PRESENT: Lease, Leroux, Smith & Schletty ABSENT: LaValle 3.0 APPROVAL OF MINUTES: CORRECTIONS: 8.0 SIGN ON EVERTON AVENUE NORTH "North County Line of Hugo" should be "North County Line of Ramsey County: MOTION: Lease made motion, Smith seconded, to approve minutes subject to corrections as stated. VOTING FOR: Lease, Leroux, Smith & Schletty. MOTION CARRIED 4.0 APPROVAL OF CLAIMS: MOTION: Lease made motion, Schletty seconded to approve the General Claims of June 2, 1975. VOTING FOR: Lease, Leroux, Smith & Schletty MOTION CARRIED MOTION: Smith made motion, Schletty seconded to approve the Utility Claims of June 2, 1975. VOTING FOR: Lease, Leroux, Smith & Schletty. MOTION CARRIED 5.0 PETITIONS. REQUEST. COMMUNICATIONS & LICENSES Mayor Lease read and signed an Official Proclamation designating June 27, 28, and 29 as GOOD NEIGHBOR DAYS sponsored by the Lions Club. 5.2 K.C. PLAZA PERMIT - INTOXICATING LIQUOR The fee had been received by the K.C. Plaza for a permit to allow consumption and display of intoxicating liquor which the Mayor issued. 5.1 PFINGSTEN - RE-DITCHING Mrs. C. Pfingsten stated her husband received permission from Engineer Kuusisto to plug the culvert. Kuusisto said no per- mission was given by him. Mrs. Pfingsten stated she wasn't present when the permission was given so she would not argue the issue. She stated that when they plugged the culvert they did not stop the flow only deverted the flow. Mrs. C. Pfingsten said she now has permission from the Rice Creek Water Shed to plug the culvert. Mayor Lease said Rice Creek does not thave the right to issue JUNE 20 1975 5.1 PFINGSTEN - RE-DITCHING cont. permission to anyone to plug a culvert on a public rightaway. Mrs. Pfingsten stated when Co. 4 road was put in it changed the road creating problems. Kuusisto stated that they were very careful that the road be put back the same as it was - there is no change in the culvert. Mayor Lease said it is up to the Rice Creek Water Shed to hold a Public Hearing as to what steps are next in this problem area. 5.3 LIONS CLUB MOTION: Smith made motion, Schletty seconded, to issue a Soft Drink License for a fee of $5.00 and a Non-Intoxicating Malt Liquor "On Sale" License for a fee of $10.00 to the Hugo Lions Club to be used on the City Park Grounds on Good Neighbor Days, June 27, 28 and 29. VOTING FOR: Lease, Leroux, Smith & Schletty. MOTION CARRIED Lions Club requested permission to use the Fire Hall and City grounds. They have the approval of the Fire Chief. Representatives stated the Club has sufficient liability insurance coverage. Stated the money collected would be used for some worthwhile cause for the City of Hugo. I•ZOTION: Schletty made motion, Lease seconded to issue a Bingo Permit to the Hugo Lions Club to be used on Good Neighbor Days. VOTING FOR: Lease, Leroux, Smith & Schletty. MOTION CARRIED MOTION: Lease made motion, Smith seconded to grant permission to the Hugo Lions Club to use the Fire Hall and City grounds for the Good Neighbor Days. VOTING FOR: Lease, Leroux, Smith & Schletty. MOTION CARRIED CERTIFICATE OF DEPOSIT MOTION: Lease made motion, Smith seconded to cash C.D. 3216 for $1795.00, #3453 for $3046.19 and #3557 for $3089.98 Revenue Sharing, to be placed in the General Fund . VOTING FOR: Lease, Leroux, Smith & Schletty. MOTION CARRIED 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 ORDIANCE COMMITTEE - No report. JUNE 29 1975 7 6.2 PLANNING COMMISSION V. Peloquin to report on the White Bear Rod & Gun Club to the Planning Commission on June 11 . City Council to have report by their next meeting of June 16. Councilman Leroux stated she thought the Commission should review again the Open Space proposal. Mayor Lease did not approve of high valued land be taken for the use of a bicycle trail. Lease stated a park development committee should be formed and asked Leroux if she would take charge of such a committee. She said she would. Notice to be published in the Forest Lake Times to contact Leroux for those who are interested. 6.3 SEWER COMMITTEE Clerk read letter from Metropolitan Waste Control Commission stating they had received the User Charge System and that the report will be submitted to the Commission at its June 3 meeting, and that anyone is .lcome to attend. 