3.0 APPROVAL OF MINUTES:
MOTION: Lease made motion, Smith seconded to approve
minutes of July 7, 1975, as corrected.
VOTING FOR: Lease, Leroux, Smith and Schletty.

4.0 APPROVAL OF CLAIMS:
MOTION: Smith made motion, Schletty seconded to approve
General Claims of July 21 , 1975.
VOTING FOR: Lease, Leroux, Smith and Schletty.

5.0 PETITIONS, REQUEST, COMMUNICATIONS & LICENSES:
BURIED CABLE - NORTHWESTERN BELL TELEPHONE COMPANY
MOTION: Lease made motion, Smith seconded to approve the
application of the Northwestern Bell Telephone
Company to place buried cable in Homestead Drive
north of 125th. Street North, Job Order 30845.
VOTING FOR: Lease, Leroux, Smith and Schletty.
MOTION CARRIED
MOTION: Lease made motion, Smith seconded to approve the
application of the Northwestern Bell Telephone
Company to place buried cable on Elmcrest Avenue
26' from center line of road instead of 18' as
requested by Northwestern Bell Telephone Company.
The Clerks office and or the Engineering office
be notified 24 hours in advance of installing of
the buried cable, Job Order 30838.

application of the Northwestern Bell Telephone
Company to place buried cable along 120th. Street
North and Fiona Avenue North per Sketch A. subject
to concurrence with the Ramsey CountyEngineering
Street Maintenance Department, Job Order 30842.

5.1 POLICE CHIEF VACATION
The City Council approved the Police Chief requested
vacation of October 17, through October 28, 1975.
Patrolman Jackson will work his schedule and will be
on call of which the Washington County Sheriff Office
was notified.
5.2 TENNIS COURT - ZINSCHLAG
MOTION: Lease made motion, Leroux seconded to grant
aVafiance to build a Tennis Court on Lots
24 and 25 of Sunset Park, a Variance allowing
the building of a Tennis Court with no other
principle building. A second granting of a
Variance allowing the front and side of these
two lots, the side variance between 24 and
25 zero feet; side lot of 25 south end, be
151 ; through Easterly front part of lots 25
and 24 10' variance to not less than 10' as
a Permitted Assessory Use under RR2.
VOTING FOR: Lease, LaValle, Leroux, Smith.
VOTING AGAINST: Schletty

MOTION: Lease made motion, Smith seconded to grant
a Special Use Permit to Gordon Zinschlag
to install a front yard fence on lots 24 and
25 to fence in his tennis court, a fence to
exceed the 4' maximum height,as per Chapter 98
Subd. D. and not over 101 .
VOTING FOR: Lease, LaValle, Leroux, Smith.
ABSTAIN: Schletty

5.3 SHIMOTA RE: PI.G FEED LOT COMPLAINT
Property owners live at 9824 - 140th. St. No. ,
pig farm at 9686 - 140th. St. No. , Hugo. Shimotas
claim their life style has changed considerable
due to the stench of the pigs and manure. They
no longer entertain inside or outside of their home,
they no longer enjoy their gardening due to the
smell. They further claim that the Moes, pig feed
lot owners, have not lived up to their conditions
when applying for their permit to the Minnesota
Pollution Control Agency namely; 1 . Cementing
should be removed and spread. Council informed the
Shimotas that the feed lot was grandfathered in.
The City of Hugo nor the PCA has any control over
animal odors in an Agricultural zone.

5.4 MOBILE HOME PERMIT RENE19AL - MC CLOUD
MOTION: Schletty made motion, Lease seconded to grant
a Temporary Mobile Home Permit Renewal under
Chapter 40, Article III, Subdivision D to
Robert McCloud, 9627 - 122nd. St. No. , Hugo,
Minnesota.
VOTING FOR: Lease, LaValle, Leroux, Smith & Schletty.
5.5 AMENDED SPECIAL USE PERMIT - FRED RIERMAN
MOTION: LaValle made motion, Leroux seconded to grant
an Amendment to the Special Use Perm it of
May 7, 1973 with the following conditions:
1 . Combine both lots into one single lot.
2. Increase maximum number of employees from
10 to 20.
3. Provide a metal interior facing on external
walls to a height of 10 ft.
4. Sewer system to adequately handle the additional
number of employees.
5. Surface drainage planned as he has filed.
VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty.

