The depart- ment has a budget of :;3000.00 to pay ;dart-timemen, and they are not actu- ally receiving pay for the actual hours they wor'c. Their hours are cut in half, and then_ shaved, in order to fit into the budget. At this point T,ayor Tease questioned why anyone woul:Lwork for little pay. Barth said each man had his o,m reasons, some for e_-perience, some for prestige, etc. Barth mentioned that. these Tien br-7r. their own unifornTs, ..1.; o. IIc said they meet each ':ednesday night and go over various lags. T,cy check every business in town every hour throughout the night. Sargent- Don T,elle spoke, saying he does the scheduling. There is also quite a bit of paper work involved. Barth mentioned he would like to have a council person act as a laison between the residents and the council when problems or questions arise. He also said most of the part time men are working all the hours they can, but TIr. fell e could work thirty or thirty five hours per week with more pay, and b<, on more or less a full time schedule. 'Je said he definitely would like another full time Mian in the future. Lease thanked Barth and his men for corning to the sleeting and explaining their postion. Dr. Chapman from the audience told 3arth he was invited to come and speak at the next HELP meeting J,.-lT 17th. He also mentioned they were sympathetic to the problems of the Police Department. r"aycr Lease in closing, asked Barth to put in writing, his recommednation for more men, for the rest of 1;'74 and 1975. 11r. Jim Gannon, a representative , of the :;shite Bear Rod and Gun Club, came in with the club's plans for their trap fields, as requested in one of the conditions of the special use permit. It was noted that Jerry Perron was unable to come in himself. Arr. Gannon left two copies of the plans with the City Cleric for the Council's review. The Fischer Tiining Permit Renewal was discussed next, even though Mr. Fischer had not arrived as yet. Howard stated T.:tr. Fischer had complied with what Howard asked of him, and every thing was in order. Lotion made by LaValle, seconded by Leroux to grant a Renewal Iiining Permit to Fischer Construction of Rosemount and that the permit inspection fee be :?0650.00, the Letter of Credit for :1;3000.00 be extended imediately to cover the time of the permit, and the Performance Bond stay at �2�25000.00. Motion carried. The Grundhofter and 1-TcCullough Special Use Permit was the next item on the agenda. They appeared with a site plan which they explained to the council. Attorney Johnson also explained certian things to the council, as he was at the planning meeting when they recommended gra. �.�;-;:--the permit. A fever of the conditions set by the Planning Commission .sere changed by the council and "•'ayor Lease felt parking facilities should be provided. I7-otion made by Lease, seconded by LaValle that a Special Use Permit for T''cCullough and Sons be approved ,with the following eleven conditions: 1 . Building to be set back a minirl,.,-m of 80 feet from the Highway 61 right of way. 2. Shall be occupied by no more than 10 people. 3. Shall be dedicated for the purpose of contacting and masonry con— tracting. :1xterior storage of heavy machinery and building equip..ient will be expressly prohibited. 4. Said building shall. be a cement and brick construction in accordance to the Plan A submitted by the applicant. 5. Building shall be constructed to face northerly and shall access Highway 61 by mea-1s of a private cxri.mac. :. T in accordance with Site Plan B submitted by the applicant. 6. Special Use Permit shall be contigent upon the applicant obtaining access to Highway 61 . 7. The owner or applicant will supply at minimum a septic system to consist of a 1 ,000 gallon septic tank and three lines 75 feet each for drainfield. 8. Applicant shall furnish proof of ownership to City Council prior -to issuance. July ° . Surface water drainage plan shall be filed for approval with the City Engineer prior to issuance of the Building permit. 11 . Parking area to be constructed to accommodate 15 vehicles, and to be surfaced with crushed rock. Lease, LaValle, Leroux, for, Smith opposed. Motion carried. The Farvin Rehbein P1ining Permits and specific Special Use Permits involved were explained by the engineer and attorney. The Planning Commission had recommended approval of the permits with various stringent conditions. I-.:otion made by LaValle, seconded by Leroux to grant a Special Use Permit to Joe Gregoire for a Borrow Area for sand subject to the following con- ditions, and the condition of the nice Creek 'Jatershed Board (attached to Permit) : 1 . 7hi_3 Special Use Permit is issued for the removal of gravel in accor- dance with the plans submitted and any deviation from these plans shall require an amendment to this special use permit. 2. All existing trees and natural vegetation bordering the pit area shall be left undisturbed. 3. All top soil in the pit area shall be stockpiled, and at the time the operation is completed, the top soil shall be replaced and seeded to grass cover. 4. If. se,!er facilities are to be provided, they s=!=,•.11 be of the portable, cher;ieL.l holding tants type. 5. 1 bond in the amount of :''3000.00 shall be posted for the Borrow Pit Site, and shall be a, performance bond in the form approved by the City Attorney and written to insure coi :p?fiance with the provisions of this special use permit. 6. The conditons of the special permit issued by the Rice Creek 'Mater shed District for the site shall be made a part of this special use permit. 7. Inspeci.ion of the site shall be by the City 'Engineer and the bonds shall be released only after he has=e='ti_f'ied that the provisions of the Special Use Permit have been complied with. 8. Any violation of the conditions of this special use permit shall be grounds for termination of the permit and final grading, sloping, and seeding shall then be at the direction of the City Engineer. 