PRESENT: LaValle, Leroux and Schletty (LaValle was Acting Mayor until Mayor arrived) ABSENT: Lease and Smith 3.0 APPROVAL OF MINUTES: MOTION: LaValle made motion, seconded by Leroux to approve the minutes of June 2, 1975. VOTING FOR: LaValle, Lem ux and Schletty. MOTION CARRIED 4.0 APPROVAL OF CLAIMS: MOTION: Leroux made motion, seconded by LaValle to approve the General Claims of June 16, 1975. DISCUSSION: Leroux questioned Item Number 5, Great Plains Gas at a cost of $70.41 . After discussion, it was being questioned if the Old Village Hall is being heated. Chief Barth stated it was warm whenever he entered the building. Windows had been blown out during the last storm. Council directed the Clerks office to contact the Gas Company and have them drain the tank of gas and no further delivery would be necessary. In discussing the Old Village Hall it was also brought up the security lite has been burnt out for some three months, as stated by Chief Barth, The Clerks office is to check on this as the Council wants the security light lit at all times. VOTING FOR: LaValle, Leroux and Schletty. MOTION CARRIED MOTION: Leroux made motion, seconded by LaValle to approve the Utility Claims of June 16, 1975. VOTING FOR: LaValle, Leroux and Schletty. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 RUBY DANIELSON, SPRING COMPANY — INGERSOLL ROAD Ms Danielson, realtor, is selling 5.6 acres of land for Mr. Reynolds. She asked whether the City of Hugo would be interested in purchasing part of the property for roadwork on Ingersoll Avenue. Council stated that Reynolds was asked to give part of the property to the City for completion of the road some years ago and that he would never come into an areement with the City. The zoning on the property is RR 2 (5acres5. If Reynolds would five the City 661 of land, the Council would grant a Variance for a one three acre plat. Ms Danielson will confer with Reynolds as she would like to see the road taken care of before selling +'ha n-nnno-►+iv JUNE 169 1975 115 5.2 POLICE CHIEF Chief introduced Michael A. Jensen, Stewart Ave. , White Bear Lake to the Council recommending that he be hired by the City of Hugo as a part time patroleman. Stated he met all the qualifi- cations that he needed to replace a former part time patrolemen who had left the department, leaving the department short of help Chief stated the part time men would like some weekends off which, being short of men, he was unable to do. LaValle stated several events are coming up, and the department should be filled. MOTION: Leroux made motion, Schletty seconded, to hire Michael A. Jensen, Stewart Ave. , White Bear Lake as a part time patrolemen for the Police Department of the City of Hugo. VOTING FOR: LaValle, Leroux, and Schletty. MOTION CARRIED 5.3 WASHINGTON COUNTY ROAD MAINTENANCE CONTRACT The Hugo roads are in such a shape that Schletty questioned weather the City of Hugo wanted to renew the Washington Road Maintenance Contract. LaValle pointed out that with the rainy weather, the road could hardly be kept up to standards. He also stated, that the City of Hugo is not in a position to maintain the roads them- selves and that the contract should have good review by Council members. Copies of the contract are to be sent to the Council Members, by the Clerks office. MOTION: Schletty made motion, Leroux seconded to table the Washington County Road Maintenance Contract to the first meeting in July, July 7th, 1975. VOTING FOR: LaValle, Leroux and Schletty MOTION CARRIED 5.5 WHITE BEAR ROD & GUN CLUB The Planning Commission felt that the terms of the Special Use Permit have been violated and the Council should deal with the following items: 1 , 29 9 & 11 . The remaining con- ditions of the Special Use Permit are in compliance. The items in question: 1 . Fencing - barbwire needs some additional work which will be done later in the summer. 2. Tree planting - trees not available at time of Planning report - Chief Barth stated tree planting had been started. 9. Driveway to be blacktopped - no activity on grounds so Council can't take any action on this item. 11 . Parking lot, one-half of the area, to be surfaced with crushed rock - still under construction. The bond, Item 19 has been posted with the City Clerk. Leroux suggested giving an extension of time on the above mentioned items. JUNE 16, 1975 117 Schletty said he would rather see it tabled until the items i questioned are completed. T. Peltier, audience, said the Club should apply for a Variance. MOTION: Schletty made motion to table the Annual Review of the Special Use Permit for the White Bear Rod and Gun Club until all the requirements are met. MOTION FAILED FOR A LACK OF SECOND MOTION: Leroux made motion, LaValle seconded, to grant an extension of time on the four items in question On the Special Use Permit, Numbers 1 , 2, 9, and 11 . DISCUSSION: Leroux pointed out that under no circumstances should there be any shooting done on the grounds until all items are completed. Being construction has not been completed, another review by the Planning Commission should be done. Clerks office to notify the Gun Club that there will be no shooting, and they should post the land stating so. LaValle will instruct the Planning Commission, by Clerks office, to make an inspection the later part of August or first part of September to see if conditions have been met. They are to have their report to the City Council by their first meeting in September, September 2, 1975. Leroux seconded. VOTING FOR: LaValle and Leroux. VOTING AGAINST: Schletty. MOTION CARRIED Attorney submitted legal fees against the White Bear Rod and Gun Club. MOTION: LaValle made motion, Schletty seconded to bill the White Bear Rod and Gun Club for legal fees of $0721 .00 and engineering fees of $192.00 and the National Biocentricts Enviromental Study for $02,500.00. VOTING FOR: LaValle, Leroux and Schletty. MOTION CARRIED 5.4 ASSESSORE TO BE