HomeMy WebLinkAbout1974.10.07 CC Minutes OCTOBER 7, 1974 MINUTES OF PROCEEDINGS OF THE CITY COUNCIL CITY OF HUC, O;., r The meeting was called to order at 7:00 PM by Acting Mayor LaValle, Roll was called: LaValle, Leroux, Martin, Smith present, Lease absent. Minutes of meetings of September 16th, 23rd, and 24th were reviewed. Motion made by Leroux, seconded by Smith to approve minutes of September III 16th. Motion carried. Motion made and seconded to approve minutes of September 23rd. Motion carried. Motion made by LaValle, seconded by Smith to approve minutes of Septem- ber 24th. Motion carried. Regarding the October 1st minutes, Clerk Burkard, stated there should be a motion to recind the motion adopting the levy for the Cit y, as he had a resolution for adopting same. Motion made by LaValle, seconded by Martin to recind motion in October 1st minutes adopting City Levy, and minutes be approved after such correction. Motion carried. Motion made by Leroux, seconded by Martin to approve General Claims. Motion carried. Motion made by Martin, seconded by Smith to pay Water Department Claims. Motion carried. Leon Muellner appeared regarding the petition he had presented to the Council last winter for putting in "No Parking" signs on the West side of Francesca by the hockey rink. He said something was to be done this past summer, but nothing had been done as yet. Motion made by LaValle, seconded by Smith that Clerk purchase necessary signs to solve the park- ing problem on Francesca. Motion carried. A Mr. Land, Mr. Hangi, and Mr. Rialer appeared with their attorney, David Doyscher, regarding their inability to obtain building permits from the building inspector. They felt their perc tests were adequate, but mr. Crever had visited their sites and said they were unbuildable as far as he was concerned. Mr. Doyscher said Rice Creek Watershed had made on-site inspections and had found no problem. As Mr. Crever was not in attendance at the meeting, the Clerk's office was asked to notify him to submit a written report on the three lots before the next meeting, when theses people will again be on the agenda. Howard Kuusisto and Marvin LaValle will also make an on-site inspection of the area. Three bills had been submitted to the Clerk's office by the Hollahan Family for removal of oil on their cars. They apparently live on the haul route for the County Highway Project and their cars had been sprayed with oil which had been put on the road. for dust control. There was some mention of giving the claims to Rehbein, but LaValle said Rehbein already knew of them, and felt it was not their obligation to pay. LaValle said if these claims were paid, there would be more resulting in. thousands of dollars. Motion made by LaValle, seconded by Smith to deny the claims of $107.96 each for removal of oil on the cars. Motion carried. Lee Martin reported to Council he felt they should meet with the Planning Commission and Ordinance Committee soon to discuss changes in the zoning Ordinance. Motion made by Martin, seconded by Leroux that a Special Meet- ing with the Council, Planning Commission, and Ordinance Committee be held on Thursday, October 17th, at 7:00 PM at the City Hall to discuss changes in the Zoning Ordinance. Motion carried. The Clerk' s office is to notify all the members of the various committees. It was stated that proposed assessments for the new sewer had been sent to .,. citizens, and the hearing will be Friday, October 11th at the Hugo School. Clerk Burkard then read aloud a letter from the Metro Sewer Board stating the SAC charge for 1975 will be X32.5.00 and the annual user charge is to be $10,513.06 with monthly installments of $876.09. Acting Police Chief Barth appeared with his written report which also ste ' i he would like vacation time on October 30, 31 , November 1 , 4, and 5. Motion made by LaValle and seconded to approve vacation for the Acting Police Chief on the dates specified in his letter dated October 7, 1974. Motion carried. Mr. Barth also questioned whether he was still acting chief or now a patrolman, as he was made acting chief for three months only. Motion made by Martin, seconded by LaValle to axtend Mr. Barths being acting chief for thirty days. Motion carried. This subject is to be put on the October 21st agenda for discussion. Attorney Johnson next gave his written report to Council as he explained a few items. He said there is a discrepancy in the wording of the Bond for the Hugo A & W Special Use Permit. It is to read "approved" rather then "prepared" by the City Engineer. Clerk's office is to notify owners. The White Bear Rod & Gun Club Letter of Credit was revised by Mr. Johnson and sent to the bank. Regarding the Metro Sewer Repayment Contract, some changes had been made, and Mr. Johnson had prepared a letter regarding