Attorney Johnson and Engineer Kuusisto ABSENT FOR ROLL CALL: LaValle 3.0 APPROVAL OF MINUTES: MOTION: Lease made motion, Smith seconded, to approve minutes of July 21 , 1975 as corrected. The minutes from July 21 under paragraph 3.0 should have said minutes approved as corrected. Schletty stated that he voted against paragraph 5.2 - Zinschlag tennis court. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 4.0 APPROVAL OF CLAIMS: GENERAL CLAIMS MOTION: Lease made motion, Smith seconded, to approve General Claims of August 4, 1975. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED UTILITY CLAIMS MOTION: Lease made motion, Schletty seconded, to approve utility bills. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 5.0 PETITIONS, REQUEST, COMMUNICATIONS AND LICENSES: 5.1 WHITE BEAR ROD & GUN CLUB LICENSES Kurt Sparks from Minnesota Pollution Control Agency discussed PCA's current status regarding the White Bear Rod and Gun Club. PCA felt lead shot had significant potential to pollute the waters and they want a reclaim system. The agency intends to send a letter to the White Bear Rod and Gun Club with a permit appli- cation and request plans and specifications from them. The PCA will look at the petition submitted and assess the system and then issue a permit to White Bear Rod and Gun Club if it meets their requirements. The agency is staffed with lawyers from the Attorney Generals office and they will enforce viola- tions of PCA standards. AUGUST 49 1975 5)5 5.1 WHITE BEAR ROD & GUN CLUB LICENSES CONT. Lease stated he would like a copy of the PCA's letter to the White Bear Rod and Gun Club and Mr. Sparks stated this is their normal policy. The White Bear Rod and Gun Club has not, as yet, submitted specifications for their proposed sewer system. There was no one present to represent the White Bear Rod and Gun Club. MOTION: Motion made by Lease, seconded by Schletty, to deny White Bear Rod and Gun Club applications for non-intoxi- cating liquor, cigarettes, and soft drink license as they have not complied with conditions of their permit as previously outlined, specifically sanitary sewer permit, cost reimbursement in the amount of 53,413 and obtaining Certificate of Occupancy. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED MOTION: Motion made by Lease, seconded by Schletty, seconded by Smith, that the City Clerk be instructed to notify the White Bear [pd and Gun Club that there will be no use of the facilities until all of the permit requirements are met, including but not limited to: 1 . Sanitary sewer permit filed and approved by the Minnesota Health Department. 2. Reimbursement of all expenses in the amount of $3t413-00- 3. Obtain Certificate of Occupancy. 4. In compliance with any other Local or State regulatory agencies. VOTING FOR: Schletty, Lease, and Smith. AGAINST: Leroux MOTION CARRIED 5.2 P. A. LUMBLAD - TEMPORARY MOBILE HOME PERMIT MOTION: Motion made by Schletty, seconded by Smith, to issue a temporary mobile home permit under Chapter 40, Article III, Subdivision D. to P. A. Lumblad. VOTING FOR: Smith, Schletty, Leroux and Lease MOTION CARRIED 5.3 ST. JOHN THE BAPTIST CHURCH MOTION: . Motion made by Lease, seconded by Leroux, to approve the non-intoxicating liquor, and soft drink license for St. John the Baptist Church. AUGUST 4, 1975 VOTING FOR: Smith, Schletty, Leroux and Lease. MOTION CARRIED 6.0 REPORTS OF OFFICERS AND COMMITTEES 6.1 PLUMBING INSPECTOR - BOB VADNAIS No report. 6.2 ORDINANCE COMMITTEE 6.2.1 What Ordinance is the committee to work on next? Lease felt a "driveway ordinance" should be written and "Subdivision Ordinance" should be reviewed. Jim Smith stated Ordinance #264, "Shooting Regulations" has no reference and felt that it should be reviewed. 6.3 PLANNING COMMISSION Mary Ih bcock was introduced to the City Council, City Attorney and City Engineer. Bob Burkard read letter from the Senate Metropolitan Subdivision on land use requesting someone from the Council to make a 10 minute presentation on the land use of Hugo at their meeting on August 18. The Council has a meeting that night so the City Clerk was instructed to contact Dan Spitzer to see if he could go or have someone attend from the Planning Commission. 