The meeting was called to order at 7:11 PM by Mayor Lease. Roll was
called: Lease, LaValle, Leroux, Martin, Smith present..
Motion made by Lease, seconded by Smith to approve minutes of the
October 21 , 1974 meeting. Motion carried.
Motion made by Lease, seconded by Martin to approve minutes of the
October 24th meeting. Motion carried.
Motion made by Martin, seconded by LaValle to approve minutes of the
October 30, 1974 meeting. Motion carried.
Discussion of General Claims brought out the fact that Gerald Beach,
Tree Inspector, must come in with a report before he is given the
rest of claim. Clerk's office to send Beach a letter on 1st of December
as a reminder. Motion made by Lease, seconded by Leroux to approve
General Claims for payment. Motion carried.
Motion made by Smith, seconded by Lease to approve Water Department
Claims for payment. Motion carried.
Motion made by Lease, seconded by Martin to grant renewal of a Mobile
Home Permit to Robert McCloud, 9627-122nd St. North under Section II,
Paragraph D, Oneka Ordinance #8. Motion carried.
Mr. Jerry Riopel submitted a written complaint to the City Council re-
garding: Marvin Rehbein permit for land fill from Mr. & Mrs. Jerry Riopel
farm. Smith read letter to all council members. The complaints were
as follows: 1 ) The land was never leveled off to Riopel's satisfaction
stating that Mr. Rehbein had not returned to finish the job, 2) Mr.
Rehbein hauled peat ground and leveled it off on Riopel's property with-
out his .permission, 3) Because of unfinished job the neighbors have
complained about blowing sand and he is unable to work the soil to stop
the drifting. Mr. Riopel was also in attendance at the meeting and
questioned when the road would be completed. Howard stated that he had
contacted the countyengineer and Art Madsen and they will be out to
check on this as soon as possible. Lease mentionedthat when the permits
were given they were told there would be sand blowing. Lease stated he
would like to see the permits to review them. Lease told Mr. Riopel that
we would be out to look at the stivation.
Warren Creager requested the Council consider refunding his $40.00 because
he was turned down by the Planning Commission for a minor subdivision
inside Arcand Estates. Request was denied.
Martin reported to the Council that Mr. Johnson would try to have the
rough draft, with all the changes included, completed by the November 18th
Council meeting. Martin also stated that the committee would start work
on Wednesday night on subdivision, trees, and any other suggested
ordinances besides animal nuisance. Martin asked Attorney Johnson if
he had any other "pet Peeves" outside of reorganization. Johnson stated
there is substantial expesne to the city for engineering review and design
and legal review and planning review, etc. He suggested it might be
advisable to draft a special ordinance to provide the recovery of those
costs for several of these areas. Lease suggested that maybe someone
from the Planning Commission should be in attendance.
There had been no planning meeting the second half of October, therefore,
nothing new from the Planning Commission.

It was reprted that the final assessment roll was with Ehlers for final
computation. Lease suggested that Bob take a look at the rates for sewer.
Police Chief, Robert Barth had submitted a written report which was
accepted as is.
Charles Johnson submitted his written report along with a few other
comments. Last Tuesday, October 29, Mr. Johnson' s office was given a
telephone notice of about 1 day that there was a temporary restraining
order hearing scheduled in the Distric Court, Washingto) County against
the city, White Bear Rod and Gun Club and LaValle Excavating. The judge
set a heari:.g on whether or not the restraining order should be made
permanent or not for Thursday, October 31st. Mr. Johnson stated he
appeared, the Gun Club appeared and the Attorney General' s office
appeared for the Enviornmental Quality Council and at that time he moved
to have the City of Hugo dismissed from the lawsuit completely which
the judge granted. The White Bear Rod and Gun Club moved to have the
restraining order lifted until after the EQC meeting of November 12th
and the judge granted that order and continued the matter until Novermber 141
Mr. Johnson also received a telephone call on November 1st informing him
that there is a meeting of the EQC Technical staff on November 5th at
9:00 AM in the Capital Square Building to review the environmental
assessment. Attorney Johnson recommended that someone be there to
represent the city. LaValle moved and Smith seconded that Attorney
Johnson represent the city at the meeting of the EQC Technical Staff
on November 5, 1974 at 9:00 AM at the Capital Square Building in St. Paul
Motion carried.
Attorney Johnson also stated that Mr. Card's attorney had contacted him
regarding the building permit matter. Mr. Card's attorney suggested
that a meeting be held between Mr. Card's attorney, the building inspector,
and Mr. Johnson to try and resolve the matter. Mr. Card's attorney has
been notified as to the vasis of non-action on the building permit
applciation and the reasons for non-action. At this time the permit has
neither been approved or denied and Mr. Card still feels he should be
given the permit. Lease requested Attorney Johnson to write a letter to
Mr. Card's attorney stating we had not received the necessary information
requested in his original letter.
Attorney Johnson requested the Clerk's office to send special letter to
Joe Ohman, Vern Pelolquin, Harley Johnson and Ed Waugh regarding the
Council's decision on their assessments.
Lease asked Attorney Johnson about the Bayless matter. Johnson stated
the matter is in discovery process now and there is no indication as to
when we might come to trial.
Mr. Johnson mentioned that there will be a symposium an law inforcement
(Washington County orientated) on Novmeber 15th and 16th to be held in
Hudson, Wisconsin and he feels that Chief Barth should attend if at
all possible. Motion was made by Martin, seconded by Smith that Police
Chief Robert Barth attend the symposium on law inforcement to be held
on November 15th and 16th to be held in Hudson, Wisconsin. Motion
carried. Mr. Johnson will have a copy of the letter regarding this
symposium sent to Cheif Barth.

