PRESENT: Peltier, Atkinson, Schwab, Vail, McAllister The special meeting was called to hear the presentation of Herb Reissner, EL Marketing, regarding the punchcard voting system. Mr. Reissner is to submit to the city a cost estimate to implement the new system in Hugo. MOTION: McAllister made motion, Vail seconded, to adjourn the special meeting at 7:10 PM. All aye. Motion Carried. The regualr meeting of the City Council was called to order at 7:22 PM. PRESENT: Peltier, Atkinson, Schwab, Vail, McAllister Attorney Johnson and Engineer Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Vail seconded, to approve the minutes of November 7, 1983, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Vail made motion, Schwab seconded, to approve the General Claims for November 21 , 1983, as submitted. All aye. Motion Carried. MOTION: Schwab made motion, Vail seconded, to approve the Utility Claims for November 21 , 1983, as submitted. All aye. Motion Carried. • MOTION: McAllister made motion, Peltier seconded, that the following claim be added to the Utility Claims (Water Dept) : TWIN CITY TUNNELING - $27,839.54 (Project 8311) All aye. Motion Carried. Let the record that the money will be paid from the water revenue fund. A Change Order will be issued by the engineer relative to the city being responsible for the restoration of the street and sod rather than Twin City Tunneling. 5.0 PETITIONS, REQUESTS, CONMKUNICATIONS & LICENSES 5.1 Wilbur Harris - Amended Special Use Permit Mr. Harris was present and stated that he would like to apply for a Building Permit for the restoration of the building previously known as Schmidty's. Mr. Harris 101 November 21 , 1983 stated that he will be responsible for payment of SAC charges in the amount of approximately $10,000.00. That sum must be paid at the time the Building Per- mit is picked up. MOTION: McAllister made motion, Peltier seconded, to approve a Special Use Per- mit for Wilbur Harris Investments, Inc. , which shall contain all the conditions of the SUP issued April 18, 1983, and the conditions in the City Council minutes of November 7, 1983. All aye. Motion Carried. 5.2 Peter Schuna - Variance Mr. Schuna, 9825 122nd Street, would like to construct an accessory building closer to the front lotline than the principal building. The ordinance allows for a 40' setback requirement and the garage will be constructed so that it meets that requirement. MOTION: McAllister made motion, Peltier seconded, to approve the variance for Peter Schuna to construct an accessory building closer to the front lotline than the principal building. All aye. Motion Carried. 5.3 Charles Shubat - Special Use Permit MOTION: Peltier made motion, Vail seconded, to approve the Special Use Permit for Charles Shubat, to sell Christmas trees on land located at 14530 Homestead Avenue until December 31 , 1983. All aye. Motion Carried. 5.4 Flay Avenue Street Light Residents from Flay Avenue were present to discuss the installatimi of a street light and a plan as presented by NSP. All residents present, with the exception of one, were in favor of the plan. MOTION: Schwab made motion, Peltier seconded, to install a street light on Flay Avenue, north of 147th Street, with underground wiring. The res- ponsibility for restoration of the yards will be the city's. All aye. Motion Carried. 5.5 Don Mosher - Representative from Senator Boschwitz's Office Mr. Mosher was present to listen to the concerns of the City of Hugo to relay to Senator Boschwitz. 5.6 American Legion - Review of SUP Mayor McAllister reviewed the water bills for the American Legion and it was determined that an additional RBC charge would not be required at this time. A letter to that effect shall be sent to the Legion. November 21 , 1983 102 LIQUOR LICENSES • MOTION: McAllister made motion, Vail seconded, to grant an ON SALE CLUB LICENSE AND CIGARETTE LICENSE to tIe AMERICAN LEGION POST 620, 5736 147th Street, in the amount of $112.00. All aye. Motion Carried. MOTION: Peltier made motion, Schwab seconded, to grant and OFF SALE LIQUOR LICENSE to ROBERT RICCI DBA RICCI'S SALOON, 14777 Forest Boulevard North, in the amount of $100.00. All aye. Motion Carried. MOTION: Schwab made motion, Peltier seconded, to grant an OFF SALE LIQUOR LICENSE TO GPR & ERA, DBA BLACKSMITH LOUNGE, 17205 Forest Boulevard North, in the amount of $100.00. All aye. Motion Carried. MOTION: Peltier made motion, Vail seconded, to grant an OFF SALE LIQUOR LICENSE to ONEKA HILLS FARMS, INC., 12010 Keystone Avenue, in the amount of $100.00. All aye. Motion Carried. MOTION: Vail made motion, Peltier seconded, to grant an OFF SALE LIQUOR LICENSE to CATHERINE E. ANDERSON DBA SWANNY'S OF HUGO, INC., 14559 Forest Blvd. , in the amount of $100.00. All aye. Motion Carried. 6.0 ORDINANCES AND RESOLUTIONS - No discussion 7.0 UNFINISHED BUSINESS - No discussion 8.0 NEW BUSINESS Fire Chief, Ron Istvanovich, was present to request funds to purchase two radios. He recommended the purchase be made from Capitol Electronics - Airtron, 6 channel, 5 watt. MOTION: Schwab made motion, Peltier seconded, authorizing the Fire Chief to pur- chase two radios from Capitol Electronics at $639.50/each. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, authorizing the Fire Chief to install a central charging system for all fire trucks, in an amount not to exceed $250.00. All aye. Motion Carried. MOTION: McAllister made motion, Vail seconded, to add Robert Ricci to the Council agenda. All aye. Motion Carried. 103 November 21 , 1983 The Building Inspector was present to state the problems he has found at the multiple dwelling that was moved into Hugo by Robert Ricci. They are as fol- lows: The Council also recessed to make an on-site inspection of the bldg. 1. Front yard setback (garage slab installed does not meet 30' setback req) . 2. Fence around dumpster and along east property line too high (4' allowed) . 3. Windows located on 2nd floor are too high from the floor and do not open to the required clearance (fire safety) . 4. Handicap ramp already installed does not have the right pitch. MOTION: Peltier made motion, Schwab seconded, to grant a variance to Robert Ricci of not more than 15' for a front yard setback (147th Street) . All aye. Motion Carried. Mayor McAllister stated that the ramp will have to be revamped to accommodate the handicap. Inspector Crever will check with the State as to whether they will accept a permanent step .below the window in lieu of meeting the height requirement by remodeling. Ricci will check to see if hardware is available to make the window open to the required clearance. All fencing is to be 4' . MOTION: McAllister made motion, Peltier seconded, to approve an Amended Spe- cial Use Permit for Robert Ricci to install 4' fences instead of 5' fences. Approval is subject to receipt of an application by the clerk's office. The fee for the application is waived. All aye. Motion Carried. 9.0 ATTORNEY AND ENGINEER Mr. Johnson submitted his monthly report. Engineer Kuusisto stated Shamrock Glen is getting ready to finalize on their streets, and that an additional sanitary sewer inspection is required. 10.0 CLERK MOTION: McAllister made motion, Peltier seconded, to adopt RESOLUTION 1983-17, A RESOLUTION AMENDING RESOLUTION 1980-61 IN THAT THE CITY OF HUGO WILL ACCEPT PERSONAL CHECKS FOR PAYMENT ON ALL BILLS TO THE CITY OF HUGO UNLESS OTHERWISE SPECIFIED. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, setting November 25, 1983, as the Floating Holiday for the clerk's office. All aye. Motion Carried.