6.4 SEWER COMMITTEE Kuusisto stated that they should have dwgs. for storm sewers and streets by the next meeting. MOTION: Motion made by Smith, seconded by Schletty, to direct the City Engineer to get final plans and specifications for storm sewers and street restoration - Project #1975-1 . VOTING FOR: Smith, Schletty, Lease and Leroux MOTION CARRIED 6.5 BUILDING INSPECTOR Tom Crever submitted report of permits issued. Tom Crever asked if the Pioneer Club cleanup was satisfactory. Lease stated that they were satisfied. There is aproblem with debris left behind by the sewer construction crew and other debris from other sources. Howard Kuusisto was instructed to inspect the area. A Mr. William Pavek . was installing a 6 foot fence in the front of his home and Mr. Crever instructed him to stop work and obtain a "Variance." Mr. Parek agreed to stop and called Mr. Burkard and then went ahead and finished installing the fence without the "Variance." Tom Crever was told to send a letter to Mr. Pavek instructing him to obtain a Special Use PArmi t nr "PmnlrP +}1P fannc wi+hi n 'A(1 Amro AUGUST 4, 1975 �; 9 v 6.6 FIRE CHIEF No Report. 6.7 POLICE CHIEF 6.7.1 LILLY'S RESIGNATION MOTION: Motion made by Lease, seconded by Schletty, that we accept Lilly's resignation from the Police Department effective August 9, 1975. VOTING FOR: Lease, Leroux, Smith and Schletty MOTION CARRIED If Mr. Lilly withdraws his resignation, the Council said Mr. Lilly should be reinstated. 6.8 ATTORNEY Attorney Johnson submitted his monthly report - File No. 1500 Tom Crever asked about the Tauer apartment case. It was stated that the complaint has been drawn up and is in the hands of the Police Department. Burkard was instructed to ask Barth what action the Police Department has taken and report at next Council Meeting. 6.9 ENGINEER Engineer Kuusisto submitted report. 6.10 CLERK 6.10.1 - LOUISE BRENIER - DEPUTY TREASURER MOTION: Leroux moved, Smith seconded, to appoint Louise Brenier, Deputy Treasurer and the appropriate bonds be obtained. VOTING FOR: Smith, Schletty, Lease and Leroux MOTION CARRIED 6.10.2- Burkard discussed changes to Engineering fees for the Road Budget. 6.10.3 - MUGGS - Mr. Burkard read letter submitted by Mr. Muggs requesting the $10,000 bond be reduced and the $1 ,000 in escrow. The $10,000 bond is to protect the City from future damage and Kuusisto stated the Engineers are aware of this. MOTION: Motion made by Smith, seconded by Schletty, that we reply to Mr. 11aggs that the first letter we sent is the one we want to hold him too and the $10,000 bond stands. AUGUST 4, 1975 VOTING FOR: Lease, Smith, Schletty and Leroux MOTION CARRIED 6.11 TREE INSPECTOR Dutch Elm Disease - 69 trees marked - 35 removed. 6.12 ARTHUR ROMER - CERTIFICATION OF ASSESSOR Attorney Johnson stated that he went over contract from County and he will go over it with Burkard to fill it out. Lease called recess at 9:00 Meeting called back to order at 9:22. 7.0 ORDINANCES AND RESOLUTIONS 7.1 ORDINANCE FOR MOTOR VEHICLE SALES MOTION: Smith made resolution, seconded by Leroux, to adopt Ordinance No. 123 an Ordinance amending Chapter 320 of the Hugo City Code, entitled "Zoning" VOTING FOR: Smith, Schletty, Leroux and Lease MOTION CARRIED 8.0 UNFINISHED BUSINESS 8.1 ROBERT A. ANDERSON SEPTIC TANK MOTION: Motion made by Smith, seconded by Schletty, that the Robert A and Kathleen Anderson Plans be accepted with the appropriate signatures and it shall be recorded at the County Registar of Deeds. VOTING FOR: Smith, Schletty, Lease and Leroux MOTION CARRIED 8.2 PIG FEED LOT INSPECTION (JERRY MOE) Lease stated that the pigs are gone and Mr. Moe has spread the manure. Smith said that he made an on-site irB pection of the property and Moe had told him the PCA has been out and had made the following suggestions which he plans to carry out: 1 . Spread manure; 2. Make Apron. Mr. Moe plans to cement prior to bringing in more pigs. 8.3 P. KAMMAN - DEAF CHILD SIGN Schletty reported that the City could obtain two "Deaf Child Signs" for the following prices: ° 82.00 with posts or $48.00 without posts for two. The Kammans were asked how long they would intend to leave the signs up. They replied until the child is more aware of his handicap. AUGUST 4, 1975 « 9 MOTION: Motion made by Leroux, seconded by Schletty, that Howard Schletty order deaf child signs from the County at a cost of : 48.00 for two and have them put up. VOTING FOR: Smith, Schletty, Lease and Leroux MOTION CARRIED 9.0 NEW BUSINESS No new business. 10.0 MISCELLANEOUS Schletty made a report on some road work done on 165th and Ingersoll, and 1b.nna Avenue north of County Rd. 4. Lease reported that the road by Sunset Lake is caving in. Burkard reported the road behind the post office needs repair. MOTION: Motion made by Leroux, seconded by Schletty, to adjourn at 10:45 P.M.
