Smith seconded. VOTING FOR: Lease, Smith and Schletty. MOTION CARRIED 4.0 MOTION: Smith made motion, seconded by Schletty to approve General Claims for May 20, 1975. VOTING FOR: Lease, Smith and Schletty. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES: MIRON MOBILE HOME PERMIT RENEWAL MOTION: Lease made motion, Smith seconded to grant a renewal Temporary Mobile Home Permit to George T. Miron under Hugo Code Chapter 40, Article III, Subdivision D. VOTING FOR: Lease, Smith and Schletty. MOTION CARRIED Groucho's Softball Team licensing. MOTION: Lease made motion, seconded by Schletty to grant a Non-Intoxicating Malt Liquor License and a Soft Drink License to the Groucho's Softball Tournament on June 7th and 8th, 1975. VOTING FOR: Lease, Smith and Schletty. MOTION CARRIED 5.7 BURY CABLE - NORTHWESTERN TELEPHONE MOTION: Lease made motion, Smith seconded to approve the application of the Northwestern Bell Telephone Company to place buried cable along east side of Greene Avenue, north of 147th. C� MOTION CARRIED 5.6 INDYKIEWICZ MINING PERMIT RENEWAL The Planning Commission recommendation is to grant a renewal with the original conditions attached. An on-site inspection was made by the Engineer as requested by the Planning Commission. It app:eared . to the engineer, that the excavation and removal of materials does not follow any parti- cular type of plan which would provide a completion program of grading for drainage slopes and the installation of top soil and seed. These are parts of the mining permit conditions. The engineer suggestions are: 1 . The large westerly area should be graded to drain and top soil applied and seeded. This general area should first be further inspected regarding elevation of the remaining area with respect to the drainage ditch. 2. The operator/owner should provide information regarding his program of excavation. This item pertains to the many different excavations at the site and the basis for such type of operation. 3. The conditions of the prior permits shall be included as part of this permit. 4. The operator/owner should appear before the Planning Commission regarding this renewal permit. 5. Conditions suggested as part of the original permit included, or as part of the renewal permit should require a time schedule for compliance. MOTION: Lease made motion, Smith seconded to table the Renewal for the Indykiewicz Mining Permit until June 16, 1975. The Clerks office is to check with the Planning Commission to see if the Engineets report was taken into consideration when they made their approval of the Renewal. MOTION CARRIED 5.1 CHANGE RESOLUTION NUMBERS MOTION: Lease made motion, Schletty seconded to change RESOLUTION NO. 1975-26 to 1975-27 A RESOLUTION ABOLOSHING RESOLUTION NO. 1975-24 RELATING TO ESTABLISHING SANITARY SEWER USE RATES FOR PREMISES SERVED BY THE SEWER SYSTEM, AS REQUIRED BY HUGO CITY CODE CHAPTER 262, also to change RESOLUTION NO. 1975-27 to 1075-28 A RESOLUTION ESTABLISHING SANITARY SEWER USE RATES FOR PREMISES SERVED BY THE SEWERAGE SYSTEM, AS REQUIRED BY HUGO CITY CODE CHAPTER 262. MAY 20, 1975 c t VOTING FOR: Lease, Smith and Schletty t' MOTION CARRIED 5.2 STREET LIGHT INTERSECTION OF 170TH & FOREST BLVD. Planning Commission recommended the installation of a street light at the intersection of 170th. and Forest Boulevard. No reasons were given why the request was made. MOTION: Schletty made motion, Smith seconded to deny the request of the installation of a street light at the intersection of 170th and Forest Blvd. VOTING FOR: Lease, Smith and Schletty. MOTION CARRIED 5.3 SUBDIVISION VAIANCE - S. TILTON The Planning Commission recommended approval of the erection of metal building to be used for storage, in RR2. It was determined that the building is to be built across the road from the house, the principle building. Attorney stated there should be an existing non-conforming use stated. MOTION: Lease made motion, Smith seconded to refer the Application for a Subdivision Variance from Stephen Tilton, back to the Planning Commission for the following two reasons: 1 . Existing non-conforming use and to what extent. 