Roll was called: Crever, LaValle, Martin, Leroux, Lease present. Motion made by Martin, seconded by Lease to approve minutes of meeting of February 4, 1974 as presented. Motion carried. Motion made by Crever, seconded by Leroux to approve minutes of the meeting of February 11 , 1974 as presented. Motion carried. Motion made by Lease, seconded by LaValle to pay the general claims as presented. Motion carried. Clerk Burkard reported he had received an additional claim for Carl Dale of Design Planning Associates for $368.40. Their contract has been fulfilled, and this is for additional work on zoning, etc. Motion made by Lease and seconded to pay Design Planning Associates claim for $428.40 along with the general claims. Motion carried. Next item on the agenda was renewal of mobile home permits. Motion made by LaValle, seconded by Lease to renew mobile home permit for Dave Lindahl under paragraph B. Section II of Oneka Ordinance #8. Motion carried. Motion made by LaValle,seconded by Leroux to renew- mobile home permit of John L. Ward under Paragraph B. Section II of Oneka Ordinance #8. Motion carried. Motion made by LaValle, seconded by Lease to renew mobile home permit of Gordon W. Russett under Paragraph C. Section II of Oneka Ordinance # 8. Motion carried. It was noted that the Robert LaCasse mobile home permit is to be cancelled. A petition for a mobile home permit for Helen Betts, lots 13, 14, 159 and 16, on the Leo Schoeller property at 4908 120th Street had been received in the clerk's office. Mrs. Betts appeared stating she wants to purchase a mobile home and live on the property near her daughter. LaValle suggested having them know by March 18th what provisions will be made for water and a septic system. Motion made by LaValle, seconded by Lease to schedule a public hear- ing for a mobile home permit for Helen Betts for the Leo Schloeller property at 4908 120th Street, Hugo, Minn. , March 18, 1974 at 9:00 PM. , with the notice to also be published in the White Bear Press. Motion carried. Oak Vista Estates Subdivision was the next item on the agenda. Howard Kuusisto explained certain items to the council with the aid of two preliminary maps. In his estimation, there would have to be an ex- tensive amount of upgrading and graveling the roads in the area. Don Lease stated that in October the planning commission had asked that no more than thirty six (36j lots be put in the plat, and now there are thirty eight (38) . Lease also felt they had changed their plans so much, they should refile their application. He stated there are no proper outlets to adjacent properties, and if taxpayers have to pay for upgrading roads around the subdivision, it would cause a hardship to the taxpayers, and should be denied for this reason. It was also stated that a cul-de-sac can be no longer than 600 feet, according to the ordinance. FEBRUARY 19, 1974 3 5 Motion made by Lease, and seconded to deny the preliminary plans of Oak Vista Estates Subdivision for the following reasons: 1 . There is a completely different layout than at the public hearing 2. The city engineer does not have all the drainage easements & drainage plans. 3. The cul-de-sac shoud be only 600 feet according to ordinance. Motion carried. Bruce Folz appeared on behalf of Oak Vista Estates. Vern Peloquin appeared and stated the person who was hired to do his surveying is hospitalized, and the matter will be delayed a while longer. Motion made by LaValle, seconded by Leroux to table the Minor Sub- division of Vern Peloquin until the meeting of March 4, 1974. Motion carried. Mr. Richard Bury of the Bur-Lar Mining Co. appeared regarding his mining permit renewal. It was noted that his inspection fee had been $300.00 and $264.20 and been used in attorney and engineering fees, leaving a credit balance of $35.80. The planning commission had recom- mended that the permit be renewed with the same conditions as 1973, including the :$300.00 inspection fee, which is returnable if unused. Motion made by Martin, seconded by Leroux to ren-ewBur_-Lar Mining Permit with the same conditions as 1973. Motion carried. Tom LaValle's Mining Permit then came up for review. Motion made by Lease, seconded by Leroux to renew Tom I,aValle's Mining Permit for 1974 with the same provisions as 1973, with the added condition that the 1000 foot and 500 foot areas be kept free of water during the spring and that the 1000 foot area be filled to specified grade no later than July 1 , 1974. At that point Marvin LaValle questioned the high inspection fees, as not oneha,lf had been used last year. Motion made by Lease, seconded by Leroux to amend previous motion to read renew Tom LaValle's Mining Permit for 1974 with the same pro- visions as 1973, except the inspection fee be $310.00 