reserve capacity, an appeal to reduce the charge, and any change in the law that would indicate what they have done was not legal, Hugo would have an "out". The Tree Inspector had sent back copies of the signed contract and he would like $500.00 paid to 'hin by November 1st. Motion made by Leroux, seconded by Martin to accept and sign the contract with the Tree Inspector. Motion carried. Engineer Howard Kuusisto had sent his written report to Counci in the mai_, and he also explained a few items. It was stated that request for payment of part of the HUD Grant had been sent in. Howard said the contractor on._the County Project will correct any damage done to private property, culverts, etc. Motion made by Martin, seconded by Smith that Howard Kuusisto instruct Hoffman, to adjust the height of the manhole in the Industrial Park at a manium cost of $500.00. Motion carried. Clerk Burkard reported on the following: Motion made by Leroux, seconded by Martin to renew Mobile Home Permit for Joe Zaspel under paragraph d, section II, Oneka Ordinance #8. Motion carried. Motion made by Leroux, seconded by Martin to approve NSP application G0794290 for gas main at 152nd St. No. and Hwy 61 . Motion carried. Motion made by LaValle, seconded by Smith to approve Northwestern Bell application JOB Order 30309 at Hilo and Homestead Drive. Motion carried. Motion made by Smith, seconded by Martin to approve Northwestern Bell Estimate 5258 for buried cable along the South side of Frenchmen Road. Motion carried. Motion made by LaValle, seconded by Leroux to certify $375.00 to the ,. . ) County Auditor for cleanup of George King Estate. Motion carried. IOU Motion made by Leroux and seconded to certify for collection of water bills to the County Auditor. Motion carried. Motion made by Martin, seconded by Smith to adopt Resolution 1974-18, A Resolution Appointing Election Judges For The City of Hugo, Minnesota, for the November 5th election. Motion carried. Motion made by Leroux, sem nded by Martin to adopt Resolution 1974-19, a Resolution Requesting and directing the County Auditor to reduce by $5540.00 the taxes levied for collection in the next ensuing year for payment of the said principal and interest on Waterworks Improvement Bonds of 1961 . Motion carried. Mr. Burkard reported his office received a Revenue Sharing check in the amount of $2872.00. Regarding the $5141 .00 given to the County by the Dept. of Revenue Shar- ing, there was much paper work and correspondence between the clerk's office and Washington D.C. on the matter. They wanted to give the money to Oneka Township after there was no more Oneka Township because of the merging with Hugo. We can apply to the County for reimbursement of these funds. Motion made by LaValle and seconded that Clerk write a letter to the County Auditor requesting *5141.00 in Revenue Sharing money. Motion carried. Motion made by LaValle, seconded by Martin that the Clerk write a letter requesting partial payment of Grant Funds for Sanitary Sewer Improvement Project for the City of Hugo, Motion carried. There had been a letter from NSP Co. stating they were requesting a 12% increase from the Public Service Commission on street lighting, pumping stations, etc., effective January 1 , 1975, and all contracts now held would be void effective December.. 31 , 1974. Clerk Burkard reported that on October 15th there will be a meeting for assessors and a city official should be at the meeting with the local assessor, according to statute. Motion made by LaValle, seconded by Smith that Mayor Lease attend the meeting along with the assessor on October 15, 1974. Motion carried. Voter Registration opens Thursday, October 11 , 1974. The Minnesota Pollution Control Agency would like a reply within ten days as to what the City is doing about the suspected Sunset Lake Pollution problem. Councilman Smith said he had a verbal bid of $505.00 form the St. Paul Technical Vocational School for the old police car. Burkard said Barnett will give $500.00 on a trade in. Motion made by Martin, seconded by Leroux to accept bid for 1975 Police Car from Barnett Chrysler for $4889.23, and the present ,police car to be traded in at a quotation of $500.00 from Barnett. Motion carried. It was noted a cashiers check in the amount of $244.46 was received from Barnett. Motion made by Martin, seconded by Smith to invest Revenue Sharing plus interest of $3208.38 in a CED for 90 days. Motion carried. 190 Jim Mugge appeared with Don Hult for discussion on Hardwood Creek Estates. The engineer for Rice Creek Watershed had called the clerk's office to give their okay on the plat, and a letter had been received from the State Highway Deaprtment giving their approval also. Mr. Hult said they would like to get preliminary approval in order to get the road built and surveying done this year. Motion made by Martin and seconded to approve Preliminary Plat of Hardwood Creek Estates subject to the following conditions: 1 . Engineer's report be submitted to the City Council prior to its action on the application. 