2. The principle building must exist before the secondary or auxiliary building is built. VOTING FOR: Lease, Smith and Schletty. MOTION CARRIED 5.5 DAY CARE CENTER Attorney Johnson to check into the Day Care Zoning. Lease moved to table the Day Care Rezoning request until the report from Attorney Johnson is received. 5.4 MOTOR VEHICLE SALES IN RB & CB BY SPECIAL USE PERMIT Smith sugggsted that a Public Hearing could be held on both the Motor Vehicle Sales and the Day Care Center for amendments in the City Code. MOTION: Lease made motion seconded by Smith to ask the Planning Commission to hold a Public Hearing to amend Chapter 320 of the Hugo City Code. MAY 20, 1975 VOTING FOR: Lease, Smith and Schletty. MOTION CARRIED 6.1 RESIDENTIAL EQUIVALENT CHARGE The Sewer Ordinance does not list the cost of the TEC on new homes. Attorney Johnson and Engineer Kuusisto had discussed the charge and also an annual percent increase and what would be a reasonable end point. Not having come to any conclusion, further discussion was to be made with Ehlers and they were to report at the next meeting, June 2, 1975. Lease stated that any new homes would have to pay the $515.00 in order to obtain the building permit. COMPREHENSIVE EMPLOYMENT AND TRAINING ACT (CETA) A duplicate request was made by the City of Hugo and also the Police Department. The City Council acted on a Maintenance Man for the City of Hugo so this job description is the only one that they wanted submitted. Smith will call and discuss with Mr. Larson regarding any further information PIONEER CLUB PROBLEM Letter was read from Mikeworth and Bartholdi. No actual claim was filed by the Pioneer Club against the City of Hugo for damages. MOTION: Lease made motion, Smith seconded, to have Attorney Johnson and Engineer Kuusisto get to gether all details regarding the sewer problem for a response to Mikeworth and Bartholdi letter pertaining to the Pioneer Club. VOTING FOR: Lease, Smith and Schletty. MOTION CARRIED HUD AUDIT CONTRACT A draft of the Audit Contract has been submitted through the Engineers office. The auditing firm has agreed to the terms and asked for a change from 15 to 20 days which was agreed upon. Engineer has preliminary approval from Telfers. HORSESHOE LAKE DRAINAGE An estimated total cost was submitted for the recommendations of the Rice Creek Watershed District. The Council must petition the Rice Creek Water- shed District for the proposed work. The Watershed District will then hold a public hearing, send out the hearing notices and determine the affected drainage area. The Watershed District would assess the costs and the City would collect the assessment. Part of the proposed improvement is outside the City limits of Hugo, and this is where the Watershed District helps coordinate the project between the governmental agencies involved. As the City Engineer was not present at the meeting, the Horseshoe Lake Drainage Problem will be put on the agenda for the June 2, 1975 City Council Meeting. MAY 20, 1975 �. 4 8.0 NEW BUSINESS 8.1 DOG CONTROL J. Parsons stated two incidents where large dogs had disturbed and had bitten her young child while in his own yard. Smith stated the problems of writing up a Dog Ordinance that would be of benefit to all people. Also stated the financial aspect is a problem. J. Parson volunteered her help is she could be of any, to speed up the ordinance writing. SIGN ON EVERTON AVENUE NORTH Schletty to check to see what signs are available, either Caution or speed limit sign, to slow down traffic on Everton Avenue North, North County Line of Ramsey County. If none available, to contact Washington County to install one. RECOVERY OF EXPENSES FROM THE WHITE BEAR ROD AND GUN CLUB Clerk submitted report for legal and engineering cost. Attorney and Engineer to figure actual costs. REVENUE SHARING MOTION: Smith nade motion, seconded by Lease, to place $1 ,000.00 in Capital Expenditures for Recreation, $1 ,000.00 in Operating/Maintenance for Recreation, and $10,878.00 Operating/Maintenance for Public Safety. VOTING FOR: Lease, Smith & Schletty MOTION CARRIED MOTION: Lease made motion, Schletty seconded to cash C.D. #2898 for $2,381 .00 and C.D. #3896 in the amount of $2,214.76 to be placed in the General Fund. VOTING FOR: Lease, Smith and Schletty. MOTION CARRIED Lease directed Clerk to transfer $500.00 from the Sewer Fund to the General Fund.