Engineer Howard Kuusisto submitted his written report to Council and
explained a few items. All forms for the HUD Grant have been completed
and we should be receiving the money soon. The complaint from Royal
Haven Estates was discussed briefly along with Hardwood Creek Estates
regarding damages done by NSP and Northwestern Bell. Even if they have
submitted plans to Council the lines are not put where the plans state.
A meeting would be set up with IPSP and Northwestern Bell to discuss
this matter.
There was discussion regarding an inspection of a fallen barn. The
building inspector had contacted Fire Chief Granger and he was to
go out there and check it. Lease stated we need a formal complaint
in order to take any action.
The building inspectors report was given which showed 3 new houses and
a garage.
The Clerk stated he had received a letter from the City of St. Paul, the
Office of the City Attorney, in regard to the NSP application for increases
in electrical and gas rates. They are interested in knowing how interested
we are in the rates. Lease said we should contact them to find out what
it is about.

The Clerk's office received a notice that there will be a workshop on
sewage disposal through the University of Minnesota - February 4th-6th
and February 25th-27th - regarding septic tanks, etc. Mr. Burkard though
the building inspector and plumbing inspector should attend.
Clerk's office also received a letter from Pine City regarding problems
of towns 5,000 population and under. The City Clerk from Pine City has
requested we send a letter stating any special subjects or problems to him
by November 10th as this will be a part of the program for the next state
convention of the League of Municipalities.
As Howard Kuusisto stated in his report, all forms for the HUD Grant have
been completed requesting the $309,000 and we should be receiving our
money soon.
Due to an inconsistency in the City's old Dance Hall Ordinance No. A-31
a new ordinance was brought before the Council for adoption. LaValle
made motion and Martin seconded that we adopt Ordinance Number 1974-117,
an ordinance repealing an ordinance to protect public peace and morals
by regulating the licensing of public dances and public dance halls and
providing a penalty for violation thereof. Motion carried.
At 9:01 Mayor Lease called a recess.
Meeting reopened at 9:14 PM.
Mr. Arcand appeared before the Council and requested that the cash deposi
of $8,000.00 which is lieu of a bond for security deposit be returned
to him at this time. Engineer Kuusisto submitted a letter stating that
the work had been completed satisfactorially and is acceptable to the
City Engineer. LaValle stated that the road was satisfactory also.

carried. A copy of the Cashier' s Check is attached and made a permanent
part of the minutes.
Regarding the Wilbur Schuman Junk Yard License Mr. LaValle informed the
Council he did not have the information needed or any additional progress
to report. Smith stated he had been hauling cars out regularly. Mr.
LaValle told the Council he will report back to the Council with more
information on December 16th.
Clerk Bob Burkard stated he had received Off sale Liquor License Applications
from the following establishments:
Mr. Swan Anderson, Carpenter's, we have received the two signed applications,
$100.00 fee and surety bond. LaValle made motion, seconded by Lease that
the Off sale Liquor License Application for Carpenter's be approved. Motion
carried.
Irene Traeger - we have received the two signed applications, $100.00 fee
and surety bond. Motion made by Leroux, seconded by Smith that the Off Sale
Liquor License Application for Traeger's be granted. Motion carried.
Mr. Robert Ricci, Ricci's - we have received the two signed applications,
$100.00 fee and surety bond. Motion made by Lease, seconded by Smith
that the Off sale Liquor License Application for Ricci's be granted.
Bill's Bar and Grill - we have received the two signed applications, $100.00
fee and surety bond. Motion made by Martin, seconded by Smith that the
Off sale Liquor License Application for Bill's Bar and Grill be granted.
Motion carried.
Countryside Center - we have received the two signed applications, $100.00
fee and surety bond. Motion made by Martin, seconded by Lease that the
Off sale Liquor License Application for Countryside Center be granted.
Motion carried.
Pioneer Club - We received two signed applications, but no surety bond
had been submitted. Bob recommends this application be tabled.
Mr. Land, Mr. Hangi and Mr. Ridler again appeared before the Council to
discuss their problem regarding the lots they purchased. Mr. Kuusisto
suggested they should raise the lot level. The building inspector stated
the minimum is 3i feet above the footings. Lease suggested that they
wait until spring and watch the water level then. They stated that they
had visisted the site this spring and had only 1 slight low spot on the
property. It was suggested that Howard submit a written brief as to
his recommendations regarding the elevation plus the elevation of Horseshoe
Lake, which would probably be their next problem, to the City of Hugo, Mr.
Land, Mr. Hangi and Mr. Ridler.
Motion was made by Lease, seconded by Martin that we had reviewed with
both the people that own the property and engineer and we see it could
pose serious problems, but if they want to follow the recommendation of
the engineer and the way the land sits today it is buildable in accordance
with the engineers report so attached.
The Enviornmental Report on the White Bear Rod and Gun Club was distributed
to the council members. This is the report that will be reviewed by the
EQC Technical Committee on November 5th. The Clerk's office was requested
to send a copy of the report to Rice Creek Watershed.
