTION: McAllister made motion, Peltier seconded, that the Clerk be directed to draft an ordinance amending Chapter 150 to allow for a 6:00 AM opening. All aye. Motion Carried. The city has not received the Letter of Credit as conditioned in the approval of the Special Use Permit issued to Robert Ricci for the multi-family dwelling. The permit holder had been notified of a 7:00 PM deadline, 10/17. MOTION: McAllister made motion, Peltier seconded, that the City Clerk be directed to hand deliver a letter from the City Council to cease all construc- tion on the property owned by Mr. Robert Ricci, effective immediately, until such time as a sstisfactory Letter of Credit ($25,000) is deli- vered to the City of Hugo. Also, the Clerk is to deposit in the mail a copy of the same order to Mr. Ricci. All aye. Motion Carried. 9.0 ATTORNEY AND ENGINEER Mr. Johnson submitted his montly report. MOTION: McAllister made motion, Peltier seconded, that the City Clerk be directed to notify by certified mail, the officer of the White Bear Rod and Gun Club who signed the Special Use Permit, enclosing copies of both letters from attorneys Hiniker and Malkerson, and to confirm, in writing, who is their attorney of record. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, to amend the motion relative to the Special Meeting of November 2, 1983, to include, and other city business. All aye.
