HomeMy WebLinkAbout1973.04.16 CC Minutes APRIL 169 1973 MINUTES OF PROCEEDINGS OF THE VILLAGE C OUNCIL VILLAGE OF HUGO The meeting was called to order at 7:05 PM by Mayor Carlson. Roll was called: Carlson, LaValle, Leroux, Bjorum, and Lease present. Minutes of the April 2nd meeting were approved after review. Regarding the claims for payment, Leroux would like them identified in the future. General claims and Water Dept. claims were approved after review. Leroux announced that the Hugo Planning Commission is having a Public Hearing on the Comprehensive Plan April 25th, 8:00 PM at the Hugo Elementary School. Mayor Carlson reported he had heard from Al We that the HUD Grant is to be given to Hugo for the sewer project. Pam Bjorum reported that there is an Ordinance Committee meeting set for May 3rd, and they have ready for the Village Code Chapters 409 909 180, & 230. Chapters on fire prevention, utilities, streets and roads and nuisances are to be worked on at the next meeting. Regarding the expenditures for legal fees for recodification of the Village Ordinances, Clerk Burkard questioned whether a motion should be made to authorize money to be spent for this project. The Council and the Attorney didn't think this was necessary. Concerning the SAC Court Case, Attorney Johnson said Mahtomedi had joined with the plaintiffs, but approximately 15 to 30 other communities are going to join the de— fendants. The following action was taken: Motion made and seconded to adopt Resolution # 18, stating that the Village of Hugo elects to participate in the litigation identified as the City of Brooklyn Center, et al., vs Metropolitan Council, et a1., identified as Fourth Judicial District Court File #690532, as a voluntary defendant; and that the Village Attorney is hereby directed to notify Richard J. Schieffer, attorney for the Plaintiffs and Thomas S. Hay, attorney for Defendants, of the intention of the Village of Hugo to participate in the above identified litigation as a voluntary defendant; and that the Village of Hugo elects to adopt the pleadings of the defendants presently on file as their own, and the Village Attorney is directed to notify the above identified attorneys of the Villages desire to adopt said pleadings; and the Village of Hugo does not elect to participate in the control of the litigation and will rely on the above-identified attorney for defendants. Motion carried. George T. Mixon appeared before Council petitioning for a Mobile Home Permit under Paragraph D, Section II of Oneka Ordinance #8. This trailer would be occupied by a laborer hired by Mr. Miron and would be located at the farm at 15250 Homestead Avenue No., Hugo. LaValle said this is quite a common practice, but there is no provision for it in the ordinance. Motion made by Leroux, seconded by Lease to schedule public hearing for application for a Mobile Home Permit by schedule public hearing for applica— tion for a Mobile Home Permit by George T. Mixon on May 7, 19739 8:00 PM at the Hugo Village Hall. Motion carried. Graham Anderson appeared before Council and gave them his letter of resignation from the Planning Commission. There had been in the past, various malicious attacks on his Property, the last of which was a robbery at their home, when he and his wife were 1400 miles away. Richard Vail had been asked to close up the house, and the police department was to check on the property, none of this was done, leaving Mr. Anderson very disgusted. Fred Rierman appeared regarding his request for a Specail Use Permit to put up a building for a metal fabricating business on property owned by Vern Peloquin on Highway #61. The Planning Commission had approved the granting of the permit subject to conditions given in a letter to the Council. Vern had with him a sketch plan of the area and explained his plans to the Council. The Council stated that Vern would have to go through a minor subdivision before a building permit would be given on the property. APRIL 16, 1973 a Regarding the Road. Contract between the Village and McLaughlin, Attorney Johnson suggested having the developer build and maintain the road as a private roadway, with inspection of roadwNr when the area is built up, then accept the road. He and a spokesman for McLaughlin are to work out a solution to the problem. Howard Kuusisto reported that corrections were made in the specs for the tanker, and possibly by next meeting procedure for setting up bids would be ready. LaValle had gotten a bid for fire hall lights and the following action was taken; Motion made by Leroux, seconded by LaValle to purchase light for the fire hall from Collins Electric Company per their letter of February 20th, at a cost not to exceed $195.00. Motion carried. Motion made by Bjorum, seconded by Leroux to renew Mobile Home Permit for Robert McCloud, 9627 122nd. St. No., under Paragrapgh 2D, Section II of Oneka. Ordinance # 8. Motion carried. Regarding the Right of Way Acquisition on Everton Avenue, a map has been made and information gathered and has been given to Charles Johnson for review. The Engineer and Attorney are going to try to acquire property on both sides of the section line, and will talk to people who are concerned. Motion made by Carlson, seconded by LaValle to authorize Village Attorney to prepare legal papers for the acquisition along Everton Avenue from Frenchmen Road to Ken Peltier's property. Motion carried. Howard Kuusisto stated that Don Lease and Marvin LaValle had prepared a map showing where they thought oil or chloride should be put down on township roads. Howard will check how much this would cost. Recess called at 9:15 PM. Meeting called back to order at 9:45 PM. Mark Mattson, a County Highway Engineer had informed Mayor Carlson that detailed plans had been drawn up for the realignment of CSAH #4, the Council should schedule a public hearing on the matter. Motion made by Carlson, seconded by Leroux to schedule a Public Hearing on detailed plans for realignment of DSAH #4 on May 14, 19739 8:00 PM at the Hugo Village Hall. Motion carried. Deputy Clerk to notify Mr. Mattson by phone of this action and follow up with a letter. Regarding the blacktopping of Elmcrest Avenue, Engineer Kuusisto said the figure of $10,000.00 is quite reasonable, but he would like to see their entire plan. He said