HomeMy WebLinkAbout1973.02.05 CC Minutes FEBRUARY 59 1973 MINUTES OF PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF HUGO x The meeting was called to order by Mayor Carlson at 7:09 PM. Roll was called: Carlson, LaValle, Leroux, Bjorum, and Lease present. Motion made by LaValle seconded by Leroux to correct the minutes of January 2nd to read that Dan Spitzer was appointed to the Planning Commission for a term of four years, not three. Motion carried. Minutes approved as corrected. General and Water Dept. Claims were approved after review. Representative Jerome Belisle appeared before Council concerning the additional liquor license for the Village. He said the bill had claeared the Senate Committee and is scheduled for a House Committee meeting on Thursday, February 8, 1973, Mr. Belisle also asked the Council to send him resolutions regarding things they wanted or dkV t want an he would work on them. Richard Hill appeared before Council concerning his application for a Special Use Permit to raise dogs on his property. Motion made by LaValle, seconded by Bjorum that Richard Hill be granted a Special Use Permit for a dog kennel subject to the following conditions contained in a letter from Bill Schwab, dated January 16, 1973: 1. The Special Use Permit be limited to the keeping of six dogs over four months of age. If at some point in the future Mr. Hill desires to increase the kennel size past six dogs, it would be necessary for him to obtain an amended special use permit. 2. The dennel to be located on the property in such a way that the dog runs are on the south side of the building or toward the interior of the lot. The dogs runs to be fenced and the runways to be of either concrete or asphalt. 3. The drainage from the kennel and dog runs to go into a separate septic tank with a drainfield for disposal. 4. The kennel to be insulated with a minimum of four inches of insulation or some other acceptable material which will act as a sound barrier. 5. Should complaints due to noise be received in the future, the Village Council or Planning Commission may hold a public hearing to determine the extent of the nuisance being created and if they find sufficient evidence that there is a nuisance being created, they may amend the special use permit by including special conditions which may be necessary to eliminate the nuisance. Motion carried unanimously. Lyle Lehner appeared before Council regarding his invalid Mobile Home Perm it. He said he has always paid his fees on time and he simply has to have the trailer for a watchman on his property. LaValle stated that he would like getting together with Charles Johnson to discuss mobile home permits. Motion made by LaValle, seconded by Bjorum to table Lyle Lehner Mobile Home Permit until the meeting of February 20, 1973. Motion carried unanimously. Pam Bjorum reported for the Ordinance Committee that in the future their meetings will be held on the last Thursday of the month at 7:00 PM. Regarding the new Village Code, Jack Devney has a numbering system and titles, and the committee is trying to take the best of the Old Village and Oneka Township ordinances if they apply to the Consolidated Village and get new ordinances if none apply. They have been working on ordinances con— cerning election, fire, and civil defense, and next month will cover streets, sidewalks parks, and police. Attorney Johnson stated that as they get sections completed, he will check them. Alex Guertin from the Department of Natural Resources appeared concerning the discon— tinuing use of fire wardens. Open Burning in Washington County is to be left up to the munici— palities; whether they want permits issued through the Village Hall, Fire Dept., or still have a Fire Warden. Mr. Guertin also stated that the Village should also have a Burning Ordinance stressing safety and protection of private property. As far as air pollution is concerned, the Village is covered under the Minnesotat State Law. FEBRUARY 59 1973 17 Irene Leroux reported for the Planning Commission that Jim Houle has consented to be their secretary. She also said the February Comprehensive Planning Meeting will adver a Community Facilities Plan, and Zoning Ordinance. The Commission has been working on the Subdivision Plan Application Checklist, and the Richard Vail request for Subdivision is to be discussed at the February 20th meeting. Motion made by Leroux, seconded by Lease to appoint