agenda items of August 5th, and to also discuss any other important items.
The first time for discussion was the Sewer _Lssessment toll. Clerk
Burkard -. a.s obtained fro„i `tlie County, a list of all the people to be

some other firm would have to be hired for the wort.-. Attorney Johnson
mentioned that prior to an cIssessment Hearing, notice aould have to be

the hearing, and the total cost of the project must be published in the
paper also.
Clerk Bur':.ard has prepared a report on revenue Sharinr, i.,ihich the Council
then discussed. 1La;;;or Lease mentioned he would li'_:e to purchase a new
squad car out of this money. The Council. felt 1r. Burkard should prepare
a more thorough brealc.doti•rn of ',evenue Sharing, including sheets :i.ssin
from his present report. He is to do this for the __leeting August 191tli.

Attorney Johnson reported that all sewer easements were recorded in the
County and are back. They were given to the cl cr'�' s office for the City
files.
?egarding the LaValle—Bayless Lawsuit, answers have been filed, and the
matter should cone up for trial some time in the Nall.
I'r. Joh_ son is to also check on the election law Ordinance before Monday's
neetino.
The Building Inspector's report was ne--t. 1:-ayor I-ease -read aloud a letter
from him regarding the remodling of the Joseph Card residence, which is to
be made a part of the minutes. The Duilding Inspector does not approve of
giving Is. Card a pe-r.:iit to remodel, because this would change a summer
home into a year round residence, and the lot is substandard, the size of
the septic tank is un',nox-m. and the e=:isting sewer systerl does not meet
Finnesota State requirements. The code now requires frost footings, and
Pr. Card's home is on a slab. Tile Council supported Er. Crever' s opinion.
A letter had been -received from the 1*Tetro Sewer Board regarding; their
erecting fences around the lift station facilities in Hugo. They requested
approval from the Council on tiie matter.

neighbor of Don Tauerts, offering objections to 1;r. Tauer's having tests

Engineer Howarc, ''uusisto had sent his written report to the Council along;
with a Street and Storni Sewer Irlprovenlent ?deport. He said the Council should
revievr i t and then set a date _Cor apublic hearing to ge'ddirection of the
people on the project. A street program eroul_d not be started this year,
except for any underground structures, and the sto-r.,,l sei+ref system would be
the _first to be installed.

Regarding the sewer project in the City, there is a gas main along Highway
61 which is in the :,ray. Howard and LaValle feet i.rit'r? I"SP, and their attitude
,ra.; -that they don't like to raove these things for nothing, but they will

Regarding the TTorseshoe Lake .tater Problem, ITocr<ord had heard nothing from
Rice Creel.- on the matter. Their engineers are reviewing the problem.

Lee Martin mentioned there is a shortage of people on the Ordinance Committee.

The Council_ then discussed the matter of the Sewer Issessment Roll. It was
mentioned that assessments should be at the County by October, but Howard
said theme is such a thing as an extension. Tie also said he thought Ehlers
cou 1 do the assessment roll_ by computer.

To Hugo City Council:
I have reviewed the Joseph Card property regarding his application
for a permit to expand his present summer residence into a year-round
home. Mr. Cards' plans are to add a bathroom, remodel the porch and add
a second story to the existing structure.
• I have attached a detailed sketch of the property showing the lot
lines and locating the present building, sewer system, well and off
street parking area.
In reviewing this property and building permit application, i have
kept in mind the fact that the applicant is in fact attempting to change
theuse of the property from a seasonal to an all year residence.
The lot size,I feel, ,is. inadequate,. The actual size,is ,6650 total '
square ft. area. Approximately 850 _.5q.:' ft. is' steeps slope down-td the
lake reducing the actual usable lot area to about 5800 sq. ft. Using'
the present sub-division ordinance as a guide, any lot not served by
f both community sewer and water shall be at least 1 acre in size (1f3,560Y
sq. ft,) and not less than 160 ft. in width. Because this land was
pre-platted this code is not applicable but I would like to stress that
the minimum city lot accepted with city_ sanitary sewer and water is
10,000 sq. ft. with an. 80 ft. frontage. This lo, does not come close to
meeting even these minimum requirements and no City facilities are available.
The present on site sewage system design is doubtful for lack of
factual data. The size of the septic tank is unknown as is the amount of .
absorbtibn area. The existing sewer system does not meet Minn. 'Dept. of
Health standards or can it be remodeled to meet ,them. The existing well
• . is approximately 25 ft. from the assumed location of the absorbtion area
whereas a minimum of 75 ft. is required.. Also the wells on the adjoining
property are well within the 75 foot minimum required distance. Knowing
. the' general soil conditions, it is doubtful that ' a percolation rate of
faster than 20-30 min. per inch would be achieved. Using a rate of 20
mi. i/inch the minimum absorbtion area for a two bedroom home would be 400 sq-.
.ora total of 200 lineal ft. of drainfield trench. By changing the use
of the property from seasonal to year round I am assuming that laundry
and bathing facilities would be added to the building. I do not see how
any additional amount of drainfield could_ be installed on a lot that
small and still remain within health standards set.
The foundation design is quite doubtful .as to meeting Minn. State .
Bldg. Code . requirements. The existing one is a floating slab. It . seems
to support ' the present structure, but to increase the .size or 'add the
additional weight. of a second story,extensive foundation work would have
to be done. Code „states' footings shall extend 42” below grade which `

- would involve putting in frost footings and underpinning the present
4•. slab.
The present building is heated by a space heater and the bathroom •
• facilities consist of' a lavatory and water closet, no bathtub or. shower.
To add the .desired second story, new ceiling joists would have to
be installed to carry the additional load. There is also the possibility
that the window and door headers will have to be increased in size to take
the additional loading, _tearing walls .Dr beams also have to be
Provided `to carry the second story.
I have talked to the planning commission members and Mr. Bill
Schwab and they stated that because this is a sub-standard lot ifs would
not be suited to the change Mr. Card is seeking a permit for.
In conclusion, I have not issued a permit to Mr. .;Card as I think ..this
project would involve a major remodeling'and rebuilding .job' for which
present and/or future. facilities would be inadequ:lte. The lot . is far
below todays minimum accepted standards for single family dwellings and
I see no way that it can come close to being acceptable by Minnesota
Public- Health Standards, Rice Creek Watershed Standards .or Pollution Conteoll
Agency Standards. I don't think it would be fair to surrounding pro-
perty owners to jeopordize their health and well being by issuing a build
ina permit for this work. _ _ ._ _ . _