2. Written permission from the Northern Natural Gas Company for the construction of 177th Street on the eastern portion of the plat to the developer and be submitted to the City Council prior to its approval. 3. A portion of the property shown on the plan but not platted to the north of Hardwood Creek be designated as Outlot A. That portion of the property shown on the plan but. not platted on the westerly side of the plat line between Hardwood Creek and proposed 177th Street be designated Outlot B. That portion of the property shown on the plan but not platted on. the westerly side of the property line between 177th Street and the southerly property line be designated as Outlot C. All references to reservation for future of commercial development of above Outlot B and C be removed from the plan. 4. That a secenic easement be granted to the City of Hugo over Outlot A described above and working arrived at prior to final plat approval. 5. That parkland dedication in the amount of $1500.00 in addition to the scenic easement, be made to the City of Hugo. 6. That all proposed restrictive covenants be submitted to and reviewed by the City Attorney prior to the consideration of the plan by the City Council. 7. That 177th Street as proposed, shall be constructed by the developer; being a gravel surface road, 7 ton load, as approved by the City Engineer. 8. A bond shall be required from the developer in an amount to insure the construction of the proposed road. Said bond to be in accordance with the recommendation of the City Engineer, and s hall continue in force until deemed acceptable by the City Engineer. 9. That all homes within the plat be constructed at a distance no more than 400 feet from the 177th. St. North. 10. The right of access to each lot shall be dedicated to the City except access to 177th St. No., with the acception of Lot 7, Block 1 , which will have access to the Northern 200 feet South of the Pipeline Easement. 11 . Approval of Rice Creek Watershed be received by the City. 12. Prior to acceptance of final plat, City Engineer will recommend the amount of the performance bond. Motion carried. Mr. Neil Ganoe appeared regarding obtaining a Minor Subdivision from the Harold Caruth property on 165th Street. Motion made by Martin, seconded by Leroux to grant a Minor Subdivision to Neil Ganoe under Subdivision K of the Subdivision Ordiance regarding Hardship in condition of the land, and subject to the four conditions of the planning commission. Motion carried. Mrs. Norm Horton Sr. appeared regarding obtaining a renewed special use permit and junk yard license. LaValle mentioned he was not staisfied with the tree planting, and there was no provision of off street parking. He was at a fire there a week ago, and they had to move equipment for the firemen to get into the yard. He also said they would run the yard in Hugo the way the St. Paul yard is run and there would be no problem. OCTOBER 7, 1974 k Motion made by LaValle, seconded by Martin that Norm Horton Junk Yard License and Specail Use Permit be approved subject to the existing condition. of Attachment A of his present permit, and with the additional condition that a $5000.00 Letter of Credit be depostied with the City of Hugo, and that all conditions be met within 90 days from October 7, 1974. Lee Martin felt in all fairness to Mrs. Horton, an arbitrator should check on the yard. Howard and the Fire Chief are to do the checking. Motion carried. Motion made by Leroux and seconded to extend the meeting past the 11 :00 P.M. deadlire•. Motion carried. Motion made by Leroux, seconded by Smith to deny the Minor Subdivision of Warren Creager because it does not comply with the Comprehensive Plan. Motion Carried. Regarding the Wilbur Schuman Junk Yard License, LaValle was to work with Schuman on this. It was stated Mr. Schuman wants to phase out his opera- tion. Motion made by Martin, seconded by Smith to table the Wilbur Schuman Junk Yard License until the October 21 st meeting. Motion carried. Motion made by Martin, seconded by Smith to adopt Resolution 1974-20, a Resolution Certifying Annual Levy To County Auditor, General Levy, $54,150.50, Outside Limitations of PERA $2644.00, Tree Inspector $2300.00, Metro Sewer (Bond Indebtedness) $2649.00, and Fire Equip. Bonds of 1974 $8200.00. Motion carried. Lee Martin mentioned there was a fallen down barn causing a nuisance on the Gerald Preston residence on 180th Street and neighbors had complained the building inspector and fire chief will be instructed to inspect an'1 report their findings to Council.
