HomeMy WebLinkAbout1974.10.21 CC Minutes OCTOBER 21 , 1974 MINUTES OF PROCEEDINGS OF THE CITY COUNCIL CITY OF HUGO;:; The meeting was called to order at 7:07 PM by Mayor Lease.Roll was called: Lease, Leroux, Martin, Smith present, LaValle absent. Motion made by Leroux, seconded by Smith to approve minutes of the October 7th meeting. Motion carried. Motion made by Lease, seconded by Martin to approve minutes of the October 17th meeting with the correction that RR should be 2 acres and 5 acres. Motion carried. Motion made by Lease, seconded by Martin to approve general claims for payment. Motion carried. Motion made by Martin, seconded by Leroux to recind Resolution 1974-18 be- cause of the replacement of Mrs. Ruth Schletty as an elction judge. Motion carried. Motion made by Lease, seconded by Martin to adopt Resolution 1974-21 , A Resolution Appointing Election Judges For The City Of Hugo, Minnesota. (Eleanor Stricklin is to replace Mrs. Schletty. Motion carried. Mr. Land, Mr. Hangi, and Mr. Ridler again appeared in regard to obtaining building permits for their lots on 170th Street. They were at the meeting of October 7th, but the building inspector was not present. Mayor Lease read aloud a report on the entire situation from the building inspector. Mr. Crever had checked perc tests taken on the land some time ago, and advised Mr. Ridler to contact Bill Schwab of the County to find a solution to the septic problem. Letters had been received in the Clerk's office from Rice Creek Watershed regarding proposed ditch construction on the property, and they found the proposed ditch construction satisfactory with certain conditions. Marvin LaValle and Howard Kuusisto visited the site, and Howard said the ground water table is much lower than it was previously, and the County ditch might have some bearing on the drainage. He felt elevations should be taken. The perc rate seems to be good when the ground is dry. He also sug- gested finding alternate drainfield sites. New perc tests were taken a short time ago and pass, according to the building inspector. The building inspector felt these people should have a soils expert take soil borings, and elevations and decide where to put the drainfields. Lease and Martin felt if the pert tests passed, they couldn't be denied building permits. Mayor Lease suggested these people have Don Hult design systems to work, as he took the latest perc tests, and he requested Howard to take elevations. Tom Crever, the inspector, is to look over all the applications and plans as submitted. The meeting recessed and a Public Hearing opened at 8:00 PM for the applica- tion of Lloyd J. Johnson, 13005 Ingersoll Ave., for a Mobile Home Permit. The Clerk read aloud the notice published in the Forest Lake Times. Mayor Lease explained that Mr. Johnson was applying for the permit under the Hard- ship clause, as his mother-in-law has cancer, and they would like the home for her. The building inspector is to check on what size septic system should be put in for the trailer. Hearing closed at 8:05 PM and the meeting resumed. C :OCTOBER 21 , 1974 Motion made by Lease, seconded by Martin to grant a Mobile Home Permit to Lloyd J. Johnson. 13005 Ingersoll Avenue under Section II, Paragraph D, Oneka Ordinance 0 8, and this is to include a separate septic tank and drainfield. Motion carried. Bruce Folz appeared on behalf of Oak Vista Estates. He said they had re- vised the plan so all lots would have 165 foot frontage, and they dropped one lot to do this. Joseph Rivard, the attorney for Oak Vista, said these people were before the planning commission and council several times and have tried to comply with what the council wanted. He said the width problem has been solved, and the cul-de-sac is only temporary by the very nature of the layout of the plat. Lease said the council feels the cul-de-sac is permanent, because there is no other way out. The council had suggested they plat only part of this at one time, but the same plats keep coming back. Leroux mentioned the cul-de-sac is longer than the Ordinance states it can be. Attorney Johnson said there is no ultimate plan to tie into any other street, so it can't be considered temporary. Folz said they did try to comply with phasing and were denied, and the terrain doesn't permit the road being placed in any different area. This land is hilly and has plenty of timber, and they are trying to preserve the area in this plan. He said the 600 feet mentioned in the Ordinance dates back when there were no wide roads and fire equipment couldn't get in in case of fire, or trees would block the roads in storms. Here there would be a 66 foot road, which should be no problem. Lease, Leroux, and Smith felt they might agree to phasing of the plan, but Martin, felt this would gain nothing, as the last phase would still have the 600 foot cul-de-sac. It was noted that the planning commission had approved the first plan, where the road went out to Grant Township. Police Chief Barth appeared for a discussion on whether he would be named police chief rather than acting chief. Motion made by Lease, seconded by Martin to appoint Robert Barth police chief for the City of Hugo. Motion carried. Motion made by Martin and seconded to table the Wilbur Schuman Junk Yard License until Mr. LaValle has up to date information and progress on the matter. Motion carried. Clerk Burkard mentioned some thought should be given on repealing the old Dance Ordinance. Recess called at 9:07 PM. Back to order at 9:18 PM. Motion made by Lease, seconded by Martin to have Mr. Johnson draw up an or- dinance repealing the Ordinance A-31 and effective date of repeal to be December 31 , 1974. Motion carried. Clerk Burkard mentioned that the HUD Grant required a contract with an auditing firm when the sewer construction is 50 % complete, and the council should think about this. Mayor Lease felt the council should meet on the sewer assessments causing problems some morning and then meet with the people the same afternoon an' explain the situation to them. Motion made by Lease, seconded by Leroux to have a special meeting on October 24th at 10:00 AM and open the meetin4, between 1 :00 PM and 4:00 PM for discussion and objections from the floor. Motion carried. OCTOBER 21 , 1974 �t; ° i Clerk Burkard reported on the following: Ed Leroux may want to go to Assessors School again this year as they didn't open filing in time. Luvern Johnson from the League of Municipalitier will be in Hugo October 31 , to ansewer any questions aa.yone might have. Clerk Burkard is to draft a resolution endorsing the Roseville Resolution to the Rice Creek Watershed Board. Tree Inspector Gerald Beach's contract is signed and in force. The Clerk's office received payment from the insurance company for the damaged water heydrant. Howard mentioned the Rice Creek Watershed people would like a meeting with council on the Horesshoe Lake and other problems. The Clerk's office is to notify Mr. Hamilton of the Watershed Board they are invited to the next council meeting on November 4th. Howard also mentioned he would like people to hold off connecting to the sewer until November 15, 1974. Mayor Lease said a letter had been sent to the White Bear Rod & Gun Club from the EQC requesting any progress on the property be halted until the Envi ronmental Assessment has been evaluated by the EQC. Apparently the club had started to move dirt and cut trees. Attorney Johnson said during. . the Assess- ment stage they could progress, but under the Impact stage, progress must be halted.