5.5 HUSNIK ADDITION
MOTION: Lease made motion, LaValle seconded to approve
the addition of a light manufacturing building
to Jim Husnik with the following conditions:
1 . Accept the drainage plan filed with the
City Engineer.
2. Fulltime people up to 7.
3. Adequate drainfield required by engineer.
4. Drainage to flow into Industrial Park as
authorized by Vern Peloquin.
VOTING FOR: Lease, LaValle, Leroux, Smith & Schletty.

6.0 ORDINANCES AND RESOLUTIONS
6.1 SPEED LIMIT SIGN ON EVERTON AVENUE NORTH
MOTION: LaValle made motion, Smith seconded to adopt
Resolution No. 1975-29 A RESOLUTION ESTABLISHING
A SPEED LIMIT, IN THE CITY OF HUGO, A SPEED
LIMIT OF 30 MILES AN HOUR, ON EVERTON AVENUE
NORTH AND ETHAN AVENUE NORTH FROM 120 TH. STREET
TO ELMCREST AVENUE NORTH.
VOTING FOR: Lease, LaValle, Leroux, Smith & Schletty.
MOTION CARRIED

Copies of the Resolution 1975-29 to be sent to the
Washington County Commissioners and Ramsey County.
6.2 AMEND ZONING ORDINANCE - MOToa. .VEHICLE SALES
Planning Commission held a Public Hearing with no
comments regarding amending Zoning Ordinance to include
car lots. Attorney Johnson was instructed by Mayor Lease
to draw up a resolution to amend the zoning ordinance
to permit motor vehicle sales in Retail Business by
Special Use Permit only.
6.3 DOG ORDINANCE
Attorney Johnson to meet with the Ordiance Committee
at their next meeting to make the final draft of the
Dog Ordinance.
DISCUSSION: Lease suggested some kind of identification
at a minimal fee of $1 .00 to $2.00. Police to be Wardens.
Clerk stated in prior years, they had a bullentin-board
listing the dogs that were picked up and notified owner.
Lease called recess at 9:56. Meeting called back to order at 10:15.
7.0 UNFINISHED BUSINESS
7.1 DEAF CHILD SIGN
Schletty got a cost estimate on the proposed signs to
be installed, at $100.00. After talking to the
Washington County Highway Department, it was determined
that the sign would provide false security for a
handicapped child and that their effectiveness would
be equal to that of a CAUTION sign, asign that could
be used in different areas and are printed. While
trying to install the CAUTION sign, the County was
told by the people that requested the sign that they
did not want that one installed.
NOTION: Lease made motion, LaValle seconded, to retract
the Motion made on June 16, 1975 a motion to
install tow signs to be installed on Finley Street.
VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty.
MOTION CARRIED
7.3 OPEN MEETING LAW
Attorneys recommendations are the same.
MOTION: LaValle made motion, Smith seconded to extend
the meeting beyond 11 :00 PM.
VOTING FOR: Lease, LaValle, Leroux, Smith & Schletty.