6.4 BUILDING INSPECTOR Report submitted: 4 new homes, 3 garages, 1 remodeling 1 swimming pool. 6.5 FIRE CHIEF - No report 6.6 POLICE CHIEF Report given. Chief Barth stated that since Officer Jackson became fulltine, the burglaries have been cut in half. TREE INSPECTOR Submitted report - stated still working on final details for the dumping of diseased trees. 6.7 ATTORNEY 6.7.1 DAY CARE CENTER Attorney read the following: Chapter 257.081 Subd. 10 from Minnesota Statutes "Day care facility" means any facility operated to provide care for children for limited periods of a day. Day care facilities include but are not limited to family day care homes and group day care centers. Chapter 257.101 Subd. 6 Notwithstanding any law to the contrary, no municipality or other politcal subdivision may enact zoning ordinances which prohibit the use of a single family day care of five or less children, including the provider's children, so long as the facility meets requirements for licensure pursuant to this and all nnnlieAhle Int-al and Gtntp health nrrl P,_fPty rPLrulations. JUNE 22 1975 .A J. PIONEER CLUB Letter sent to Attorney Mikeworth, no reply received to date. MOGREN -vs- CITY OF HUGO Answers to be prepared by Council and Clerk. HORTONvs CITY OF HUGO Answers to be prepared by City Council. 6.8 ENGINEER Engineer to look at roads again. Cost to restore roads was again discussed. Dust Control Program for 1975 should be reviewed in the Spring. Cost for 1975 would be 25¢/gallon, same cost rate as used in 1974. The White Bear Rod & Gun Club has contacted the Engineer and discussed the plans and specifications for constructing their private sewage disposal system. At this time, no further information has been received. HORSESHOE LAKE DRAINAGE A report regarding the Horseshoe Lake Drainage plan has been submitted to the City Council. The report included work on a drainage system to the north, including ditching and cleaning along 177th St. North. It is suggested that the preliminary report would be reviewed and if satisfactory would be submitted to the Rice Creek Water Shed District for their review. MOTION: Schletty made motion, Lease seconded,to have Engineer, Attorney and City Clerk draw up a petition to submit to the Rice Creek Water Shed for the Horseshoe Lake Program. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 7.0 ORDINANCE AND RESOLUTIONS Dog Ordinance was discussed with no further information being offered for a solution. 6.9 CLERK Submitted letter from Mrs. Quimet stating the sewer construction caused the loss of her tree, by cutting the roots too close. Removal cast is $400.00 for the tree which she wants the City to pay. Complaint turned over to the Engineet. Letter submitted by NSP giving notice of cancellation of the existing contract for municipal water or sewer pumping service at the end of the existing term, as per jurisdiction of the Minnesota Public Service Commission. JUNE 29 1975 1 6.9 CLERK cont. 1 CETA regulations were received and given to Attorney for review. BURIED CABLE MOTION: Lease made motion, seconded by Smith to approve Job Order 30772 to place buried cable on Irish Avenue. DISCUSSION: As per application, applicant agrees to restore the disturbed portion of the street or road— way to as good condition as found. Engineer to follow up on this buried cable and also previous one on east side of Greene Avenue. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED MOTION: Lease made motion, Schletty seconded to authorize Clerk to purchase a calculator not to exceed $150.00. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED G. UNZE — PICKEREL LAKE — TREPESSING PROBLEM Public using his land for picnic, fishing off his shore, pulling boats unto his land, leaving a mess after their departure. Council suggested posting land, Attorney Johnson to check into matter. Schletty suggested filing a complaint with Police Chief. Lease called recess at 9:46. Resumed at 10:09. Public Hearing was discussed at length. Smith felt people wanted roads returned to original condition. Lease felt people couldn't afford the total project. Smith stated that what seemed to be the biggest problem was Foxhill. MOTION: Lease made motion, Smith seconded to extend meeting beyond 11 :00 P.M. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED Mayor Lease submitted Eleanor Leases' name for a vacancy that exists on the Washington County Park and Recreation Committee, due to a recent resignation of a member from the Forest Lake/Hugo area.
