PRESENT: Lease, Leroux, Smith and Schletty LaValle arrived at 7:31 P.M. ABSENT: None 3.0 APPROVAL OF MINUTES: MOTION: Lease made motion, Smith seconded to approve minutes of August 18, 1975. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED 4.0 APPROVAL OF GENERAL CLAIMS: MOTION: Lease made motion, Leroux seconded to approve General Claims of September 2, 1975. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED APPROVAL OF UTILITY CLAIMS: MOTION: Lease made motion, Sckiletty seconded to approve Utility Claims of September 2, 1975. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED 5.0 PETITIONS. REQUEST, COMMUNICATIONS AND LICENSES: 5.1 GANOE MOBILE HOME PERMIT RENEWAL MOTION: Leroux made motion, Schletty seconded to grant a Renewal Mobile Home Permit to Neil L. Ganoe at 5625-165th. St. No. under Chapter 40, Article III, Subdivision B of the Hugo City Code, at a renewal fee of $10.00. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED 5.2 MRS. WOLKERSTORFER — HOW TO BUILD ON 5 ACRES IN CONSERVANCY ZONE It was recommended that the only way to build on 5 acres in Conservancy was by petitioning for rezoning. 5.3 RAY PELTIER — WATER PROBLEM Stated he has water in his basement since Good Nieghbor Days, June 27-29, 1975. Living on a corner lot, stated both streets, frontand side are slanting toward his house, plus the driveway of the Fire Hall which also slants to his house. Never had a water problem before, but with the severe rains plus fireman washing hoses on SEPTEMBER 29 1975 7 5.3 RAY PELTIER - WATER PROBLEM CONT. there driveway and the hydrant break has resulted in heavy damage to his basement tile and wall paneling. Wanted to know if any compensation could be made. Clerk Burkard said that the City has insurance on such claims and suggest he contact the Agency. Engineer Kuusisto:'is to investigate the streets to see if the 4-5 loads of dirt, as suggested by Peltier, would be adequate to eliminate his problem until the street improvement plans goes through. 6.0 REPORTS OF OFFICERS & COMMITTEES RAY PALME SEWER PROBLEM Attorney Johnson stated that all expenses incurred on the Palme Sanitary Sewer Repair are in. MOTION: Motion made and seconded that clerk be instructed to send cost of damage, $1112,136.67 to City sewer, by Ray Palme to his Bonding Company for pa yment to the respective parties and also indicating those obligation that the City have paid. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED 6.2 PLANNING COMMISSION: White Bear Rod and Gun Club Inspection report discussed. 6.4 BUILDING INSPECTOR: 4 New Homes; 4 Garage, 2 Storage Buildings and 1 sign. 6.6 POLICE CHIEF: Reprted mileage on squad at 46,544 at which time he recommended a new squad for the department if the old squad was to be used for a second. Council suggested he have this in his 1976 budget which is due the 15 of September. 6.7 ATTORNEY A modification of the Sanitary Sewer Chapter of the Code was prepared and presented to the Council. After discussion it was decided to insert the Residential Equivalent Charge for new homes being built, in this Chapter also. Attorney to revise and submit at next meeting. HORTON-V-CITY - Interrogatories have been answered and Responses to Requests for Admissions have been prepared. Interrogatories to Horton have been prepared and served. 6.8 ENGINEER Job Description of Sewer Operator Class S-C presented to Clerk along with the different classes of operators. to be sent to Bruce Larson, CETA. SEPTEMBER 2, 1975 17 9 6.8 ENGINEER CONT. STREET AND STOR1.1 SEWER PROJECT: To date, ten (10) plan holders have been received - bids will be received by the City Council on September 18, 1975 at 2:00 P.M. HUD GRANT: The final inspection has been completed by Mr. J. Telfer of HUD. The clean-up list has been completed, with the exception of a few items including the material to be removed east of the Pioneer Club on the easement location. The Contractor has been notified of this clean-up. Area has accumulated more debris since the last inspection. Hoffmans will probably remove burnt trees and Pioneer Club the remainder. BALD EAG_ INDUSTRIAL PARK: The Bald Eagle Industrial Park sani ary sewer and rough grading has been completed, except that Grace Development has not completed the street