Roll was called: Lease, Martin, Leroux present. I•aValle absent. The minutes of Tay 20th were reviewed and approved as presented. The min— utes of Day 29th were corrected in that page 2 paragraph 2 states Yr. Chapman was on the Oneka Township Planning Commission. Minutes approved after correction. The general Claims for payment were then reviewed. Regarding payment to the sewer contractor, the attorney and engineer said payment could be authorized, but the check held until a letter of concurrence fro;..IHUD is received. Hotion made by Partin, seconded by Leroux that general claims be paid, with the check for Hoffman Brothers being held until a letter of concur— rence from HUD is received. iTotion carried. Notion made by nartir_, seconded by Leroux that water department claims be paid. Notion carried. The appointment of: a council member and planning commission member was the next item on the agenda. Motion made by Tartin, seconded by Leroux, to adopt Resolution 1974-14, A Resolution For Appointing A Nember Of The City Cou rail .For the City Of Hugo, Finnesota, To Fill A Vacancy, James W. Smith being the appointee. nartin, Lease, Leroux, for. ,potion carried. Clerk Durkard then swore in. Yr. Smith and he took his council seat. Notion made by Leroux, seconded by 7artin to appoint IIoward Schletty to the planning commission to fill the unexpired term of David Norden. Notion carried. June Smith appeared regarding an amended Special Use Permit for her child care center. She had formally made an application and paid the 325.00 fee. She had also appeared before the planning commission, and they felt a few conditions should be added to her permit. . ;; edition 12 of therepermit is to read" The present sewer disposal_ drainfield system be expanded by Sep— tember 1 . 1975 by adding an additional 1 ,000 gallon septic tank in se ve:+., with the existing tank and two additional drainfield lines be added, each one being; 75 feet in length placed in trenches 24 inches wide. Yotion made by Tartin and seconded to approve application for an amended Special Use Permit for Jane Smith. Votion carried. The council was nest given copies of the attorney and engineer' s contracts for sewer wort; for review. Nayor Lease read aloud rr. Johnson's Represen— tative Proposal. It was stated it will be 11% of the bid figure. None of the time Mr. Johnson has spent on the sewer project has appeared on his monthly statements. Notion made by Martin, seconded by Leroux to accept letter dated Kay 20, 1974 from attorney Charles A. Johnson for Representation Proposal Sanitary Sewer Project 1973-1 . HUD—'.ASF-1`7-05-0148. Motion carried.. Engineer Howard Tuuyisto' s contract was discussed next. This had already been approved and signed in December, but copies could not be found. Potion made by Lease, seconded by Martin to approve Engineering; Contract of Howard A. I Ausisto for Sewer Project 1973-1 . Totion carried. .,AA JUNIL 3t 19-74 117 The fiscal agent 's contract i,✓as also to be approved. It eras stated that most of the Mork listed in the contract had already been done, this would be a. formality of signing a contract. Lotion made by Ilartin, seconded by Leroux to approve contract of Ehlers and Associates, Inc. for ';9275.00 for General Obligation Sanitary Sewer Improvement Bonds and General Obli— gation Pile Equipment Bonds. Lotion carried. Regarding modification or amendment to Resolution3, establishin" rules for the organization_ and procedures of the village council of Hugo, 1-Tinnesota, this was given to the ordinance committee for their review. Regarding special meeting notices, attorney Johnson said a new case came up, Sullivan versus Credit River Township. Publication in newspaper in this case was not necessary. A notice should be posted in a regular posting place a reasonable time ahead of the meeting. If the future special meeting is set at a regular meeting, this is looked upon as giving notice also. Nr. Johnson said posting 48 hours ahead should riot ae problem. Kr. Johnson also 1-1,­d completed part of the City Code—Chapter 20, r:dminis— tration, and gave copies to the council for their review. He said all committees should disignate specific days for their meetings and this should be published once for the general public' s information. This chapter was then given to Lee Plartin for the ordinance committee review. T=r. Johnson had prepared the Sewer Ordinance for adoption. He said specific sewage rates will be established by resolution. A few changes 'i, d been made in this ordinance, some added by the ordinance committee, and some by the attorney. At that point 1.r. Steve Chapman from the audience, asked if there should not have been a public hearing on this ordinance before passage. I;r.Johnson said this type of ordinance does not require a public hearing, according to statute. The engineer had also prepared a written report, copies of which were given to the council for review, as Howard elaborated on a few things. He said everything had been subr.,itted to HUD, and he was a.•raitin", their letter of concurrence. He said the Bald Nagle Industrial Par': Sej.rer Project is about 98;'O complete, and work is progressing satisfactorily on the City Sewer Project. 