NOVEMBER 25, 1974 MINUTES OF PROCEEDINGS OF SPECIAL MEETING 0 1 1Z <br /> 4s <br /> The meeting was called to order at 7:11 P.M. by Mayor Lease. Members <br /> present were: Lease, Leroux, Martin and LaValle - Smith absent. Also <br /> present was Charles Johnson, City Attorney. <br /> Br. Burkard read petition from Clerk of Court on the Schreier and <br /> Mogran Subdivision. He also read petition received from John J. <br /> Oman and Grace M. Oman regarding sewer assessment. <br /> Mr. Burkard read letter received from the EQC regarding the White Bear <br /> Rod and Gun Club. <br /> Christmas lights and decorations were discussed. It was decided <br /> that the Businessmen could have the lights put up at their own <br /> ezpense and the City would pay for the electricity from December 20th <br /> through January 2nd. <br /> Mr. Johnson explained the changes made in the Zoning Ordinance. He <br /> stated that all the comments from the Ordinance Committee have been <br /> worked into the ordinance. The followikng are some of the additons <br /> and changes made: <br /> - Second classification for Rural Residential. <br /> - Added classifications for Lake Shore and Flood Plain. <br /> - Land Unit Development was redefined. <br /> - Definitions have been expanded. <br /> Attorney Johnson explained that there was a problem with the Lake <br /> Shore and Flood Plain classifications overlapping other districts. <br /> It was decided that Subd. M & N should be taken out and the restric- <br /> III tions for lakeshore and food plain will be incorporated under use <br /> limitations for other districts. The legend on the Zoning Map will <br /> be changed. <br /> Burkard questioned the filing fee for Farm Site Plan applications. <br /> A $10.00 fee will be added under Paragraph 320-10. <br /> Attorney Johnson explained that Planned Use Development was com- <br /> pletely revamped. HUD fee was added under Paragraph 320-10. <br /> LaValle asked if there was a provision to cover the City for reim- <br /> bursement for Engineering and Legal fees. Mr. Johnson explained <br /> that under the HUD the Council can ask for additional money as re- <br /> quired to cover the cost for engineering and legal fees; it is also <br /> covered generally under fees. <br /> Attorney Johnson will have the changes made and the new draft of the <br /> Ordinance at the December 2nd meeting. Hopefully a Public Hearing <br /> will be scheduled at the Council meeting of December 2nd tentatively <br /> for the week of December 16th. Mayor Lease will check with Carl Dale <br /> to see if he will be available to attend the Public Hearing. <br /> Attorney Johnson stated that the whole Ordinance has to be published <br /> in the paper to be official. LaValle suggested adopting the Code as <br /> it would be cheaper. Johnson stated that all Ordinances adopted by <br /> the City are in the Code form. He also stated that there is no <br /> time limit that you have to publish the Zoning Ordinance after the <br /> Public Hearing. <br /> Attorney Johnson stated that he was contacted by Vern Peloquin's <br /> Attorney regarding getting another service added or a letter stating <br /> that they could have a drop into a manhole.