9. The special use permit shall expire on September 30, 1975 and all conditions of it shall have been complied with by that date or it may be extended due to conditions beyond the contractores control to in- clude labor relations or acts of God. 10. Dust shall be controlled on the haul roads by the contractor in accor- dance to the recommendations of the City Engineer. Lease, LaValle, Leroux, Smith for. This special use permit shall expire on September 30, 1975, and all conditions of it shall have been complied with by that date or it may be extended due to canditions beyond the contractors control to include labor relations or acts of God. 10. As a part of this special use pe-rrait, the applicant is authorized to operate a hot—mix asphalt plant. This plant shall be operated in com— pliance with the Minnesota Pollution Control agency's Operating Permit Number 1022-73-0-1 . 11 . The bitu:_.inous hot—mil: plant shall be placed in such a location that it has the least visual impact from the surrounding properties. Lease, LaValle, Leroux, Smith for. ',�'otion carried. Lotion made by LaValle and seconded to grant a Mining Permit to I,iarvin Rehbein Contracting Company to remove sand from the LaCasse, Gregoire, and Riopel properties subject to the following conditions, except numbers 4, 5, 11 , and 12 of the Planning Commission recor.mendation. All applicable provisions of the City of Hugo ordinances governing mining shall be complied with. 2. . is permit is issued for the purpose of removing borrow material or ;;ravel for use on the j-ob under contract with Washington County for wort: on County Road 4 and County Road 56. 3. 3•10 top soil or overburden shall be removed from the site. 4. The inspection fee shall be based on the amount of the material removed from the site. The charge shall be fixed at a rate of on,� cent per cubic yard_ of material renoved. The amount of the fee shall be computed based on estimates submitted by the applicant and con— firmed by the i!ashington County Engineer. :"'2000.00 shall be paid immediately to the City of Hugo for prepayment for inspection fees and shall be finally settled at completion of the highway construc— tion project. JULY 1 , 1974 J 7 5. The contractor shall provide a :;;,40,000.00 bond and a 'A0,000.00 irrevocable letter of credit for the maintenance and or reconstruction of the haul_ roads. 6. Recommendations of the 7:1ashington County Engineer, dated May 30, 1974 and those of the City of Hugo Engineer, dated June 11 , 1974 shall be made a part of this permit. 7. Inspection to insure compliance with this permit will be done by the City of Hugo Engineer. He may request the assistance of the 4ashinb ton County Engineer in providing such inspection. This permit shall expire on September 30, 1975 . 8. Any violations of the terms or conditions of this permit shall be grounds for immediate termination in accordance with the City Ordinance. 9. Any additional limitations or specifications for the haul routes which shall be deemed necessary for health and safety reasons by the City :,ngineer and City Attorney. 10. The hours of mining operations at the Gregoire and Riopel operations shall be extended to 5:00 AE to 11 :00 P:`. T"otion rade by Lease, seconded by Smith to grant a Mining Perrait to Marvin Rehbein Contracting Company for mining on the Durraine property subject to the following sixteen conditions : 1 . All applicable provisions of the City of Hugo ordinances governing :pining shall be complied with. 2. This pernit is issued for the purpose of removing borrow riaterial or gravel for use on the job under cont-ract with �lashington County for work on County Road 4 and County 'load 56. 3. I?o top soil or overburden shall be removed from the site. 4. Haul roads shall be those designated in the application which have been approved by the City Engineer and the Iashington County Engineer. 5. Dust control on all city streets shall be by -the use of oil, (crankcase oil) as directed by the City Engineer. Dust control on all roads under the jurisdiction of Washington County shall be by calcium chloride as directed by the '.lashington County Engineer. 6. The inspection fee shall be based on the amount of the material re- moved from the site. The charge shall be fixed at a rate of one cent per cubic yard of material removed. The amount of the fee shall be coriputed based on estimates submitted by the applicant and confirmed by the 'tashington County Engineer. ;,2,000.00 shall be paid immediately to the City of Hugo for prepayment for inspection fees and shall be finally settled at completion of the highway construction project. 7. The contractor shall provide a ',40,000.00 bond and a ';10,000.00 irrevocable letter of credit for the maintenance and or reconstruc- tion of the haul reads. 8. Haul routes shall be periodically inspected by the City Engineer and maintained by the contractor in accordance witil his recommerndations. 12. A speed limit of a _maximum of 45 miles per hour be maintained by contractor gravel trucks when operating on the haul roads on City streets. 15. The Engineer's report was next, and I1 .1ard said he had looked over some road problems with LaValle, especially in the Oak Shore Park area. He also mentioned the Horseshoe Lake problem is':cin;_; studied by .Rice Creek Watershed Engineer. Howard suggested oiling the roads after getting them back in shape after serer pipe is put in. There have numerous complaints about the dust. :attorney Johnson stated he had ready four copies 6f the Sewer Contract for HUD, the sewer contractor and the engineer. He also gave his written report to the council for their review. The building inspect.ur: also gave his report to the council.