ABOLISHED IF THEY ARE NOT CERTIFIED Present local assessor is not certified nor is he interested in being certified. All assessing would be done through Washington County who would hire our local assessor to assess the area in Hugo as the county is short of certified assessors. JUNE 16, 1975 119 MOTION: LaValle made motion to have Clerks office get costs on assessing, County versus a part time assessor, if Hugo were to hire one and the costs will be discussed at the next meeting. Leroux seconded. VOTING FOR: LaValle, Leroux and Schletty. MOTION CARRIED 5.6 INDYKIEWICZ MINING PERMIT RENEWAL There is a line fence problem, Indykiewicz to maintain one half of fence. Indykiewicz should provide a planned program of excavation. He presently has many different excavations with no apparent plan in mind. MOTION: LaValle made motion, Leroux seconded, to postpone revewing of the Indykiewicz Mining Permit until the meeting of July 7. Clerks office to notify party requesting a planned excavation and to contact City Engineer regarding plan and also the fence problem. VOTING FOR: LaValle, Leroux and Schletty. MOTION CARRIED 5.7 FISCHER MINING PERMIT RENEWAL There has been no activity but engineering will inspect land for ponding agter the heavy rains. There is no current letter of credit. One will have to be on file before any activity can occur in pit. MOTION: LaValle made motion, Schletty seconded to accept the $650.00 inspection fee and bond for the renewal of the Fischer Mining Permit but renewal will not be granted until the letter of credit, $3,000.00 is received and Clerks office is to n6tify them as such. VOTING FOR: LaValle, Leroux and Schletty. MOTION CARRIED 5.8 TILTON APPLICATION S. Tilton stated would like to build a secondary building. Has had three horses for some 10-11 years. He lives on (five) acres. MOTION: Schletty made motion, Leroux seconded to grant a Variance to build a secondary building before a principle building at 11899 Homestead Drive, Royal Haven Estates 2, Lot 2 and not to house more than three (3) horses. Periodic review is to be taken. VOTING FOR: LaValle, Leroux and Schletty. TVTn M 7 n'KT n Ann 7 M n JUNE 16, 1975 HORSESHOE LAKE Residents around Horseshoe Lake cane to the Council meeting voicing complaints of culvert being plugged and they as residents could not unplug the culvert. They felt it was up to the City to keep the culvert unplugged. Attorney stated that the City was following through on their legal suit and that was their responsibility Attorney and Engineer had prepared the petition to be sent to Rice Creek Watershed District. MOTION: Schletty made motion, Leroux seconded to instruct Attorney to send the petition to the Rice Creek Watershed for further handling of the Horseshoe Lake problem. VOTING FOR: LaValle, Leroux and Schletty. MOTION CARRIED SIGN REQUEST: P. Kamman requested a sign to be installed on Finley between 145 and 146 street, a sign noting Deaf Child. MOTION: Lease made motion, LaValle seconded to have Schletty get a cost estimate on the installation of two signs and order two to be installed on Finley street. VOTING FOR: LaValle, Lease,Leroux and Schletty. MOTION CARRIED 7.1 STREET IMPROVEMENTS A review ofthe sewered area will be taken Wednesday by Engineer, LaValle and Lease to determine what extent the improvements will be. MOTION: Lease made motion, LaValle seconded to hold a Special Meeting on June 18, at 3:30 P.M. to act on the street improvement program. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED If storm sewer is to be put in in the area of 150th and Foxhill the residents there will be assessed without another Public Hearing. 8.0 NEW BUSINESS DAY CARE CENTER MOTION: Lease made motion, seconded by LaValle to instruct the Planning Commission to not have the Public Hearing on the Day Care Center. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED JUNE 16, 1975 123 -p23 CETA PROGRAM Lease instructed Schletty and Smith to review job applications for the maintenance man. MOTION: Lease made motion, LaValle seconded, to enter into the CETA Program. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED OLD VILLAGE HALL - A request to purchase the Old Village Hall or to rent it to be used as a church. It was stated that the Hall property was purchasedby the city from school district, and if it was not to be used for a govermental purpose, property would revert back to the school district. City not interested in renting the building. OLD DUMP TRUCK - To be kept for Cities use. FIRE TRUCK - OLD - To be sold. MOTION: Lease made motion, Leroux seconded to advertise for bids for the sale of the '38 Dodge Fire Truck. Bids to be received no later than July 15. Advertisement to be placed in the Forest Lake Times and the St. Paul Dispatch/Pioneer Press. Truck can be viewed at Grangers Garage, 14797 N. Forest Blvd. DISCUSSION: LaValle pointed out that the City has the right to reject any offer. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED MOTION: LaValle made motion, Schletty, to approve the Leton contract for the repair of the doors on the City Fire Hall at a cost of $305.00. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED Complaints have been received that there has been tree dumping behznd the Pioneer Club. MOTION: Lease made motion, LaValle seconded to have City Clerks office send a Nuisance Notice to Mr. Gerald Waste To have trees re- moved by July 7, 1975. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED MOTION: Lease made motion, Leroux seconded to accept the resignation of Marie Jansen as secretary of the Planning Commission. VOTING FOR: Lease, LaValle, Leroux and Schletty. JUNE 160 1975 r MOTION CARRIED Clerks office to advertise for position at x$2.75/hour. MOTION: Lease made motion to adjourn the meeting at 10:59. Leroux seconded. Bob Waller stated that the White Bear Rod & Gun Club had not met all the required conditions and that the Permit should be recalled.