grading. The Development Corporation contacted the City Engineet and requested that any grading of street work on their part would be delayed to 1975. Rough grading has been completed, but the drainage facilities have not been installed. WHITE BEAR ROD AND GUN CLUB: Private Sewage disposal system - new plans and specification have been reviewed and corrections submitted to the tlhite Bear Rod and Gun Club. Engineet has been informed by Carley Engineering that corrections would be resubmitted to the Department of Health for their records. The Engineet and Council have been notified that the work would be according to the corrected plans and specifications. PIONEER CLUB - Council extending Nuisance Abate Notice until September 15, 1975 and that Gerald Waste should be notified as such through the Clerks office also suggesting to him that No Dumping signs should be posted as people are still hauling in trees. Some of the trees have Dutch Elm desease. CAUTION SIGN AT SMITH POINT - Letter received from Mrs. Marie Rolph requesting Washington County to install some type of "caution" sign at the Smith Point exit to Everton Avenue. After discussion by Council it was determined that this request should be asked of Ramsey County and that the Clerks office should notify Mrs. Rolph of such. 1976 BUDGET - Clerk requested budget in by September 15, 1975. Recess called at 9:00 returned at 9:18 P.M. 9.0 WHITE BEAR ROD & GUN CLUB RENEWAL OF SPECIAL USE PERMIT: Clerk Burkard read letter from J. L. Perron, President of the White Bear Rod & Gun Club requesting a ten (10) month extension of Item #2 of the Special Use Permit to July 1 , 1976. AUGUST 29 1975 ; 9.0 WHITE BEAR ROD & GUN CLUB REN-9iIAL OF SPECIAL USE PERMIT CONT. J. K_indsvater paid the $$15.00 for the Variance Application. MOTION: LaValle made motion, Leroux seconded to grant a Variance to the White Bear Rod & Gun Club for a ten month tree planting, Item #2 of their Special Use Permit, extension to July 1 , 1976. VOTING FOR: Lease, LaValle, Leroux. VOTING AGAINST: Schletty ABSTAIN: Smith MOTION CARRIED DISCUSSION: Smith asked attorney Johnson if it was legal to grant an extension of time even after the deadline date had been reached. In his opinion the Permit was null and void as the planting date of June 1 , 1975 had not been met. Schletty stated that the planting of Lombardy Poplar trees had not met the requirements. LaV lle stated he heard the Club will install a lead recovery program at their earliest financial convenience. As far as he was concerned the Club had met all regulations with the exception of the reimbursement for legal, engineerin and the enviromental study at the costs of 3,413.00. Two Certificate of Occupancy are to be issued one for the structure and one for the trap and skeet house. Building Inspector could issue a certificate for a portio: only, listing facilities the Club could or could not use. MOTION: LaValle made motion, Leroux seconded to renew the White Bear Rod & Gun Club Special Use Permit subject to payment of 13,413.00 which is in regard to Conditions #21 and #24 of the Special Use Permit. VOTING FOR: LaValle, Lease, Leroux VOTING AGAINST: Smith and Schletty. MOTION CARRIED Attorney Edward Zimmermann representing HELP said there was no record of a Variance being granted extending the time of tree planting to a certain date and that this condition had not been met, the Special Use Permit should become null and void in its entirety. Can this permit be renewed or a new Special Use Permit be sought with a new public hearing. Attorney stated the City of Hugo has a responsibility bf land use. Fencing condition had not been met. SEPTEMBER 29 1975 S 9.0 WHITE BEAR ROD & GUN CLUB CONTINUED: Mayor Lease stated the City has expended much money researching the problem and are tired of always new provisions, new agencies coming up with new rules and regulations costing the City more money for research. J. Perron asked Council again if the Club would be issued a partial Certificate of Occupancy by the Building Inspector after inspection. Answer yes. J. Perron paid the reimbursement amount of $3,413.00. MOTION: Lease made motion, LaValle seconded to adjourn meeting at 10:31 P.M. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith.