Jim Houle as secretary to the Planning Commission. Motion carried unanimously. Don,1ease reported for the Sewer and Water Committee at their last meeting they dis- cussed responsibilities; construction, ordinances, etc. They also want to have a cost plan ready along with a comprehensive plan for sewer and water. Mr. Kuusisto reported that funds have been put aside by HUD and everything looks in good order. Regarding village maintenance operations, LaValle reported that he had an ordinance relating to an equipment fund for the Ordinance Committee to look over. An ordinance is needed to set up a fund to maintain a fire truck, road grader, truck# squad car, tractor snowplow, etc. Mr. LaValle would like to consult with Howard Kuusisto and Charles Johnson concerning a Right of Way Map for the village. It was reported the Graham Anderson has been working on one and LaValle is to see how much money he wants for it. Ken Granger, the fire chief, reported that his men need keys for the fire hall, and the portable generator for the jeep needs fLxing. Motion made by Leroux, seconded by LaValle that Fire Chief be authorized to have portable generator fixed. Motion carried. Motion made by LaValle and seconded that Chief have ten sets of keys made for the fire hall. Motion carried. LaValle reported that he's having someone out to check on having the outside lights on the hall put on a photoelectric system. Motion made by Leroux, seconded by Bjorum that Chief Granger draw up a mutual aid contract with Forest Lake Fire Dept. and send to Charles Johnson for review. Motion carried. Chief Granger also made known the fact that he would like a workshop with the Council and his men in the future to discuss Firemen Pension Fund. Regarding specs for the new fire truck, Granger is to have the blueprint corrected and give the specs to Mr. Johnson for his approval before the next council meeting. Marvin LaValle pointed out that the Fire Chief is paid only $50.00 per year for his work, which he thought was not enough. He suggested having a decent salary for the Chief decided upon by the next meeting. Police Chief Gunderson reported that he had talked with Mrs. Warren Vining regarding their delinquent $80.00 Mobile Home Permit Fee, and they intend to pay the amount by Friday, February 9, 1973. Their trailer has a for sale sign on it and should be moved shortly. As Gunderson wanted an okay from the Council for his $150.00 per year clothing -allowance, the following action was taken: Motion made by LaValle, seconded by Bjorum to pay Chief Gunderson 1973 clothing allowance of $150.00. Motion carried. The Council also Okayed Gunderson use of the old typewriter, and Clerk Burkard is to notify him he can take it to Forest Lake for repair at a cost of not more than $25.00. The next report came from Street Superintendent Jerry Dube, who began by saying he had attended a meeting in regard to weed control at the USDA Office. He stated there is a need in our community to adopt stricter weed control in our ordinances. Dube went on to the subject of a radio system and said he had looked more extensively into the subject. As far as medical insurance, he's having representatives from American Family and Mutial of Omaha coming to see him this week. Clerk Burkard then presented his 1972 Annual Financial Report to the Council for their appal. Leroux moved and LaValle seconded the motion the Council accept Village Clerk's 1972 Annual Report. Motion carried unanimously. Tom Crever, the Building Inspecotor, reported that he had gone to the Building Inspectors School in January. He stated that the Plumbing Inspector Bob Vadnais, would like to go to a workshop pertaining to on-site sewage disposal systems to be held in February. Motion made by LaValle, seconded by Bjorum to send Bob Vadnais to the County Sanitary Workshop February 20-22 and pay him registration fee of $20.009 $20.00 per day and 9¢ a mile. Motion carried unanimously. FEBvARY 59 1973 19 Regarding bonding for the Bdg. Inspector, Clerk Burkard had looked into this, and found that no liability insurance was available. Attorney Johnson stated that it is proved by ordinance that the Village must back up the inspector if he's doing his job properly. Regarding Farm Building Permits, Johnson is going to contact Bill Schwab as to ordinances in this matter. Crever reported that the cost for printing 200 each of on-site sewer applications, on-site sewer