ABSENT: None 1 . Minutes of Special Meeting on March 15, 1975 for approval. MOTION: Lease made motion, Leroux seconded to approve minutes of Special Meeting held March 15, 1975 to issue a On Sale Sunday Liquor License to Charles Hayes, of Rockville North. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. VOTING AGAINST: None MOTION CARRIED 2. Minutes of Proceedings of the City Council Meeting held March 17, 1975, for approval. MOTION: Lease made motion, seconded by LaValle, to approve the minutes of the City Council meeting minutes of March 17, 1975. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty. VOTING AGAINST: None MOTION CARRIED 3. General Claims reviewed. MOTION: Lease made motion, seconded by LaValle to approve General Claims of April 7, 1975. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. VOTING AGAINST: None Treasurer corrected Item #14 from $35.31 to read $11 .77 due to prior payment, leaving a total of $13,252.09. MOTION CARRIED 4. Utilities Claim reviewed. MOTION: LaValle made motion, seconded by Leroux to approve the Utility Claims dated April 7, 1975. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty VOTING AGAINST: None MOTION CARRIED 5. MOTION: LaValle made motion, seconded by Schletty to grant a renew- al Temporary Mobile Home Permit to Robert McCloud under Hugo Code Sec. 40-12, Subd. D: Hardship Cases, for 3 months, fee $10.00. APRIL 7, 1975 VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. VOTING AGAINST: None MOTION CARRIED 6. MOTION: Lease made motion, seconded by Leroux to grant a renewal Temporary Mobile Home Permit to Joe Zaspel under Hugo Code Chapter 40, Article III, Subd. D for three months for a fee of $10.00. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty VOTING AGAINST: None MOTION CARRIED STAFF REPORTS: ORDINANCE COMMITTEE: Ordinance Committee has completed its review of the Subdivision Ordinance and has submitted copies of the corrections to the Council to be reviewed at the next meeting of April 21 , 1975. POLICE DEPARTMENT: Police Chief questioned wheather Rockville U.S.A. is entitled to a Sunday Liquor License as they serve only sandwiches from a heated oven, not an open kitchen. Chief to question the intent of the owners as to future plans regarding food. 7. Hiring of full time patrolman MOTION: Lease made motion, seconded by Smith to hire John Jackson at a starting salary of $9,000.00 per year with $150.00 clothing allowance and $250.00 in insurance benefits at a full time starting date of April 15, 1975. Jackson was questioned wheather the starting salary was adequate and he stated yes. Schletty questioned the $250.00 toward insurance and the insurance policy was reviewed. Officer Jackson stated his intent wa; to move to the City of Hug() when possible. Chief Barth stated that Officer Jackson was to be sent to the Bureau of Criminal Apprehension and that during his vacancy, another patrol- man would be available for duty. VOTING FOR: Lease, LaValle, Leroux, Smith and Scnletty. VOTING AGAINST: None. MOTION CARRIED Councilman LaValle asked Chief Barth to keep tract of squad mileage and to report up to date mileage on the monthly report. ATTORNEY: 8. Suggested correction of Diseased Tree Control Program area changing Section 8 to Section 20. y APRIL 7, 1975 4 MOTION: Lease made motion, LaValle seconded to publish the Correction to Notice of Diseased Tree Control Program For The City of Hugo. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. VOTING AGAINST: None. MOTION CARRIED Wenzel Application: Mikeworth and Johnson to draw up a covenant which is to be attached to the plat and kept on record at City Hall. Oman, Twin Pines Trailer Court Re: Sanitary Sewer Assessment: 9. MOTION: LaValle made motion, Schletty seconded to have Clerks office send letter to J. J. Oman stating that in the event a sanitary sewer expansion project would be constructed along trunk highway #61 and abutting the existing Twin Pines Trailer Court, there were no additional benefits to the existing Twin Pines Trailer Court, there would be no further special assessments to the property encompassing the Twin Pines Trailer Court for such a future sanitary sewer system expansion. A copy of this letter to be sent to City Attorney and City Engineer. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. VOTING AGAINST: None MOTION CARRIED 10. MOTION: LaValle made motion, Lease seconded to adopt Resolution No. 1975-24 A RESOLUTION ESTABLISHING SANITARY SEWER USE RATES FOR PREMISES SERVED BY THE SEWERAGE SYSTEM, AS RE- QUIRED BY HUGO CITY CODE CHAPTER 262. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. VOTING AGAINST: None MOTION CARRIED 11 . MOTION: Lease made motion, Smith seconded to adopt Resolution No. 1975-25 A RESOLUTION AUTHORIZING THE INVESTMENT OF CITY MONIES FOR THE CITY OF HUGO, MINNESOTA VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED City Engineer and City Attorney to get together and draw up suggested proposal for the Bisanz road. APRIL 7, 1975 12. MOTION: Lease made motion, seconded by Schletty to have Clerk office write James Muggs, Hardwood Creek stating they have not received the pref ormance bond and until such time received, there will be no Building Permits issued. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED 13. Horton Junkyard MOTION: Lease made motion, LaValle seconded to have Attorney Johnson write the District Court stating the Cities position regarding the Horton Junkyard. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED ENGINEER: Clerks office advised to send a copy of the Sanitary Sewer System, Chapter 262 and resolutions to the Metro Council, attention Ray Odde. Rice Creek Watershed wants a meeting with the Hugo City Council regarding the Horseshoe Lake problem. Engineer to get report from the Rice Creek Watershed. Permits will be issued if conditions are not received. Schletty made comment that he had contacted Washington County Highway and the City could get up to 50 loads of gravel for emergency use on roads. 