PRESENT: LaValle, Leroux and Smith (LaValle was Acting Mayor until Mayor Lease arrived at 7:20 P.M.) ABSENT: Schletty 3.0 . APPROVAL OF MINUTES: An Ordinance amending Chapter 320 of the Hugo City Code, entitled "Zoning" was noted as being Ordinance #123 which should be inserted in the minutes of the City Council Meeting of August 4, 1975. MOTION: Leroux made motion, Smith seconded to approve minutes of August 4, 1975 with the above noted insertion. VOTING FOR: LaValle, Leroux and Smith MOTION CARRIED 4.0 APPROVAL OF CLAIMS: MOTION: Leroux made motion, Smith seconded, to approve General Claims of August 18, 1975. VOTING FOR: LaValle, Leroux, and Smith. MOTION CARRIED 5.0 PETITIONS, REQUEST, COMMUNICATIONS AND LICENSES: MOTION: Leroux made motion, Smith seconded to grant a Renewal Mobile Home Permit to George T. Miron at 15250 Homestead Avenue, North under Chapter 40, Article III, Subdivision D of the Hugo City Code, at a renewal fee of $10.00. VOTING FOR: LaValle, Leroux and Smith. MOTION CARRIED BURIED CABLE - N.W. BELL TELDPHOYE- 137TH ST. NO. TO HOMESTEAD AVE. AND 140TH ST. NO. MOTION: LaValle made motion, Leroux seconded to approve the application of the Northweste:�; Bell Telephone Company to place buried cable on 137th street North to Honestead Avenue and 140th. Street North, Job Order 30898. VOTING FOR: LaValle, Lercux and Smith MOTION CARRIED PIONEER CLUB - NUISANCE ABATE NOTICE The Pioneer Club had a deadline date of August 18 to remove the trees and debris from their property. They are in the process of working out a reasonable type of agreement as to who is responsible for what percentage of debris. AUGUST 18, 1975 ' .. MOTION: LaValle made motion, Smith seconded to grant an extension of time to the Pioneet Club on their Nuisance Abate Notice to September 2, 1975. VOTING FOR: LaValle,Leroux and Smith MOTION CARRIED 5.3 AXELSON REGARDING GUN CLUBS Mrs. Axelson stated that ohe Gun Club created enough noise on one grounds and resented that the White Bear Rod and Gun Club could shoot also at the Bald Eagle Gun Club. Stated her husband works nights and finds it difficult to sleep while the shooting is going on during the day. Bob Salchow from the Bald Eagle Gun Club said that the 6-8 teams that are shooting at their Club are invited guests that this is their way of generating income to their Club. These teams are a small percentage of the teams that shoot at the White Bear Rod & Gun Club, namely 80 to 100 teams. The teams were invited to complete their shooting season and therefore the situation is only temporary. LaValle said the Club is grandfathered in and that no Permit is issued to the Club from the City so conditions have not been set by the City. S. Chapman did not like the increase in shooting would rather see it decrease. He also stated that in charging guests the Club was becomming Commercial and it is suppose to be non—profit. Jim Kindsvater, from White Bear Rod & Gun Club, resented the teams being labeled White Bear Rod & Gun Club as these teams could be representing any other Club and probably would not have any problem. Smith read letter from Mrs. Lindquist registering complaint against Gun Club noise. T. Peltier questioned whether the Club was selling beer. Answer was no. Questioned whether beer could be on premises. Answer was no. Stated whe would like one complete day without shooting. Lease asked Bob Salchow if he would talk to S. Chapman regarding limiting the hours of shooting at the Club. He said he would. 6.0 ORDINANCES AND RESOLUTIONS: Lease asked Clerks office what procedures were necessary to change Voting Place for Ward 2. Clerks office to check. 8.0 NEW BUSINESS DELAYED CONNECTION CHARGE FOR SEWER A fee of Three Hundred Dollars shall be paid at the time AUGUST 18, 1975 DELAYED CONNECTION CHARGE FOR SWER cont. of securing the permit for connection after said twelve month period. Do to the high water table, it was requested by the Clerks office for the Council to consider extending the penalty time for six months, March 1 , 1976 instead of November 20, 1975. Lease asked Clerk and attorney to check into the matter. CETA PROGRAM Smith stated that the City of Hugo would be eligible for another CETA funded person. The program is extended through June 30, 1976. Engineer Kuusisto was asked to write a Job Description for a Sewer Operator Class S-C and report back to Council on September 2, 1975. 7.0 UNFINISHED BUSINESS STREET AND STORM SEWER IMPROVEMENT Attorney Johnson after reviewing the Improvement Program 1975-1 suggested extending the time for withdrawing a bid from 30 to 45 days. MOTION: LaValle made motion, Smith seconded to advertise for sealed bids to be received by the City of Hugo until Thursday 2:00 P:M. ; September 18, 1975 for the 1975 Street & Storm Sewer Improvement. VOTING FOR: Lease, LaValle, Leroux and Smith. MOTION CARRIED PALME SEWER PROBLEM LaValle stated no bills have been submitted to the bonding company as the bill from Hood Incorporated has not been received yet. Hood is waiting for the bill from the firm that did the dewatering before submitting their claim to the City. WHITE BEAR ROD AND GUN CLUB: Conditions being questioned by the City Council: 1 . Sanitary Sewer System - verbal approval from the Minnesota Dept. of Health has been received by the Engineer. Corrected copies made by engineer, are to be sent to the Dept. of Health. 2. Engineering, legal and the Study of the National Biocentricts fees amounting to x$3,413.00. City questioned when they could expect payment. Club President Perron stated they will take care of the costs. 3. Before a Certificate of Occupancy can be issued, all requirements have to be met and a final inspection by the Building Inspector has to be made. A"- AUGUST 189 1975 1 r7 1 Perron stated the Club was going to request an extension l of time on the tree planting due to the fact that the trees wouldn't be available until next Spring. They are going to get the trees through the State and won't be able to get the requested forms until the first of September. The Planning Commission is making an on site inspection on Saturday, August 23, 1975. The Council will act on the Special Use Permit at their next Council Meeting of September 2, 1975, after the report is submitted to the Council. Mayor Lease called recess at 9:25. Back at 9:35. 9.0 MISCELLANEOUS: VAIL PERFORMANCE BOND: Performance bond expired October 15, 1973, twice informed as such. MOTION: LaValle made motion, Lease seconded requesting Clerks office to write R. Vail requesting the Performance Bond for Vails Evergreen Hills 2nd. and 3rd. to be brought up to date. No building permits will be issued until the bond is received. Clerks office to notify Building Inspector. VOTING FOR: Lease, LaValle, Leroux and Smith MOTION C_4RRIED When the road is complete, the bond will be pulled. Blacktop is needed. REHBEIN CONTRACTING COMPANY Mining Permit renewal will be September 30, 1975. Lease instructed Clerks office to write Rehbein asking him what his intentions are regarding the Mining operation. What plans he has on termination. Either renewal the mining permit and submit letter of credit or put back to agreed conditions. Copy to C. Johnson. OAKSHORE PARK Problems on Europa - heavy ponding. Council felt it was to late in the season to correct problem now. Funds are very low. CLERKS RESIGNATION: MOTION: Lease made motion, Smith seconded that the Council has received and accepted the letter of resignation from Clerk Burkard. VOTING FOR: Lease, LaValle, Leroux and Smith.