permits, building permit applications and building permits would be $140.00. Recess was called at 9;30 PM. Meeting called back to order at 10:05 PM. Motion made by Lease, seconded by Bjorum to authorize Tom Crever to have forms printed for building and on-site sewer applications and permits at a cost of $140.00. Motion carried unanimously. Mrs. Bayless appeared before Council with her Attorney, Fred Kueppers, and a couple whose building permit had been denied by Tom Crever because of failing percolation tests. Mr. Crever stated that the Minnesota Dept. of Health recommends that building permits be denied for a percolation test with 60 minutes per inch. The percolation tests in- volved here had more than 60 minutes per inch. Mr. Kueppers wanted to know what system would be okayed for a building permit. George Rossez, the contractor, said they had a proposal according to state code. It was decided to table this matter until the February 20th meeting and in the meantime, the people involved would get together with Tom Crever to find a possible solution to the problem. The permit for a junk and Auto Dismantling Yard for Norm Horton was brought up and Attorney Johnson said this should be taken care of now through the Clerk's office. Deputy Clerk to notify Horton he is required to pay a fee with his application. The Deputy Clerk reported that the president of Bur-Lar had been on a long vacation, and therefore would be unable to comply with the condition of accepting the mining permit within 30 days, Motion made by LaValle, seconded by Lease to extend Bur-Lar time to accept mining permit from 30 to 60 days. Motion carried. Regarding Clyde Rehbein, Attorney Johnson had prepared two complaint forms to be given to Crever to take care of. Charles Shubat appeared before Council with an application to provide for Village Maintenance of a future road. Deputy Clerk to send copy of the application to Engineer and Bill Schwab. Mayer Carlson read a letter from John Elli concerning a property dJopute between himself and Irene and Jim Leroux, Mr. Elli claims there is a village road where Mr. Leroux claims is his property and where he has been paying taxes. Mr. Leroux said he would like to have the land surveyed but he will not remove the fences by March lot as Mr. Elli requests. Motion made by Lease, seconded by Bjorum to refer problem of Bob Pfaff on 148th Street to Marvin LaValle. Motion carried. Clerk Burkard reported he had brought an electric typewriter from Wagers to the office on a trial basis. He thought their piece of equipment for a price of $254.00 less 10% discount was a very good buy, considering used electric typerwriters run as high as $350.00. Motion made by Leroux, seconded by Lease to purchase typewriter from Wagers. Motion carried. Clerk Burkard also reported that he had checked into three different copy machines. FEBRUARY 5, 1973 21 1. Keelox - wet copy 2. 3M Co. - dry copy-reconditioned at $645.00 with 12 mo* service contract and free delivery. 3. Xerox - dry copy - rental for $40.00 per mo. plus paper charge. Motion made by Lease, seconded by LaValle that Village purchase a reconditioned 3 M Co. 209 copy machine. Motion carried. Mayor Carlson brought up the subject of an MTC Bus for Hugo, and the Council didn't think the idea would go over too well. A drug store for Hugo was also discussed and the Council felt it was not a good idea. Gene Peltier of the Hugo Businessmens Association said Linden Pharmacy of White Bear had shown an interest in this subject at one time, but Peltier didn't feel the community would make much use of a drug store. Regarding road construction plans for 170th Street (relocation of Co. Rd. #4) the subject is on the agenda for the Washington County Planning Commission Meeting. Irene reported that she had been told if the County Commission okays it, the Metro Council will also. Deputy Clerk to schedule George Indykiewicz Mining Permit on the February 20th Council Agenda. Motion made by Lease, seconded by Bjorum to send copy of mining permit to Indykiewicz for his review, and Council to review same at the next meeting. Motion carried. Motion made by LaValle seconded by Lease to grant Off Sale 3.2 Beer License to Lyle Lehner of the Wild Wings Game Farm. Motion carried. Before adjournment, Clerk Burkard reported that the Subdivision Code had been recorded in the Washington County Office. Motion made by Bjorum, seconded by Lease to adjourn at 12:35 AM.