rather than $500.00, with the added condition that the 1000 foot and 500 foot areas be kept free of water during the spring and that the 1000 foot area be filled to specified grade no later than July 1 , 1974. Crever, Leroux, Lease, Martin for LaValle abstained. Motion carried. Recess called at 8:35 P14. Called back to order at 8:45 PM. Building Inspector Tom Crever appeared to report on the status of Bob Ricci' s saloon with regard to the property line, and the new sign he has put up. He stated the sign had been put up without a permit, and the structure's front entrance was approximately 20 feet from the property line. Mr. Ricci's original plans did not show the front entrance as it now exists. Motion made by Lease and seconded to have attorney Johnson review the situation and give council a recommendation at the next meeting. Motion carried. The building inspector will also inform the owners of the Pioneer Club they should set their building plans before the planning com- mission. Crever also reported that Don Tauer had made a rental apartment in his basement, and he felt there was a violation of Oneka Ordinance # 1 and possibly a violation of the City Ordinance # 108. FEBRUARY 19, 1974 2 7 Motion made by Lease, seconded by LaValle to cite Mr. Don Tauer for v violation of Oneka Ordinance # 1 and City Ordinance # 108. LaValle, Leroux, Martin, Lease for, Crever abstained. Motion carried. Lee Martin stated he had contacted the attorney on a moritorium on subdivisions until the comprehensive plan is completed. Johnson said if a moritiorium ordinance were drawn up, a time limit would have to be set on it, and any zoning changes would require a new public hear- ing. Motion made by Lease, seconded by Martin to table moritorium subject until the March 4th meeting. Motion carried. Lee Muellner appeared with a petition to have "No Parking" signs put up on the residential side of Francesca, from the north end of the street to the north end of the school. Motion made by Lease, and seconded to accept petition and post the west side of Francesca for no parking on a year round basis from the north end of the school to the north end of the street. Motion carried. Clerk Burkard reported on the following: Free maintenance on the copy machine is now ended. We can now have a maintenance contract for 9140.00 for the year, which included all parts and labor. Motion made by Leroux, seconded by LaValle to accept maintenance agreement with Minnesota Mining Company. Crever, LaValle, Leroux, Lease for, Martin abstained. Motion carried. A letter had been received from Ehlers, regarding an application for Moody's Municipal Bond Rating, and they would like it acted upon as soon as possible. Motion made by Leroux, seconded by Crever to accept and sign Moody Agreement for Municipal Bond Rating. Motion carried. I A letter had been received from the Minnesota Highway Department con- cerning Hardwood Creek Estates, and a copy would be forwarded to Mr. Muggs. A letter had com afrom the Minnesota Pollution Control Agency giving approved permit for sewer construction. Howard stated this was a matter of procedure. Mr. Burkard stated the Clerk' s and Finance Officer's Conference was coming up March 6, 7, & 8, at a cost of $40.00 each person. Motion made by Lease, seconded by LaValle to approve registration and mileage to send clerk and deputy clerk to the Clerk' s Conference March 6, 79 & 8. Motion carried. Mr. Burkard reported that Minnesota Statue 15 A-20 increases mileage for official business from 9¢ to 15¢ per mile. Motion made by Crever, seconded by Leroux to change city mileage rate to 15¢ per mile. Crever, Leroux for Martin, LaValle, Lease opposed. Motion failed. The engineer reported the road in the Industrial Park is in bad shape, but the contractor will take care of this. Howard also stated Mrs. Arcand might be requesting a bond instead of the 1$8000.00 check on deposit with the clerk. RY 19, 1974 IJ 9 LaValle brought up the subject of Don Tauer again. He felt Mr. Tauer should be notified by letter, rather than being cited for violation right away. Motion made by Lease, and seconded to recind the motion made earlier in the minutes to cite Don Tauer for violation of Oneka Ordinance E 1 and possibly the City Ordinance ;#108. LaValle, Lease, Martin, Leroux for, Crever opposed. Motion carried. Motion made by LaValle, seconded by Martin to have the city attorney write a letter to Don Tauer, informing him he is in violation of Oneka Ordinance # 1 and possibly City Ordinance !# 108, and he is re- quested to appear before the city council of March 4, 1974 at 8:00 PM. Motion carried. Mayor Crever mentioned that he had been asked once again to bring up the slabject of curtailing the 10:00 PPI curfew. The council was against doing this.