7.4 REPORT ON PIONEER CLUB
Council instructed Clerks office to send the second
Nuisance Notice to the Pioneer Club for the removal
of the debris on and near Egg Lake. They are to
appear before the Council on August 18, 1975 if no
action hasbeen taken.
7.5 STREET IMPROVEMENT
Due to the lack of funds, there will be no oiling on
any streets in Hugo.
Any major street improvements, $5,000 or over, LaValle
suggested that bids should be taken.
CULVERT PROBLEM ON HENNA AVENUE
G. Crane contacted Schletty requesting a larger culvert be
installed on Henna Avenue. He was advised by the Mayor, that
the County and the City of Hugo do not give culverts but that
if the party wants to buy one, the city will install the culvert.
8.0 NMI BUSINESS
8.1 FIRE TRUCK BIDS
The following six bids were received:
1 . Hugo Lions Club for $1 .00
2. Edward L. Trudeau 14365.00
3. Ronald A. Carlson 1)300.00
4. Robert Drummond and Dr. Richard R. Nyman $525.00
5. Dale W. Palmer $483.50
6. John Freed $426.00
Lease read letter from the Hugo Lion's Club explaining
that the Club wanted the truck kept in Hugo to be used
in parades, etc. , in and around the community. A big
percentage of the Lions Club members are Firemen and have
many fond memories and would not like to see its career
as a garbage hauler.
MOTION: Lease made motion, LaValle seconded to let the
Hugo Lions Club take the truck as the monies
offered are not too high.
DISCUSSION: LaValle said he would not like to see the truck
deteriorate. Leroux, Schletty and Smith said
the letter stated that the truck be housed
immediately and they wanted assurance that this
maintenance program be carried out.
VOTING FOR: Lease, LaValle, Leroux, Smith & Schletty.
MOTION CARRIED
MOTION: Lease made motion, Leroux seconded, directing the
Clerks office to mail all other bids back.

8.2 SUPIER OPERATOR
MOTION: Schletty instructed the Clerks office to
advertise for a qualified sewer operator,
part-time or full-time in the usual newspapers
Lease seconded the motion.

9.0 MISCELLANEOUS
MOTION: Lease made motion, LaValle seconded to issue
JOHN MOORE a sewer hook up permit for x$20.50
plus $915.00 ($515.00 residential equivalent
charge and $400.00 for water) .
VOTING FOR: Lease, LaValle, Leroux, Smith & Schletty.
MOTION CARRIED
BALD EAGLE INDUSTRIAL PARK - DRAINAGE PROBLEM
Clerk read letter from James W. Parrish, Starmold who
was inquiring as to who is resuonsible for the drainage
problem in the Park. Council said it was not a City
problem but the developers problem, Grace Development
Company.
MOTION: LaValle made motion, Lease seconded directing
the Clerks office to write the Starmold Company
asking them to contact the Grace Development
Company regarding their problem.
VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty.

MUGG BOND
Clerk read letter from Mr. James Mugg requesting the
City Council waive the required $10,000.00 bond for the
road, as he stated the road is near completion.
MOTION: LaValle made motion, Smith seconded instructing
the Clerks office to write James Mugg requesting
the $$10,000.00 Road Bond. The Bond is a guarantee
on the road not the building of it. He has thirty
(30) days to have the Bond into City Hall.
VOTING FOR: Lease, LaValle, Leroux, Smith & Schletty.

FISCHER MINING PERMIT RENEWAL
Fischer letter of credit has been received so Clerks office
will issue the renewal permit.
SECRETARY PLANNING COMMISSION
Leroux and Spitzer, Chairman Planning Commission, reviewed
applications and presented three to the Council. Leroux
recommended Mary Jane Babcock.
MOTION: LaValle made motion, Leroux seconded to hire
Mary Jane Babcock as Planning Commission Secretary
for $2.75 an hour.
VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty.

EXPERIMENTAL SEWER SYSTEM
Robert A. Anderson requested permission from the City Council
for an experimental disposal system for his home on
5.3 acre tract on Goodview Ave. as designed by Mr. R. E.
Machiner Resource Engineering and Water Waste Consultant.
Building Inspector Crever referred the matter to Engineer
Kuusisto for his approval. Forms for an agreement between
the City and Robert A. Anderson holding the City of Hugo
harmless of any liability were reviewed by Attorney Johnson
with suggested changes. Boring and ground water table
elevation would be presented to the City Engineer.
PETITION FOR RICE CREEK WATERSHED DISTRICT
MOTION: LaValle made motion, Leroux seconded to adopt
Resolution 1975-30 A Petition for an improvement
project for level control for Horseshoe Lake.
LaValle also instructed the Mayor and City Clerk to
sign the Petition and forward a certified copy to
the Board of Commissioners of the Rice Creek
Watershed District for proceedings.
VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty.
MOTION CARRIED
MOTION: Leroux made motion, Smith seconded to adjourn
meeting at 12:55.