assessment on property owner for blacktop or curb and gutter is the best(netio�of payment. LaValle stated that White Bear and Forest Lake Townships blacktop roads by petition and assessment. LaValle would like to meet the Attorney, Engineer and Fiscal Agent to decide on a general road policy, and bring it to Council for action. Since the HUD Sewer Grant is approved, Howard Kuusisto had prepared a Sanitary Sewer Schedule containing 15 point to follow, which he explained to the Council. It was decided that an informational meeting should be held to discuss the sewer with certain- groups ertaingroups affected in the community,so the following action was taken: Motion made to schedule a special informational meeting on the subject of the future sewer on May 1, 1973, 7:00 PM at the Hugo Village Hall. Motion seconded. Carried. . Discussion was held on the cutoff of agenda items on the Monday previous to the Council meeting, and close meetings at 11:00 PM. LaValle said he was against this unless mare Council meetings are held. Bjorum agreed. Council to think about this idea. Motion made by Leroux, seconded by Bjorum to authorize Ball Field Improvements at a cost of $400.00. Motion carried. APRIL 169 1973 , LaValle reported that the Fire Jeep needed new tires and the following action was taken: Motion made by Bjoaum, seconded by Lease to purchase flotation tires and rims for the Fire Jeep at a cost of $265.00. Motion carried. Clerk Burkard reported his office had received a letter from the County on George King's relatives wanting to probate his estate. Motion made by Lease and seconded to notify George King's relatives lawyer that Mr, King's property had been condemned. All opposed. Motion failed. Clerk Burkard reported he had received a letter from Richard Birrenback's lawyer, stating that 148th Street is mislocated, and they want Village Officials to investigate. Motion made by LaValle, seconded by Lease to have Clerk's office send Birrenback's lawyer a letter informing him the Village Engineer is working on the problem and it should be solved soon. Motion carried. The Clerk also reported he had received a letter from the Minnesota Pollution Control Agency requesting an inventory be made with Hugo Governmental Boundaries of all sewage retention systems in watercraft, mobile homes, camper units, etc. He was asked by the Council to respond to this letter. Motion made by LaValle, seconded by Bjorum to invest monies received from Revenue Sharing for the time teing. Motion carried. Motion made and seconded to schedule Public Hearing for the Sanitary Sewer Project MY 8, 1973, 7:30 PM at the Hugo Elementary School. Motion carried. (See back page to be made part of official minutes) Richard Vail appeared before Council to request permission to move heavy trucks on posted roads on April 17th. He had already discussed the issue with LaValle and the Engineer and was given permission by the Council, with the request that he notify Jerry Dube before he takes any action. Motion made and seconded to adjourn at 12:00 AM. Motion carried. Robert Ee Burkard, Clerk EXTRACT OF MINUTES OF MEETING OF THE VILI.AGE COUNCIL OF THE VILLAGE OF HUGO, MINNESOTA Pursuant to due call and notice thereof, a Regular meeting of the Village Council of the Village of Hugo, Minnesota, was held at the Village Hall in said Village on ITax►da.,r A.oril 1.6 19 73 , at 7 o'clock "' .M. , with the following members present: Carl s or., LaVall e, Lerolax, B jorum, & Lease and the following members absent: '.None The Council considered the preliminary report of Howard A. Kuusisto of St. Paul , Minnesota, advising as to the feasibility and estimated cost of constructing Sanitary Sewer Improvement No. 1973-1 for the Village. After t consideration of said report, member Carlson introduced the following resolution and moved its adoption: RESOLUTION APPROVING THE PRELIMINARY ENGINEERING REPORT AND CALLING A PUBLIC HEARING ON SANITARY SEWER IMPROVE- MENT NO. 1973-1. BE IT RESOLVED By the Village Council of the Village of Hugo, Minnesota, as follows: (1) The preliminary engineering report heretofore submitted by Howard A. Kuusisto advising this Council as to the feasibility and estimated cost of constructing Sanitary Sewer Improvement No. 1973-1 for the Village is hereby approved and ordered filed. (2) Said improvement shall be hereafter designated as Sanitary Sewer Improvement No. 1973-1. (3) This Council shall meet at the time and place specified in the form of notice hereinafter contained for the purpose of conducting a pub- lic hearing on said improvement; and the Clerk is hereby authorized and directed to cause notice of said meeting to be given by publishing notice of the same in the official newspaper of the Village at least twice, which publications shall be one week apart with the last publication not later than three days prior to said hearing. Said notice shall be in substantially the following form: NOTICE OF PUBLIC HEARING SANITARY SEWER IMPROVEMENT NO. 1973-1 VILLAGE OF HUGO, MINNESOTA NOTICE IS HEREBY GIVEN That the Village Council of the Village of Hugo, Minnesota, will meet at the Hugo Elem.School in said Village on Tuesday_, May 8 1973, at :2:30 o'clock P.M. , to conduct a pre- liminary hearing on the proposed construction of aanitary sewers and appurtenances t: thereto in the streets, alleys, easements, and other locations proposed to be required, in an area within the south 1/2 of Section 17, all of Section 20, the north 1/2 of Section 29 and the east 1/2 of the east 1/2 of Section 19, Township 31N, Range 21W (substantially the old Village of Hugo), at an estimated cost of ti $556,000 (after deducting a federal grant estimated at $#34;000j. 3s7, �°� • The area proposed to be specially assessed for special benefit from said improvement is each lot, piece and parcel of property abutting the streets, alleys and other locations in which sewer mains are proposed to be constructed, all as more fully described on a map on file in the Village offices. The motion for the adoption of the foregoing resolution was duly seconded by member Pam B:iorum and upon a vote being taken, the following members voted in favor thereof:Carlson. LaValle, Leroux, BJorum, & Lease and the following members voted against the same: None whereupon said resolution was declared passed and adopted.