14. MOTION: LaValle made motion, Smith seconded to adopt Resolution 1975-23 A RESOLUTION ESTABLISHING A BOUNTY OF POCKET GOPHERS CAPTURED IN THE CITY OF HUGO, MINNESOTA, AND AUTHORIZING THE APPOINTMENT OF A BOUNTY PAYMASTER FOR RECEIVING CLAIMS AND PAYING BOUNTIES ON POCKET GOPHERS, AND ESTABLISHING COMPENSATION FOR THE BOUNTY PAYMASTER. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED 15. MOTION: Lease made motion, LaValle seconded to adopt Resolution 1975-26 relating to the distribution of the telephone and railroad gross earnings tax to Cities. Statement came from audience disagreeing with the adoption of a resolution made by a governing body. VOTING FOR: Lease, LaValle, Leroux, and Smith VOTING AGAINST: Schletty MOTION CARRIED 16. HUD AUDIT APRIL 7, 1975 j MOTION: Smith made motion, LaValle seconded, to hire George M. Hansen Company, C.P.A. , to audit of H.U.D. Project No. SEF-MN-05-00-0148 of the City of Hugo, Minnesota. VOTING FOR: Lease, LaValle, Leroux and Smith, Schletty. MOTION CARRIED 17. MOTION: Schletty made motion, Lease seconded, to enter in a contract for audit stating cost of audit not to exceed $1 ,300.00 and to meet all the specifications of H.U.D. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED Dog Ordinance reviewed and sent back to Ordinance Committee for further corrections and is again to be reviewed at the City Council Meeting April 21 , 1975. The Minnesota Pollution Control Agency have arranged a meeting in their office for 1 :30 P.M. , April 17, 1975 to discuss matters regarding the White Bear Rod and Gun Club. Council asked City Engineer and City Attorney to attend meeting representing the City. Recess was called at 10:06. Meeting called back to order at 10:22. Rogstad Variance: 18. MOTION: Smith made motion, LaValle seconded, to accept the Planning Commission report allowing two more dogs that is permitted in the Ordinance with the understanding that the certificate shall expire upon the demise of the excess dogs or five years, which ever shall first occur. DISCUSSION: Councilman Schletty reported kennels a mess due to weather conditions, would expect as much. Dogs barked considerably at first, but later quieted. Didn't seem to be too harmful. Councilman Leroux said for the area, too many dogs; facilities seemed to be large enough and that close neighbors didn't object to the dogs in that area. Mr. Rogstad attorney stated that the Rogstad property was up for sale and does not wish to have client dispose of animals as he would soon be moving. Attorney Johnsoncourected the Planning Commission Report to read from "to issue a Certificate of Occupancy for lawful nonforming use" to read "unlawful nonconforming use". C. Sibley said if the variance was granted others would follow and that he has put up with noise for five or six years. Darrell Jacobson, 6364 N. 165th. St. , neighboring party, stated he had no objection to the dogs he did not consider them a nuisance or a disturbance to the neighborhood. MOTION: LaValle made motion, Smith seconded, to grant a Variance Application to Norman Rogstad, changing "lawful" to "unlawful", kenneling of two (2) more dogs to six (6) more dogs and five years to one year as stated in the Planning Commission Report as of March 12, 1975. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED 20. MOTION: LaValle made motion, seconded by Leroux to extend meeting beyond 11 :00 P.M. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED 21 . Hugo Lions Club MOTION: Lease made motion, seconded by Smith to accept the Hugo Lions Club proposal concerning the ballfield in the South- west corner of the City Park of a total expense of $1 ,180.00 that the City will participate in a maximum of $590.00 and the Lions Club will participate in the amount of $590.00 plus any additional cost as may occur. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED 22. MOTION: Lease made motion, Leroux seconded that the amount of $590.00 to use for the ballfield, be out of the Park Revenue Sharing Fund. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED 23. MOTION: LaValle made motion, Leroux seconded, that the direct payment be made from the City of Hugo, and when the $590.00 is paid to the City, from the Lions Club, the City Clerk will have the authorization to order the benches. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED Grace Development Company after requesting proposed changes; it was suggest- ed by the Mayor to have the Grace Development Company contact its engineer and draw up a new plan that would be up to date and at that time the City could act on it. The City would not have the City Engineer do any more work on the development as enough money has been spent on the project. 5 MININIMEM i APRIL 7, 1975 51 A Child Day Care Center was requested from the Co-op Parents to be establish- ed at Faheys Rock House. Present zoning classifications does not allow for this and it was suggested the Co-op Parents petition for a re-zoning application and then fill out, an application for a Special Use Permit. Members of the audience said the requirements for a Day Care Center are too severe and costly and that most individuals cannot afford the expense to have a center which they felt is badly needed in the Hugo area. Suggest- ed the sewage requirements be reviewed. Council said any review would have different proceedure. Curb and Gutter and Better Surface Roads 24. MOTION: LaValle made motion, Smith seconded to hold a Special Meeting to discuss the storm sewer and street improvements in the Old Village of Hugo on April 15 at 7:00 P.M. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED MOTION: LaValle made motion, seconded by Schletty to adjourn meeting at 12:40 A.M.