1-Ioward then rientioned that dust control could be taken care of during the later part of June. i,"otion made by 1-artin, seconded by Smith to authorize dust control by Larry Johnson at a bid of 250 per gallon for 1974, and that the total cost should not, exceed :;;3000.00. Notion carried. Acting Police Chief then gave his written report to council. He also sub— mitted a. bid on a 1974 Plymouth Fury I he had received from Barnette Chrys— ler Plymouth. Payor Lease thought the bids should be taken on a 1975 police car. The council suggested that Barth aorlc out the specs, so the City could then call for bids. JL'YE' 3, 1 741111- (1 T• . Barth had noticed this offense lately. lire Chief Granger appeared and said a Civil Defense Director should be appointed for a disaster type situation, now that the tornado season is upon us. He said the church, school, and bank are available shelters, but if something happens late at right, no one has the 1,1eys for these places. IV otion -made by T'artin_ and seconded that the cleric draft a letter to the ',.bite Bear School District 624 and to St. Jc :::�.' y' r--questing emergency access during disaster for shelter, and that such access shall be made under supervision of the police department. I•lotion carried. Granger said the neer fire trucks are ready for any emergency now. T7otion made by Lease, seconded by 1-artin to authorize two firemen -to attend the Firemens Convention Jure 6-10- in Hibbing, T,inneoota, and that the cit;; pay _;20.00 registration_ fees, ; 20.00 per diem. and mileage. I•"otion carried. Cler"L Burkard reported on the following: The city needs `020,327.96 rci_^ Bond I•_oney for payment of bills. I•Totion made by I1artin, seconded by he-rou._ that the clerk be authorized to negotiate government certificates in the ar:ount of ,32_0,827.96. T''otion carry gid. The Hugo Slow Pitch Team had requested a pole with a meter_ for surnrler electrical service use. The clerl: contacted NSP, and if the city supplies and installs a pole, ITS?' will than=e "2.00 per nonth for the service. It was stated that the Fugo Team will supply and install the pole. T"otion made by Tlartin and seconded to authorize the installation_ of electrical service for a pole in the cit;; park. TTotion carried. Al letter had been received from the ".lashington County 'Hi ghv. ►ay Department regarding a preconstruction conference June 6, 1074, and they would like someone from TTugo representated at this conference. IToward said he could probably attend, and Fr. LaValle mould be contacted also. The clerk's office had received approXimately ten bulletins on acts of the legislature. Levy limitations vras one of them. The clerk's office had received from the Tetro Council, an open space and park plan. Clerk Burkard felt Hu.-o needs a citizens committee on open space. I"ayor Lease thought inenbers of the IL•:L7 group might be interested in this type of thing. :;e have received more information and maps on the flood Insurance Program from HUD. This will be referred to the engineer, plannin;; co-rmlission and ordinance cor_unittee. Irene Leroux reported that the next planning meeting c•rill be June 11th. Mayor Tease reported for the utilities committee that they will write a report -to the council regarding sewer assessment shortly. JUIN., 3, 197`- 121 :Gee I"artin reported that the ordinance committee worked on parts of the uroposed zoning ordinance already, and they will meet again June 4th, and will probably be able to have a recoru-,iendation soon to the council. It was stated -that the ordinance comizittee has set the 1st and Mrd Tuesday of each month as their meeting nights. I;ayo-r Lease said he had received a letter from Bill Schwab, and he would like nominations for the Washington County Park Advisory Committee. T:ayor Lease also mentioned the council has to solve the problem of the police chief job. He said he doesn't feel Barth has the experience for that particular position right now. He felt the council should take a close lool•,- and r..iaybe come up with another title, such as Senior Patrol Officer for example. He said Hugo is not ready for a big city type police chief operation and he would like the council to review the matter. Leroux suggested iceeping Barth as acting chief, and giving him a raise in pa-r for the time being. The old sewer bill of approximately :;18,000.00 was brought up for discussion. A contract had been received from the I,?etro Sewer Board covering payment over a period of 15 years. Mayor Lease said this should be reviewed and action taken shortly. Attorney Johnson said it might be worthwhile to de— termine what types of contract other cor.viunitics are negotiating. Clerk Burkard was asked to contact Forest Lake and Forest Lake Tovmship regarding their contracts. Lee I`F..r-cj.: h`CL cone investigating regarding; the Shade Tree Desease problem, and according to the Minnesota Legislature, Hugo must hire a qualified tree inspector for the control of Shade Tree Desease. If a municipality does not appoint an inspector within 75 days after A"arch 1 , 1974.9 the Department of Agriculture can appoint one for the community until such time as they do themselves. There will be a couple day schools the end of June and first Dart of July at the University of Plinnesota for people to become certified in tree inspection.
