Don Tauer appeared ,A th his attorney, Kenneth Rohleder, regarding his obtainings a Special Use Permit for multiple residence. This request had been denied by the planning commission because it does not -co'. with the Conp-rehensive Plan. County Planner Bill Schwab :iientioned in a letter to the planning comsnisssion that the request doesn't comply with existing land use. IIr. Rohleder stated Fr. Tauer had complied ti••;ith all requests, and submitted all data -required. He said the planning comiilis— sion based their denial on what- is not the lags. IIe believes the commis— sion acted sone,�hat arbitrarily. Mayor Lease brought out the fact that he had obtained fror.:: the County, p apers conta.inir_g private covenants on the property, one of which being that -the property shall be used for single family residence only. Potion -made by Lero=, seconded by Smith to deny the Special Use '_'-Permit for Don Tauer for I7ultiple D.wclling for the following reasons: 1 . ThP. request does not conply with -the Comprehensive Plan 2. There are private covenants on t1FLc property. T"ore discussion was held, and I"r. Rohleder :Celt the covenants might not be in effect now. Fe also said the Comprehensive .-Man is not law and is not applicable. They felt the request mould be granted, based upon the council discussion the first tir<ie they appeared. The council then voted on the i::otion. Leroux, Partin, Smith for, Lease and La-Talle opposed. Potion carried. Ed :;attgh appeared next -regarding approval of a Subdivision for property located at 140th Street I•;o. and Flay Avenue No. The planning copullission recommended approval subject to certain conditions. The p1r.;. contains eight building sites and one outlot. LaValle felt a �.Ta-riance should have been filed at the time of filing the Subdivision application, as the corner lots arc less than required size. T'r. Johnson stated the Ordinance requires that the building site be one foot above street grade. TIe also said tl�e council could treat corner lots as varainces in the acceptance of -the plat. r."ore discussion was 1:c16. on the fact that private covenants oiere to be made, with the new owners having to fill the buildi.ig sites to conply with the ordinance. Called back to order at 9:45 Pl'T. Jerry Perron, representative of the '.Thite Bear Rod and Gun. Club, appear- ed with new plans dra,.rn up according to Concition 18, 25, and 26 of their Special Use Permit, and also incorporating other conditions of the per- nit. He e_:plai_Zcd the plan with the aid of a colored reap on the wall. They had eliminated e--.cess driveways, and have only one now. Mr. Perron mentioned that the trap, usually used, are located in t?)e center of the entire facility. Smith felt the club was not co_ nl-cin.- ,lith condition 26, and Perron said they would lil-e the tivording clarified in 18t 25, and 26, and submitted a letter to the council so stating. Snaith felt this ,•could require a variance. Johnson said the council would have to decide if this plan complies aith what the council had intended. Lee Fartin said the plan dere presented complies frith what he had intended. Irene Leroux agreed, and said ,re should cyan�;e words if incorrectly used. T'arvin LaValle also said the facility as shoim on the plan is designed as lie understood and intended them.. Theodora Peltier then questioned T':r. Perron as to whether_ he had riet with council members before the meeting. He had i_.et with I'artin, Lease, and LaValle, and tried to contact the other two. ha.Valle said he felt there was nothing wrong in this, as quite a number of people contact him or other council members about; their porbler,is at times other than council r!leetinZs. l-t that point 1,ayor Lease said I1r. Robert '.Taller had contacted hir2 with a letter, and I.-ease told hin to file it with the clerk. The letter mentioned any changes in the plans should require variance. 1r. Chapman stated that he had asked that the plans be submitted to his attorney, Tir. Crawford, but they were not, and there rias a c ,''i11.';ein the plans and they should be denied. LaValle main reiterrated that the "acility is planned the way he intended it. At chat point, Howard J. Vogel, legal council for ITELP spolce and said he felt he had grounds for denial of the above motion. i.easons being; 1 . Plans have been reviesed. 2. .in environmental assessment is to be made on this project, and this is to be taken up at the 11ugust meeting of the Environviiental Quality Council. lir. Perron then said he had spo'_.en with a member of the LQC, and they in no way want to stop a project such as this. The council then voted on the motion.
